Here's a letter from Gary Gates of F.A.A.. The 12-17-2002 E.A. was only good for three years! It was good for five years if we were seeking federal funds, that five year period had elapsed in 12-17-2007 because the council didn't vote for a re-do in a five year time limit and the E.A. was not updated between 12-17-2005 and 12-17-2007. They dropped the ball. That's why F.A.A. in Helena told me that we are at square one. They are trying to do a redo with out getting peoples (public's opinion) they want to spend 10 to 15 thousand dollars to get a bias firm to tell us we need F.A.A. involvement in our Airport. Give us 10 to 15 thousand dollars to find better use for that airport property. Let me know if there are any laws being broke here. The Montana State attorneys office told us to turn it over the Flathead County Attorneys Offices to a Mr. Jonathon Smith if we suspect any form of corruption. This is corruption as far as I'm concerned. It will be a illegal vote this Monday, as it's past the F.A.A. guidelines and requirements. This should be tabled!!!!! An airport owner may select a qualified engineering consultant for a period not to exceed 5 years. The owner may choose to re-select a consultant sooner eg. less than 5 years if they choose. 2. The maximum five year period is a requirement if the airport is seeking federal funds under the Airport Improvement Program (AIP). We understand that the City is interested in pursuing federal funds to improve the airport. 3. AIP funding requires that the airport owner secure engineering consultants (planning, environmental, design etc.) at least every five years if seeking federal funds under AIP. If the owner is not requesting federal funds than local and state procurement rules would apply. An environmental document (EA) is generally valid for a period of 3 years, at which time the documents must be updated if the proposed improvements will be federally funded. 4. There is not a requirement for the airport owner to select a separate firm conducting the environmental assesment (EA) vs. the engineering design. Neither the FAA nor the City are obligated to fund the improvements recommended in the EA or planning studies. Gary M. Gates, P.E. Do you really require that "engineering contracts and planning services be re-bid every five years even if the airport may not be expanded or be closed? What is the reason behind this claim? 4.
