TIM ► DUANE LARSON, WAYNE SAVERUD, AND JEFF ZAUNER WERE Also present: City Manager Jane Howington, City Attorney Charles Harball, City Clerk Theresa White, Chief of Police Roger Nasset, Planning Director Tom Jentz, and Revolving Loan Fund Manager Wade Elder. Mayor Fisher called the meeting to order and led the Pledge of Allegiance. Kenyon moved to approve the Agenda. The motion was seconded. There was no discussion. The motion carried unanimously upon vote. 1. Council Minutes — Regular Meeting — November 7, 2011 2. Award Bid — Single Axle Dump Truck Three bids were received for a Single Axle Dump Truck with Snowplow and Sander from I State Truck Center ($126,635), Montana Peterbilt ($127,780), and Western States Truck Centers ($124,865). Staff recommended the bid be awarded to Western States Truck Centers. 3. Ordinance 1703 — Initial Zoning Request — Department of Military Affairs — 2nd Reading The state department has requested a zoning designation of P-1, Public, on approximately 20 acres of property which is the current location of the National Guard facility on the east side of Highway 93 North. Ordinance 1703 passed unanimously on first reading November 7. 4. Ordinance 1704 — West Side Urban Renewal District — 2nd Reading Ordinance 1704 amends the West Side Urban Renewal Plan including expanding the plan boundary. Ordinance 1704 passed unanimously on first reading November 7. Saverud moved to approve the Consent Agenda. The motion was seconded. There was no discussion. Kalispell City Council Minutes November 21, 2011 Page 1 Vaughn Penrod, Penco Power Products, remarked the city is having a serious problem with graffiti and suggested contacting the landowners to keep it under control. Chris Hall, 115 West Evergreen Drive, lamented how things have changed in Kalispell over the past ten years. Diane Groves, 436 10th Avenue West, read a letter she sent to the newspaper noting that 4-6 poultry would be a reasonable number on a typical city lot. She also criticized the council member who took pictures of her property without permission. 1111111 1 1 � 114 Pli;�l��ljjjjj�� I 1 0111 � I H r1liv The City of Kalispell has been awarded a grant with a total funding amount of $424,970 for remediation of erosion along the banks of the Stillwater River. The grant requires a 25% match from the city in the form of in -kind services. Howington gave a report and answered questions. Public Comment Steve Dunfee, Buffalo Hill Golf Course General Manager, stated the Kalispell Golf Association supports the resolution and thanked staff for working on the grant. Atkinson moved Resolution 5533, a resolution amending the annual appropriations of the City of Kalispell, Montana, as set forth in the 2011-2012 budget adopted by the city council for the purpose of acceptance of a FEMA Grant for the Golf Course/Lawrence Park Trail Bridge sites spring storm and flooding disaster. RESOLUTION 5534 — DNRC GRANT ACCEPTANCE AND BUDGET APPROP- RIATION — URBAN FORESTRY GRANT The City of Kalispell has been awarded a grant with a total funding amount of $3,890 for its Urban Forestry Program to be used for 25 boulevard trees. Atkinson moved Resolution 5534, a resolution amending the annual appropriations of the City of Kalispell, Montana, as set forth in the 2011-2012 budget adopted by the city council for the purpose of acceptance of a DNRC Grant for the planting of residential boulevard trees. The motion was seconded. Council Discussion None. The motion carried unanimously upon roll call vote. The public hearing would be scheduled for December 5 to accept public comments on several proposed updates to the city's subdivision regulations. Jentz gave a report and answered questions. Public Comment None. Gabriel moved council call for a public hearing on December 5, 2011 to accept comments on the updates to the subdivision regulations. The motion was seconded. FOB111 1L t 1 Following the federal census, cities are required to examine voter wards to determine whether they are fairly proportioned. The planning department has examined the Census 2010 block data and Ordinance 1706 adjusts the ward boundaries as required. Harball and Jentz gave reports and answered questions. Public Comment None. Kalispell City Council Minutes November 21, 2011 Page 3 Larson moved first reading of Ordinance 1706, an ordinance amending Ordinance No. 1446 codified as Section 6-1 of the Kalispell City Code by re-establishing the boundaries of the wards of the city based upon Census 2010 population figures and the mandate of state law at Section 7-5-4401 Montana Code Annotated. The motion was seconded. Council Discussion Hafferman questioned whether the map was done using registered voters or residents and remarked the wards would be easier to describe using straight boundaries and landmarks like the railroad tracks. The motion carried unanimously upon roll call vote. Howington thanked planning and legal staff for their work on the ward boundaries ordinance, particularly Cookie Davies. Mayor Fisher asked Nasset what is being done about the graffiti and was informed that Restorative Justice removes a lot of it. Kluesner recognized Boy Scout Troops 1903 and 1933 in the audience, some of whom are working on their citizenship badges.
