THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M. MONDAY,
DECEMBER 17, 1979 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED. ALL
COUNCILMEN WERE PRESENT.
APPROVE MINUTES
Councilman Daley moved that the minutes of the special meeting of November 29, 1979 be
approved as presented. Seconded by Councilman O'Boyle. Motion carried.
Councilman Zauner moved that the minutes of the regular meeting of December 3, 1979 be
approved as presented. Seconded by Councilman Smith. Motion carried.
CITY OFFICIAL REPORTS
City Clerk for July and August
City Treasurer for October
City Judge, Police Chief, Director of Public Works for November
Councilman Saverud moved that city officials reports be accepted. Seconded by Council-
man O'Boyle. Motion carried.
ADDRESSING THE COUNCIL
Garmen Meadows, owner of a real estate office on 8th & Main Street East, addressed the
council concedning a previous variance granted to him as to the number of people using
the office. He stated that if there are nine employees and a salesman from another
branch office stops in, this totals ten and violates the agreement.
Councilman Zauner moved to refer the problem to Mr. Meadows' attorney and City Attorney
Donahue. Seconded by Councilman Daley. 'G3ty Attorney Donahue stated that when the
agreement was drafted, Mr. Meadows' attorney was in agreement, but the wording was later
changed by Mr. Meadows. Mr. Donahue cannot agree with Mr. Meadows' changes. He will try
to work it out with Mr. Meadows' attorney.
Question called. Motion carried.
COMMITTEE REPORTS
FINANCE
Councilman Ruiz reported that his committee was to have named a financial adviser for
the Parking Commission but was unable to interview a representative of the D. A.
Davidson Company until tomorrow. Councilman Ruiz moved that the finance committee
be given power to act on the selection of a financial adviser for the Parking Commission.
Seconded by Councilman Saverud. Motion carried.

RESOLUTION #3270
Councilman Smith moved adoption of Resolution #3270 a resolution to approve The Pines;
Addition #113 Resubdivision. There is a change from condominiums to townhouses and
no city maintenance on streets, garbage collection or police protection. Seconded by
Councilman O'Boyle. Roll call vote. All voted aye.
ORDINANCE #941
Councilman Smith moved to enact, Ordinance #941 an ordinance to amend Ordinance #930 to
extend to March 15, 1980, when all property within the City shall be zoned in accord
with the City of Kalispell Zoning Ordinance. Seconded by Councilman Zauner. Roll
call vote. All voted aye.

Councilman Smith reported a letter from Attorney
William Astle
regarding Storms
Addition, adjacent to Meridian Addition, stating
that the vote
on zoning for Meridian
Addition was illegal because a protest had been filed previous
to the vote, thus
requiring a three -fourths majority vote to pass.
(Vote was 3
ayes, 3 nays, 1 abstention
and an aye vote by Acting Mayor Daley to break the tie)
Mayor Happ declared the vote on Ordinance #938 null and void.
ORDINANCE #938
Councilman Smith moved the first reading of Ordinance #938 an ordinance to zone
Meridian Addition I-1. Seconded by Councilman Daley. Roll call vote. Councilmen
Ruiz, Smith, Zauner, Daley, O'Boyle and Grainger voted aye. Councilmen Saverud and
Granmo voted nay. First reading passed a three -fourths majority vote.
EMPLOYMENT
Councilman Zauner had no report.
PARKS
Councilman Daley moved that Park Supt. Drent be authorized to call for bids for materials
for an irrigation system for Northridge Park. Seconded by Councilman O'Boyle. Motion
carried.
Councilman Daley reported that the committee recommends that a request from Hedges
'School to close the alley between 8th and 9th Streets East for a playground program be
rejected.
STREET & ALLEY
ORDINANCE #942
Councilman O'Boyle moved the first reading of Ordinance #942 an ordinance to amend Section
17-96, Ordinance #739, to provide for one-way travel southerly to northerly on Mission
Street from U. S. Highway #93 to Charlotte Avenue; to declare an emergency and to provide
for immediate effect. Seconded by Councilman Smith. Roll call vote. All voted aye.
Councilman O'Boyle moved that a curb cut in the 400 Block on Main Street with entrance
only from Main Street and exit to alley be approved for Edgar Trippett. Seconded by
Councilman Zauner. Motion carried.
CITY DEVELOPMENT
Councilman Saverud had no report.
SEWER & WATER
RESOLUTION #3271
Councilman Granmo moved to adopt Resolution #3211 a resolution authorizing Mayor Happ
to sign Change Order #2 for Water Well Improvements - Sche4ule II. Seconded by
Councilman Saverud. Roll call vote. All voted aye.
Councilman Granmo moved that because the contract is essentially complete, the $3,000
retainage be paid to the contractor, Robert W. Ross. Seconded by Councilman Daley.
Motion carried.
RESOLUTION #3272
Councilman Granmo moved to adopt Resolution #3272 a resolution authorizing Mayor Happ
to sign an agreement with the Montana Department of Highways for utility construction
for Federal Aid Project # M F 6799 (5) (E. N. Storm Drain Project). Seconded by
Councilman O'Boyle. Roll call vote. All voted aye.
Councilman Granmo reported that the City has not as yet received the permit for soil
injection sludge disposal from the State Department of Health.
SAFETY
Fire Chief Doty explained the request for residency for fire department employees. He
has drawn a map with a 2�- mile radius limit outside the city limits. This would allow
a maximum of 4 miles from the fire station. As the city limits extend, so would the 2-J
mile limit. Councilman Grainger stated that he would like a recommendation from the
council on this request.
Fire Chief Doty asked for council approval for the following additions to the Fire Manual:
SECTION 1. Every Officer and Member Shall:
(19) Obtain and maintain a current American Red Cross Advanced First Aid card or its
equivalent.
(2()) Obtain and maintain a current American Red Cross C.P.R. card or its equivalent.
(21 Obtain and maintain a current State of Montana Chauffeurs License.
Councilman Grainger moved approval of the above named additions to the Fire Manual.
Seconded by Councilman Granmo. Motion carried.
Police Chief Stefanie reported that the City Police Department will be receiving the
following grants: 1): 2 radios for new police cars — $251.12 — 50/50 city match; 2)._ !+
week crime prevention school for Detective Hossack — $2,595 - 5 city share — 3) equip—
ment for shooting range — $13,950 — city.share $6,979•
