Stokes/KGEZFred and Connie Leistiko From: "John Stokes" <stokes a@z600.com> To: <airport@kalispell.com> Sent: Friday, April 27, 2007 4:25 PM Subject: KGEZ April 26, 2007 To the Kalispell City Council, At Mondays council meeting you were introduced to and asked to consider hiring a Seattle based engineering firm to present you with options concerning the City airport and the KGEZ towers. You are being asked to spend taxpayers dollars and fund $34,000 to begin with and most likely an additional $200,000.00 None of you were in office in 1999. That council hired experts to address the exact issues and make same exact recommendations. I direct your attention to the Vir James Report of August 1999 titled "Kalispell City Airport Feasibility 1 Master Plan" page 20, complied by Morris and Merilee. Every proposal your being asked to now pay for is contained in that report of August 1999, 1 am not remotely even going to consider an experimental array. Nor am I going to lower the tower and lose the signal. I am not going into any business relationship with KOFI. Therefore you are hereby advised, I will not accept any of the proposals. You are wasting your time and the citizens' money. The law is clear. There are only three choices, You purchase it, I give it to you or you condemn. You are fooling yourself if you think you can do a partial condemnation. My answer to your partial condemnation complaint will be that it is a total condemnation and we will litigate for years including any appeals. MDOT just recently appealed the decision entered. We can have a friendly condemnation and relocation suit or a hostile one. At no time has this city mediated or bargained in good faith with KGEZ. I suggest you immediately hire Bill Ferro, the appraiser used by MOOT, as he is familiar with the property and the property rights of all involved because an appraisal of the assets and all real estate must be performed first prior to any condemnation and offer. An easement is real estate. There is also still the matter of the outstanding fee of $40,000.00 owing from the trespass into the KGEZ antenna field from the building of the water and sewer lines. I signed the agreement, prepared at the request of Jim Patrick by Charlie Harball. There is also the interference of Fred Listiko during the MOOT case and soliciting a job for his wife, to sue KGEZ and pay KGEZ nothing for the condemnation of its properties. The delay cost me $90,000.00 Therefore, if there are to be any meaningful discussions, I will not engage if any of the three above named individuals are involved.
