Resolution 5433 - TABLED INDEFINITELY - Adjusting Police Impact Fees06/07/2010 TABLED INDEFINITELY I i *19) IIIJI V CIMB01-I&Y1It] A RESOLUTION AMENDING RESOLUTION NO.5273 TO ADJUST THE POLICE IMPACT FEE SCHEDULE TO REFLECT AN ADJUSTMENT TO THE POLICE CAPITAL IMPROVEMENT PLAN AND THE COSTS OF CONSTRUCTION AND PURSUANT TO THE RECOMMENDATIONS OF THE IMPACT FEE COMMITTEE. WHEREAS, the City Council passed Ordinance 1587 on October 16, 2006, which authorized the imposition of impact fees for police services; and WHEREAS, subsequent to the passage of Ordinance 1587 the city established impact fees for police services; and WHEREAS, the City Council passed Resolution 5273 on April 7, 2008, adjusting the police services impact fees; and WHEREAS, pursuant to MCA 7-6-1602 the Impact Fee Advisory Committee analyzed the police services impact fee and is now recommending that the currently established impact fees be adjusted to more accurately reflect the capital needs of police services and the current costs of local construction; and WHEREAS, Exhibits A, B 1, B2, B3, B4 and B5 attached hereto sets forth the capital improvement plan and fee schedule that has been recommended by the Kalispell Impact Fee Committee. The City Council finds that the report approved and submitted by the Kalispell Impact Fee Committee, along with the plan and schedule reasonably reflects the capital needs for police services in the City that may be reasonably charged through a police services impact fee. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I. That the Police Impact Fees be adjusted pursuant to the Schedule attached hereto as Exhibit "A" and incorporated fully herein by this reference. SECTION II. That this resolution adjusting the impact fee schedule shall become effective immediately. PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE CITY OF KALISPELL THIS DAY OF , 2010.
