11/18/96 City Council Minutes951 951 A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M. MONDAY, NOVEMBER 18, 1996, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL, MONTANA. MAYOR DOUG RAUTHE PRESIDED. COUNCIL MEMBERS JIM ATKINSON, CLIFF COLLINS, NORBERT DONAHUE, LAUREN GRANMO, DALE HAARR, PAM KENNEDY, DUANE LARSON, GARY NYSTUL, CITY ATTORNEY GLEN NEIER AND CITY MANAGER CLARENCE KREPPS WERE PRESENT. Mayor Rauthe called the meeting to order and led the Pledge of Allegiance. AGENDA APPROVAL Haarr moved to approve the agenda. The motion was seconded. Rauthe noted he asked Krepps to serve as the City representative on the Countywide Administrative Board. The motion carried upon vote. CONSENT AGENDA APPROVAL A. Council Minutes -Regular Meeting -November 4, 1996 B. Approval of Claims per Payables Register-$$249,886.48 C. Authority to Bid -Lawrence Park Mitigation Project Haarr moved to approve the consent agenda. The motion was seconded. Upon vote the motion carried. HEARING THE PUBLIC City Study Commission Clare Hafferman, 1337 3rd Street West, read claims from the time she was on the city study commission and made suggestions. Greenacres Dennis Dortch, 1696 Stag Lane, thanked the staff and FRDO for the work put into the extension of services plan. Sally Delby, 1740 Woodland Avenue, requested Council leave out the residents from about South Woodland, down Woodland Avenue and then down Willow Glen to about Haven or where ever the trailer court is. The area contains larger lots. Steve Blair, 420 Peaceful Drive, Bigfork, owner of the former Flathead Sports, requested the businesses and property be excluded from the annexation from Kelly Road, south. Bob Meerkatz, 1604 South Woodland Drive, spoke against the proposed annexation. MDOT Letter David Beyer, 427 Chestnut, FVCC President, expressed support to send the letter to the MDOT about the speed on Hwy 93 north. Ordinance 1251-Lantis Zone Change-2nd Reading Collins moved Ordinance 1251, an ordinance to amend Section 27.02.010, official zoning map, City of Kalispell zoning ordinance (Ordinance No. 1175), by zoning property- known as a portion of tract 5AM in the northwest quarter of the northeast quarter of Section 12, township 28 north Range 21 west, P.M.M. Flathead County, Montana (previously zoned R-4, Two -Family, residential), RA-1, Residential Apartment District, in accordance with the City - County Master Plan, and to provide an effective date. The motion was seconded. With a roll call vote the motion carried with Atkinson, Collins, Donahue, Granmo, Haarr, Kennedy, Larson, Nystul and Rauthe voting in favor. 952 952 Ordinance 1252-Zone Change-lst Reading Larson moved Ordinance 1252, an ordinance to amend Section 27.02.010, Official Zoning Map, City of Kalispell Zoning Ordinance, (Ordinance No. 1175), by zoning property known as Ashley Park Phase II, Flathead County, Montana (previously zoned County R-4, Two - Family Residential), to City R-4, Residential, in accordance with the City -County Master Plan, and to provide an effective date. The motion was seconded. With a roll call vote the motion carried with Atkinson, Collins, Donahue, Granmo, Haarr, Kennedy, Larson, Nystul and Rauthe voting in favor. Resolution 4304-Annexation Nystul moved Resolution 4304, a resolution to provide for the alteration of the boundaries of the City of Kalispell by including therein, as an annexation, Ashley Park, Phase II, No. 278, a subdivision in the north 1, southeast 1/4, Section 19, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana, to be known as Ashley Park Phase II; and to declare an effective date. The motion was seconded. The motion carried upon roll call vote with Atkinson, Collins, Donahue, Granmo, Haarr, Kennedy, Larson, Nystul and Rauthe voting in favor. Final Plat Granmo moved to approve final plat for Ashley Park Phase II. The motion was seconded. The motion carried with a vote. Hwy 93 and Grandview/MDOT Correspondence At the last work session it was agreed to have Krepps write a letter to MDOT suggesting they initiate a new traffic safety study for Hwy 93 starting with the intersection of Meridian Road to the north exit of FVCC north of Grandview/4 Mile Drive. Rauthe suggested the letter from FVCC be attached to the Council letter and all agreed. Donahue moved to send the letters to Jim Weaver at MDOT. The motion was seconded. With a vote the motion carried. FOR YOUR INFORMATION Joint TAC/MDOT meeting November 21, 1996 11:00 a.m. City Hall Next Work Session November 25, 1996 7:00 P.M. Next Regular Meeting December 2, 1996 7:00 p.m. Atkinson made reference to some items referred to by Hafferman about claims. He noted many of the items were Parks Department fees and pay for themselves. Rauthe encouraged citizens to send letters of interest for the upcoming board appointments.
