WKYC-TV <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=001-3f9&t=c> Cleveland (9/16, Russ) reported, "Citizens who have worked for two years on changing the form of Cuyahoga County government say there are many safeguards against corruption, cronyism, and one-party domination." Former Shaker Heights Mayor Judy Rawson, "who has been working on several committees planning for the new form of county government," stated that "The Code of Ethics calls for training of all employees, protection for whistle blowers, very strong prohibitions against getting anything of value for doing your job." Additionally, "Safeguards are being built into the system, which will change Cuyahoga County to an executive/council form in January, 2011. Voters approved the change last year. The new executive and 11 council members will be elected this November 2." Pepper Pike Mayor Bruce Akers agrees. The Tonawadna (NY) News <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=003-1d6&t=c> (9/16, Gulley) reported Erie County Executive Chris Collins "addressed a flagging state pension system now requiring the county to contribute an additional $12 million in 2011. With Collins' budget some two weeks from completion, he said news came from Albany last week that the county's constitutionally mandated portion of the state bill is expected to increase by 40 percent over the $28 million taxpayers already shelled out this year, bringing the total for a county with some 4,300 active employees to $40 million." The article notes the County "estimates it's about $30 million in the hole heading into next year." Collins also "vowed not to increase county taxes as a solution, but has asked all county departments to slash discretionary spending by 20 percent - but that was before the latest news out of Albany asking counties and municipalities to chip in higher portions of retirement costs." Philadelphia To Examine Retirement Program. The AP <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=004-075&t=c> (9/16) reported, "Philadelphia's City Council is back for the fall session, and one of the first topics of discussion is whether to end a controversial retirement program." The Deferred Retirement Option Program will allow "employees eligible to retire to pick a retirement date four years down the road, then amass pension payments while working and collecting their salaries." Furthermore, Council president Anna Verna stated "no hearings will come until the city solicitor tells them whether City Council can simply eliminate the program, or if it must be negotiated with labor unions. Mayor Michael Nutter says he has no doubt that Council can kill the DROP program. He says it has cost the city pension fund $258 million since 1999, and Philadelphia can't afford it." San Mateo County, California, Debt Continues To Rise Despite General Fund Increase. The Daily Journal (San Mateo, CA) <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=005-84f&t=c> (9/16, Durand) reported, "San Mateo County's structural deficit grew to $70 million in the last fiscal year despite a general fund increase of $18 million over last year, according to county finance officials." The County's general fund was up $24.8 million "where it was projected to be which added $16 million to non-departmental services and $8.8 million for general fund operating departments. Primary reasons for the increase are $6.5 million in backfilled public safety funds, repayment of a $2.2 million loan for the court computer system, $2.6 million in unspent appropriations for capital and IT needs and stabilized rent for county-owned facilities." Despite the "pleasant excess," the County still has an "ongoing structural deficit stands at $70 million for fiscal year 2009-10 and is now projected to hit $124 million by 2014-15 without action." Jacksonville, Florida, School Board Votes For 3.5% Tax Increase. WJXT-TV <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=006-6d2&t=c> Jacksonville, FL (9/16) reported on its website, "Just two days after the Jacksonville City Council approved a 9 percent property tax hike, the Duval County School Board approved a 3.5 percent tax hike. Duval public schools Chief Financial Officer Mike Perrone said taxes needed to go up because of reduced state funding and a smaller tax base from homeowners." He stated, "We've lost a great deal of revenue due to the property tax value going down." Resident Stephanie Kennedy is "frustrated because she has seen the value of her home go down by nearly $15,000 in a down economy." She adds, "I just try to pay my bills. If we're going down, and they're going down, and they're putting it heavier on us, then it's just a big mess." The station notes, "Kennedy stands to pay about $100 more in taxes this year over last year." Emergency Management and Public Safety Walla Walla, Washington, Conducts Earthquake Response Simulation. The Whitman (WA) Pioneer <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=007-bb7&t=c> (9/16, Lessler) reported, "Fake debris, simulated fire, smoke and actors occupied an empty tarmac at Walla Walla Regional Airport on the morning of Monday, Sept. 13. These elements were all part of an emergency simulation being conducted by the Walla Walla County Emergency Management Department. The simulation involved an airplane which had to land on the airport runway immediately after a 6.2 magnitude earthquake created a chasm in the runway." This test was the second in a series of simulations for the County by the Emergency Management Department. The goal behind this simulation was to "test the emergency response plan of multiple agencies throughout the county, including the City of Walla Walla Fire Department, 911 Dispatch, Horizon Airlines, the Port of Walla Walla, Transportation Security Administration, the Walla Walla County Sheriff, Providence St. Marys Hospital and Walla Walla General Hospital." Many felt the exercise went well in preparing for "the lack of predictability of earthquakes." Economic Development, Restoration and Sustainability Athens, Michigan, Applying For Grant To Develop Downtown Building. The Battle Creek (MI) Enquirer <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=008-9f7&t=c> (9/16) reported, "The village of Athens is moving forward on some of its economic development plans. Village Council President Mike Alverson said Wednesday the village will apply for a grant of up to $200,000 from the Michigan Economic Development Corp. to help improve the facade of a long-vacant downtown building that might soon be a new business. Eau Claire resident Dave Enders hopes to open a collectible coin shop in the former hardware building on Capital Avenue." Additionally, Alverson added Athens intends to examine "whether Brownfield Development grants could be used to help restore another building Enders recently bought that was destroyed in an Aug. 25 fire." Westchester County, New York, Facing Pressure Over Lack of Affordable Housing. Yorktown Patch <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=009-dd6&t=c> (9/16, Bonopartis et al.) reported, "Westchester County is geographically segregated, a federal court says, and the court may decide the county has run out of chances to rectify the situation." The County "has been on the hook to build 750 affordable housing units since 2009, when the county settled a federal lawsuit with the Anti-Discrimination Center. At issue: demographics show minorities are confined to a small list of urban towns and cities in Westchester – places like Mount Vernon, New Rochelle, Port Chester and Peekskill – and the Anti-Discrimination Center argued that Westchester didn't do anything to alleviate the problem." The lawsuit argues "that affordable – or fair – housing is either segregation-dissolving, or segregation-perpetuating. If a developer builds 200 units in a Mount Vernon high-rise or in downtown Port Chester, that's segregation-perpetuating, according to the federal government." Legislation, Policy and Grants Adams County, Colorado, School District Prepares For Eminent Domain Case. The Broomfield (CO) Enterprise <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00a-1fc&t=c> (9/16, Krider) reported, "Adams 12 school district is at the heart of a legal battle that could set a new precedent for eminent domain cases in Colorado.." The case revolves around "Auto-trol Technology Corp., a software company, wants to be compensated for $3 million in damages it said it incurred after Adams 12 took land at 12500 Washington St. in Thornton for a new transportation center, then returned it. Auto-trol claims the district`s seizing control of the land impacted the company`s ability to sell it for a higher price and it wants compensation for the loss in value suffered when the real estate market slumped." However, "The district said it spent 13 months trying to come to an agreement with Auto-trol, and it submitted an offer of $6.9 million for the land in August 2007, which also was rejected. [Auto-trol managing director Danny ] Stroud said he saw no evidence of that offer." Bloomfield Township, New Jersey, Circumvents Eminent Domain, Purchases "Troubled" Land. The Record and Herald News (NJ) <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00b-2b0&t=c> (9/16, Frankel) reported, "The gaping holes occupying Bloomfield's downtown may soon be teaming with signs of construction, with the township finally purchasing a parcel it has sought to obtain for years through eminent domain. Following a bitter fight that spanned 10 years and several lawsuits, the Bloomfield Parking Authority (BPA) has bought land owned by merchant Anthony Ellenbogen for $2.7 million." The township and BPA "had attempted to secure the Ellenbogen property, located on Lackawanna Place, via eminent domain. It has envisioned a transit-oriented hub with residential, retail and commercial properties, along with a multi-story parking garage." Ellenbogen stated he is satisfied, and that he "received fair market value for his properties." He said, "I think they gave me a fair amount of money for what my property is worth. It's unfortunate that it took almost 10 years for that to happen." Public Works and Infrastructure York, Pennsylvania, Sewage Treatment Plan Utilizes White Pellets To Meet Environmental Limits. The Philadelphia Inquirer <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00c-084&t=c> (9/16) reported, "The latest substance from the York sewage treatment plant isn't stinky sludge or bubbly wastewater. It's little white pellets, about the size of small seeds. And they promise not only environmental benefit but real money. The pellets are fertilizer, and a formulation that incorporates them, produced by an Allentown company, is being tested at Longwood Gardens in Kennett Square." These pellets are believed to be a "way for the plant to meet stricter environmental limits for discharge into nearby Codorus Creek - and ultimately, the Chesapeake Bay, which suffers from an excess of nutrients." The article notes that for York "and other sewage plants nationwide, environmental rules are becoming ever stricter and more costly. This is especially true in Southeastern Pennsylvania, where most streams are considered 'impaired' for nutrients," says Jennifer Fields, water-program manager for the area's Department of Environmental Protection office. Orléans, Ontario, Approves Investigating Light Rail Possibilities. EMC Orleans <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00d-39f&t=c> (9/16, Evelyn) reported, "Although there are no set plans to even lay down tracks, the possibility of the city's proposed light rail transit (LRT) line making it to Orléans became a little more tangible following last week's city council meeting. Cumberland Coun. Rob Jellett successfully introduced a motion at the Sept. 8 meeting that directs staff to investigate the financial feasibility of putting light rail on the new Cumberland Transitway instead of busses." Coun. Jellett said, "If the business case is there, let's move forward." Additionally, Coun. Bloess explained that "the design of the Cumberland transitway, which was also approved at the meeting, is for rapid bus transit but is designed to be converted to light rail." Coun. Monette also added that "he would like to see the LRT run along the current transitway along Hwy. 174 into Orléans, but added this option also provides transit users with the choice of taking the bus or the train." Frostburg, Maryland, Considering Series Of Trash Collection Changes. The Cumberland (MD) Times-News <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00e-ddf&t=c> (9/16) reported that the residents of Frostburg will get their opportunity to comment on the changes to the city's trash collection. The city plans to "recommend once-a-week collections of trash contained in bags with a limit of eight bags per household not to exceed 50 pounds each. The city would continue its annual bulk pickup during the first week of June." Additionally, "Established apartment buildings with four or more units at the same address would be required to use a Dumpster with a private hauler. These property owners would have 30 days to arrange the service." Frostburg also plans to build a "full-service recycling location but will end its newspaper pickup program due to the lack of participation and the costs of collection. A dedicated compost site at the Mountain View Landfill for yard waste will be studied as well." Baltimore's MTA Defends Light Rail Service Following NFL Game. The Baltimore Sun <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=00f-174&t=c> 's "Getting There" blog (9/16, Dresser) reported "readers questioned why the MTA's light rail system takes so long to move crowds out of Camden Yards after Ravens games." MTA spokesman Terry Owens responded that the MTA had "no problems with service August 28th. Our passengers should know that extra measures are taken to handle the 8-10,000 customers who use light rail for Ravens games. Depending on the availability of cars we try to make every train a three car train, and add fill in trains when possible." Dresser concludes that "there are inherent capacity limits to the light rail system" and fans who use light rail must "reflect on the plight of the folks trying to get out of the parking lots." But at the same time, the MTA "needs to do more to explain how the light rail system works so that riders can form a reasonable set of expectations." Georgia To Use Tolls To Finish Interchange. The Atlanta Business Chronicle <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=010-031&t=c> (9/16, Williams) reported, "The State Road and Tollway Authority will meet next week to consider extending the tolls on Ga. 400 to finance completion of the highway's interchange with Interstate 85 in Buckhead, sources told Atlanta Business Chronicle." The interchange, which opened in the early '90s, "doesn't give southbound motorists heading into Atlanta on either highway a direct connection to the northbound lanes of the other road. The project to connect the two has been talked about for years." Now, "under the proposal to be taken up by the SRTA board on Sept. 24, the tolls would be continued in order to pay for a flyover ramp and other improvements at the 400/85 interchange, and a series of other transportation projects," said GDoT sources. Also, "The state has owned the land needed for the project for years, and the necessary engineering studies have been completed." Telecommunications and Technology Leavenworth County, Kansas, Working To Finalize Digital Radio Deal. The Basehor (KS) Sentinel <http://mailview.custombriefings.com/mailview.aspx?m=2010091701icma&r=46 22237-239a&l=011-d64&t=c> (9/16) reported, "To the disappointment of Leavenworth County commissioners, the county has not quite wrapped up details an agreement to secure digital radios for local fire departments." County commissioners agreed in July "to have the county act as the signatory for a deal with Motorola that would allow the purchase of the radios needed to communicate with the county's new digital emergency communication system." However, this arrangement "was threatened last month when two departments, Leavenworth County Fire District No. 1 and Kickapoo Township walked away from the Motorola deal because of required packaged insurance. However, Motorola agreed to offer the remaining nine departments $643,000 worth of radios at the same price per radio and with the same zero-percent, seven-year financing."
