Murphy/Response to Determination of No HazardJanuary 15, 2010 DOT/FAA Tameria Burch, AWP-520/AJR-32 15000 Aviation Blvd Hawthorne, CA 90260 Subject: Response to Determination of No Hazard to Air Navigation Dear Ms. Burch; The State of Montana currently has no laws or regulations enforceable by the State concerning aeronautical obstruction standards regarding height, however, there are several state laws that allow and compel local airports, if affected, to review and take action regarding height limitations for airport obstructions and hazards as defined within Montana Code Annotated. In addition to the above statement, I have reviewed Aeronautical study : 2010-ANM-45-OE and would like to make the following comments of concern that could affect safe air navigation in Montana. We recommend the proposed Antenna tower at a height of 172' AGL to be located approximately 3 miles W. of Kalispell City airfield, be marked and lighted in accordance with FAA Advisory Circular 70/7460-1 AC70/7460- 1 K. (Obstruction Marking and Lighting, red lights) The Kalispell City airport elevation is 2932' MSL, the elevation of the highest site and Antenna tower is 3872' MSL making the Antenna tower request 940' above the Kalispell City airport elevation.
