Spillman/Letter of Concurrence06/05/08 Re: Letter of Concurrence, Callsign WNSG910 Dear Fred, I wanted to make sure all parties understand and agree to the terms set forth in the LOC sent to us by the State of Montana. The IMPD radio project wants to construct an adjacent frequency (155.97) on Big Mt for the new trunking system, and that frequency is next to the City of Kalispell's Public Works frequency, 155.985. While the Big Mt site is 32 kilometers away, there is the chance of interference on the existing Public Works frequency. The possible interference would come in the form of a digital chatter type of noise. If interference does occur, the State of Montana specifically the IMPD must rectify the > P Y Y � problem if it occurs. This might include the need to add "Channel Guard" to the PW radios, or others procedures which will not impact or cost the City. If corrections cannot be made to satisfy the City, the channel would be taken off the air and the State would need to find another frequency. I will be available to observe all terms are met, and will take any measures needed to enforce the terms under this letter with the St o not see anything to cause worry, but I do want to ensure the City of its conti ed roper use of its frequency. Subject: Letter of Concurrence: State of Montana/Interoperability Montana Application, #42YWAP380209012, use of 155.9700 MHz The City of Kalispell, concurs (approves) with the State of Montana/Interoperability Montana Project application for the use of frequencies 155.9700 MHz, for use at the Big Mountain Site, as described in the above referenced application. This letter further conveys the intent of the State of Montana/Interoperability Montana Project to work with the City of Kalispell, in a harmonious manner to negate any harmful system interference issues that may arise on their adjacent frequencies 155.9850 MHz. Should any harmful interference occur, all appropriate expense to remedy such interference shall be at the expense of the State of Montana/Interoperability Montana Project. This LOC in no way limits the City of Kalispell, from utilizing their spectrum in their licensed area (WNSG910). Any interference experienced from the location listed in the application will be addressed to the mutual benefit of both parties. Any interference that arises from said deployment is strictly the problem of State of Montana and the Interoperability Montana Project. If any interference to the City of Kalispell frequencies is detected and not resolved within 30 days the State of Montana/Interoperability Montana Project shall discontinue the use of said frequencies until a resolution is found. A copy of this LOC shall accompany the official license application as an exhibit and remain on file with the FCC.
