Juniper Bend - Phase II, townLhouse subdivision plat located in
Government Lots 12 and 13 of Section 6, Township 28 North, Range 21
West, Principal Meridian Montana, Flathead County, Montana.
CERTIFICATE OF WAIVE:R OF PARKLAND DEDICATION
The undersigned do hex�eby certify that a homeowner's
association for Juniper Bend ishall be formed and that the area
labelled "Homeowner's Recreational Area" on this plat shall be held
in perpetuity for use as parks or playgrounds, therefore, the
undersigned do hereby authorize the governing hody of the City of
Kalispell to waive park dediciation pursuant to Section 76-3-607
(3)(b) M.C.A.
CERTIFICA'TE OF UTILITIES
"The undersigned hereby grarts unto each and every person,
firm or corporation, whether public or private, providing or
offering to provide telephone, telegraph, electric power, gas,
cable television, water or sewter service to the public, the right
to the joint use of an oasemenit for the construction, maintenazice,
repair and removal of their 11nea and other facilities, in, over,
under, and across each area designated on this plat as "Utility
Easement" to have and to hold forever."
CERTIFICATE OIF PRIVATE ROADWAYS
The roadways shown on this plat are intended to be private in
all respects. They are hereby dedicated forever to be for the sole
use of the owners (and their successors in interest) of the lots
described on this plat, and of' future phases of this subdivision.
The owners (and their successors in interest) of the lots described
on this plat will provide the all -season maintenance of the private
roadway by the creation of a corporation or homeowners association
to administer and fund the maintenance. It is understood and
agreed that the value of e&ch lot described on this plat is
enhanced by the private, exclinsive nature of said roadway.
This division of land is exempt from the Sanitation Act per
Master Plan exemption per 76-4-124 and A.R.M. 16.16.603.
