RESOLUTION NO. 4144
A RESOLUTION TO ABANDON AND DISCONTINUE THE DEDICATED PUBLIC STREET
35 FEET ADJACENT TO AND GENERALLY SOUTH OF LOT 1, BLOCK 1, WILLIS
ADDITION, KALISPELL, MONTANA.
WHEREAS, on the 18th day of February, 1994, the City of
Kalispell received a petition from Roger L. Reimann and Marjorie
Reimann, the owners of more than 50% of Lot 1, Block 1, Willis
Addition, Kalispell, Flathead County, Montana, requesting that the
City of Kalispell abandon and discontinue the street located
adjacent to and generally south of Lot 1, Block 1, Willis Addition,
pursuant to Section 7-14-4114, MCA, and
WHEREAS, notice of said petition was published in the Daily
Inter Lake on the 13th day of March, 1994, and
WHEREAS, on the 21st day of March, 1994 the City Council of
the City of Kalispell held a public hearing to hear proponents and
opponents on the closure and to further determine any action, that
would serve the public interest, and
WHEREAS, it was determined that the petition hereinbefore
mentioned was properly presented to the Council, and
WHEREAS, it was determined at said public hearing that the
closure of the street adjacent to and generally south of Lot 1,
Block 1, Willis Addition, Kalispell, Montana, would be in the
public interest.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA, THAT:
SECTION I. All that part of the City street located 35
ft. adjacent to and generally south of Lot 1, Block 1,
Willis Addition, Kalispell, Montana, is hereby
discontinued as the same is no longer required for public
transportation and the public interest will be served by
its discontinuance.
SECTION II. The enactment of this Resolution shall not
affect nor impair the right of any public or municipal
utility to continue to maintain its plant or equipment in
said street.
SECTION III. This Resolution shall take effect
immediately upon passage by the City Council and approval
by the Mayor.
