RESOLUTION NO. 4140
A RESOLUTION AUTHORIZING THE ABANDONMENT OF AN EASEMENT.
WHEREAS, the City has a water and roadway easement traversing
certain real property lying between Sunnyview Drive and
Heritage Way and East of U.S. #93, and
WHEREAS, the owners of said property, to -wit: G.W. Ingham/John W.
Hilleboe, Special Senses, and Kalispell Orthopedic
Pension Fund have constructed alternative roadway and
water access to the property, and
WHEREAS, the City's easement across said property is no longer
needed.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That the Mayor and Finance Director are
authorized and directed to execute quitclaim
deeds transferring the City's easement
interest in the real property noted herein to
the owners of the property.
SECTION II. This Resolution shall take effect immediately
upon passage by the City Council.
PASSED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AND APPROVED BY
THE MAYOR THIS 7th DAY OF FEBRUARY, 1994.
