RESOLUTION NO. 4190
A RESOLUTION RELATING TO THE ACQUISITION OF LOTS 7, 8, 9, AND 12,
BLOCK 186, KALISPELL ORIGINAL FROM RONALD & ARDIENNE HATTEL, FRANZ
BARTHEL, AND CHERYL L. MCLEAN, RESPECTIVELY, ESTABLISHING A FAIR
MARKET VALUE, IDENTIFYING THE INTEREST TO BE ACQUIRED, AND
CERTIFYING THAT THE WORK OF THE APPRAISER HAS BEEN PERFORMED IN A
COMPETENT MANNER.
WHEREAS, the City of Kalispell by Ordinance No. 1065 passed on
the 14th day of November, 1985, did designate certain projects
within the Downtown Redevelopment Area as Urban Renewal Projects,
and
WHEREAS, one of the projects designated by Ordinance No. 1065
consisted of acquiring land and constructing parking lots for off-
street parking facilities, and
WHEREAS, the City of Kalispell by Ordinance No. 1140 passed on
the 20th day of November, 1989 expanded the Downtown Redevelopment
Area to include 10 blocks in the area of Flathead High School to
provide for the creation of a parking lot in the area, and
WHEREAS, the Department of Planning, Economic and Community
Development has caused an appraisal to be made of Lots 7, 8, 9, and
12, Block 186, Kalispell Original by Ryan Appraisal Service, and
WHEREAS, Ryan Appraisal Service has prepared a report on said
parcels, and
WHEREAS, the Department of Planning, Economic and Community
Development has received said appraisals and has made
recommendations concerning the fair market value of said property.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That the fair market value of Lot 7, Block 186,
Kalispell Original, owned in Fee Simple by Ronald & Ardienne
Hattel is Eighty Thousand Dollars ($80,000).
SECTION II. That the fair market value of Lot 8, Block 186,
Kalispell Original, owned in Fee Simple by Ronald & Ardienne
Hattel is Fifty Thousand Dollars ($50,000).
SECTION III. That the fair market value of Lot 9, Block 186,
Kalispell Original, owned in Fee Simple by Franz Barthel is
Sixty Thousand Dollars ($60,000).
SECTION IV. That the fair market value of Lot 12, Block 186,
Kalispell Original, owned in Fee Simple by Cheryl L. McLean is
Ninety-two Thousand Dollars ($92,000).

SECTION V. That the creation of additional parking near
Flathead High School will require the acquisition of fee
simple estates in the name of the City of Kalispell from the
respective owners.
SECTION VI. That the work of the Appraiser, with respect to
the property has been performed in a competent manner in
accordance with State law.
SECTION V . That the City Manager is authorized and directed
to purchase from Ronald & Ardienne Hattel Lot 7, Block 186,
Kalispell Original for the sum of Eighty Thousand Dollars
($80,000); from Ronald & Ardienne Hattel Lot 8, Block 186,
Kalispell Original for the sum of Fifty Thousand Dollars
($50,000); from Franz Barthel Lot 9, Block 186, Kalispell
Original for the sum of Sixty Thousand Dollars ($60,000); and
from Cheryl L. McLean Lot 12, Block 186, Kalispell Original
for the sum of Ninety-two Thousand Dollars ($92,000).
SECTION VIII. That the City Finance Officer is authorized and
directed to pay in accordance with the instructions from the
respective owners the following amounts:
Ronald & Adrienne Hattel--Lot 7, Block 186, Kalispell
Original, the sum of Eighty Thousand Dollars ($80,000).
Ronald & Adrienne Hattel--Lot 8, Block 186, Kalispell
Original, the sum of Fifty Thousand Dollars ($50,000).
Franz Barthel --Lot 9, Block 186, Kalispell Original, the sum
of Sixty Thousand Dollars ($60,000).
Cheryl L. McLean --Lot 12, Block 186, Kalispell Original, the
sum of Ninety-two Thousand Dollars ($92,000).
The above listed amounts are to be paid with funds properly
appropriated under the Tax Increment Budget and from the
proceeds of the funds made available from the Tax Increment
Cash Flow.
SECTION IX. That the City Attorney is authorized and directed
to prepare any documents necessary to effect this Resolution
and the City Manager is authorized and directed to accept and
properly record on behalf of the City of Kalispell the deeds
to said properties.
