LONE PINE DEVELOPMENT, LLC, hereby waives any and all right to protest which it may
have in regards to any attempt to be made by the City of Kalispell, to initiate a special
improvement district upgrading roads in the area to City standards that may be impacted by
this development. Provided however, that LONE PINE DEVELOPMENT. LLC understands
that it retains the ability to object to the amount of assessment imposed as a result of the
formation of a Special Improvement District. LONE PINE DEVELOPMENT, LLC agrees that
this covenant shall run to, with and be binding on the title of the real property described
above and shall be binding on the heirs, assigns. successors in interest, purchasers, and any and
all subsequent holders or owners of the real property shown on the subdivision plat for LONE
PINE TRAILS.
All utilities shall be installed underground.
All areas disturbed during development of the subdivision shall be re -vegetated with a
weed -free mix immediately after development.
CERTIF [CATE OF DEDICATION
LONE PINE DEVELOPMENT. LLC, the undersigned property owner does hereby certify that it has caused to be surveyed, subdivided
and platted into lots, streets and parks as shown by the plat hereto annexed, the following described land situated in the City of
Kalispell, Montana, to -wit:
That portion of the Southwest 1/4 of the Southeast 1/4, Section 13, Township 28 North, Range 22 West, P.M., M., Flathead County,
Montana, described as follows:
Commencing at the Southeast corner of Section 13;
Thence along the South line of the Southeast 1/4, South 89*57'48" West 1321.14 feet to the Point of Beginning;
Thence continuing alongthe South line of the Southeast 1/4, South 89'57'48" West 1022.54 feet;

shown on said plat are hereby granted and donated to the use of the public forever.
I hereby certify that the tracts are within a master planned area and that municipal services for water supply, sewage disposal and
solid waste disposal are available to said tracts of land; therefore, these tracts of land are exempt from review by the Department of
Environmental Quality pursuant to ARM 17.36.602. The water and sewage easements as shown hereon are hereby dedicated to the
city of Kalispell. All new 6tilities shall be installed underground.
The undersigned hereby grants to each and every person, firm, or corporation, whether public or private, providing or offering to
provide telephone, telegraph, electric power. gas, cable television, water or sewer service to the public, the right to the joint use of
an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each
area designated on this plat as "UTILITY EASEMENT" to have and to hold forever.
