AN EXECUTIVE SESSION OF THE KALISPELL CITY COUNCIL WAS HELD AT
9:10 P.M. MONDAY, FEBRUARY 3, 1992, AFTER THE REGULAR COUNCIL
MEETING IN THE CONFERENCE ROOM AT CITY HALL. MAYOR RAUTHE
PRESIDED. ALL COUNCILMEMBERS WERE PRESENT.
City Attorney Neier explained progress in lawsuits filed by the
Estates of George Mumalo, Paul VanDevort, Scott Young and Evelyn
Young -vs -the City of Kalispell. He explained that it may become
necessary during the course of the litigation to file claims on
behalf of the City against the Estate of the respective deceased
victims in order to seek contribution or defend the suit. He
requested that the council authorize the city manager and/or city
attorney to execute claims deemed necessary by the attorneys
representing the City.
Larson moved that the city manager and/or city attorney be
authorized to execute, on behalf of the City, any claims deemed
necessary by the attorneys representing the City that may be
necessary to prosecute the lawsuit arising out of an airplane
crash at the Kalispell City Airport, August 19, 1990. Granmo
seconded the motion.
The motion carried with a vote.
The meeting was adjourned at 9:17 p.m.
