located within jurisdictional areas that have adopted growth policies pursuant to Title 76, Chapter I,
M.C.A., or is within a first class or second class municipality for which the governing body certifies,
pursuant to 76-1-127 M.C.A., that adequate storm water drainage and adequate municipal facilities
will be provided.
Waiver of Protest
1, Mary Sexton, the undersigned, acting as Director for the State of Montana, Department of Natural
Resources and Conservation (The Department), do hereby waive any and all right to protest which
The Department may have in regards to any attempt by the City of Kalispell to initiate a Special

retains the ability to object to the amount of assessment imposed as a result of the formation of a
