PERFORMANCE BOND REMINDERS: Ashley Heights — The sound wall and drainage
swale were put together in the Letter of Credit, but we wanted them to be separate in case one
gets built but the other doesn't. That way we can decrease the Letter of Credit. We do not have
a new S.I.A. Burnham contacted their real estate agent and discovered that any lot in their
subdivision may be bought and built on, but that the Turner's do not intend to build the wall until
they get enough homes built in that area to pay for it. Jentz explained that if they do not build the
wall by the August, 2012 due date when their S.I.A. is up and there are houses in that area, we
will cash in their Letter of Credit bond and have it built.
OLD BUSINESS: Spring Prairie Phase 3/Kohl's — Zoning and Parks have sent their
comments. Wargo will double check the drainage basins. Public Works will send their comments
directly to them. Fire is okay with this project.
Dino Sore —modular on Claremont — We have looked at the Administrative CUP before, and now
they are coming in for the Building Permit. They are trying to avoid having the independent
utility connections, so they are flipping it from the south property line up further to the north
where there is a grade change ... somewhat of a retaining terrace wall area that they will butt up
to. There needs to be some coordination with Public Works as to how close they need to be to
not have independent connections and what they may need to do for fire wall separations if they
butt up against the buildings. They will need to pay impact fees on the additional square footage,
fixtures, etc. Burnham stated we will need to see what will be inside that building and the existing
building in order to calculate the fees. They have a wheelchair ramp and steps coming off, but
they may need to make it a one way loop instead of a two way with the driving aisle. We also
need to figure out if they have extra handicapped requirements as part of daycares like this.
Public Works will sign off on this pending the impact fee calculations. This is approved through
Site Review with conditions.
NEW BUSINESS: None.
PLANNING OFFICE ITEMS: Nothing for the September meeting.
OTHER REPORTS: Flathead County Weed Department is talking about building on the block
north of the old Scarff auto. They are considering a steel building by American General. It may be
sprinklered. They plan on using it for a storage yard and maintenance buildings, but will need to have
a predominantly office use, if they want to comply, since quasi -industrial uses are not a permitted in
that zone. Then the first floor could have storage and equipment. They plan to put the building up
against the alley and put a park in the front area.
Smith's Drive Thru Pharmacy — Elkins will send a letter regarding their Certificate of Occupancy
being denied, based on the conditions that Burnham previously submitted to the Building Dept. and
on the Zoning conditions that P.J. also submitted.
