Resolution 4303 - Woodland Court Change Order1503 RESOLUTION NO. 4303 A RESOLUTION TO ALTER AND AMEND THE CONTRACT WITH A-1 PAVING ON THE WOODLAND COURT PROJECT, MT HOME M94-SG300117/MT--CDBG-94HR-06. WHEREAS, the City on November 15, 1995 did enter into a contract with A-1 Paving, Kalispell, MT fbr the construction of certain improvements connected with the Woodland Court Project, and WHEREAS, certain elements in the project required additional work, as well as time to complete; and said additional work and time requirements could not have been necessarily foreseeable when the original construction contract was entered into, and said changes are contained in Exhibit "A", attached hereto and are by this reference made a part hereof; and WHEREAS, upon the advise and recommendation of Roger Sommerville, of Thomas, Dean and Hoskins, Inc, (the City's Consulting Engineers) it appears in the best interests of the City to approve said changes and alterations. NOW THEREFORE, pursuant to the provisions of Section 7-5- 4308(1) MCA be it hereby resolved: 1. The alterations and modifications of the contract between the City of Kalispell and A-1 Paving, dated November 13, 1996, as set out in Exhibit "A" attached hereto are hereby approved, and 2. As soon as the alterations and modifications are agreed to in -writing, signed by the City Manager, as hereby approved by the Council, this approval thereof shall be in effect. NAME OF PROTECT CITY OF KALISPELL MT "WOODLAND COURT PROTECT" MT HOME M94-SG300117/MT-CDBG-94HR-06 OWNER CITY OF KALISPELL CONTRACTOR A-1 PAVING The following changes are hereby made to the CONTRACT DOCUMENTS: Add four (4) street light pole concrete bases along the access road for Woodland Court, see enclosed sketch. Add clearing and excavation, Type I with Type A backfill for sidewalk parallelling South Woodland Court. This includes removing the vegetation and topsoil and filling with an imported borrow of subbase course and crushed gravel material for 415 lineal feet. Moving sidewalk from center of the right of way drainage ditch on South Woodland Drive to the edge of the road. Add extend the north and south access road drainage culverts to match the existing ditch and fill slope. This includes removing existing vegetation and soils to match ditch grade and backfilling with materials to match existing culvert fill. Add construct storm drainage swale along north and east sides of subdivision to drain storm waters to south east corner. Add place top soil on boulevard right-of-way and outside edge of the subdivision sidewalks. Add above to Schedule III contract, based on unit prices from the original contract and as shown on Exhibit A. Justification: The concrete bases for the subdivision light poles were not included in Change Order No. 1 documents and must be added to the contract. The City of Kalispell directed the sidewalk re -located from the center of the street right-of-way to the east edge of the right-of-way then the west edge. This requires the contractor to clear, grub, remove the topsoil and import fill to re-establish natural compacted grade. The contractor will place the crushed gravel base course and concrete sidewalk per contract prices. 11505 F ID The access road culverts were found to be too short with the designed 4:1 fell slope and were at a_1:1 slope. For safety reasons and standard design the culvert must be extended to give adequate ground slopes at the culverts ends. . The City Engineer requested the drainage swaie construction to move spring and summer storm ran -off away from the north edge of the project. Schedule I covered placing top soil back over the disturbed construction areas in the street right-of-way. Contractor must place top soil between road curb and sidewalk and along the outside edge of the sidewalks, throughout the right-of-way. Change to CONTRACT PRICE: Original CONTRACT PRICE: $ 80,056.00 Current CONTRACT PRICE adjusted by previous CHANGE ORDER:$102,865.50 The CONTRACT PRICE due to this CHANGE ORDER will increase: $10,960.00 The new CONTRACT PRICE including this CHANGE ORDER will be $113,825.50 CHANGE of CONTRACT TIME: The CONTRACT TIME will increase by 16 days. This includes removing the vegetation and topsoil and filling with subbase course and crushed gravel material for 415 lineal feet. Moving sidewalk from center of drainage ditch to the east edge of South Woodland Drive. Add extension of access road drainage culverts. Includes setting culvert section to grade, attaching to existing culverts and backfilling with 3/4 inch crush gravel base course subgrade and top soil materials. Add construction storm drainage swale per direction of City of Kalispell Engineer to the north and east side of the subdevelopment area.
