Resolution 4110 - Create Special Parking Maintenance District No. 2 - Parking CommissionRESOLUTION NO. 4110 A RESOLUTION CREATING SPECIAL PARKING MAINTENANCE DISTRICT NO. 2 FOR THE PURPOSE OF PROVIDING THE FUNDING OF THE COSTS OF MAINTAINING, OPERATING, REPAIRING AND IMPROVING ON ALL OFF-STREET PARKING LOTS, ON --STREET PARKING AND OTHER FACILITIES LOCATED WITHIN SPECIAL PARKING DISTRICT NO. 2. WHEREAS, on the 21st day of June, 1993, the City Council of the City of Kalispell did pass and adopt Resolution No. 4103, A RESOLUTION TO CREATE SPECIAL PARKING MAINTENANCE DISTRICT NO. 2; and WHEREAS, the City Clerk of Council of said City did give Notice of passage of said resolution by publishing the same five successive days in the Daily Inter Lake, a daily newspaper published in Kalispell, Montana, beginning on June 28th, 1993, and also on June 28th, 1993, true copies of said Notice were mailed to all persons having real property within said district, and WHEREAS, on the 19th day of July, at the next regular meeting of said Council the Council did conduct a hearing on said Resolution No. 4103, and insufficient protests, written or oral, were made or presented against creating said Special Parking Maintenance District No. 2 to prevent its creation. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. That Special Parking Maintenance District No. 2 is hereby created for the purpose of providing the funding of the costs of maintaining, operating, repairing and improving all off-street, on -street parking and other facilities located in Special Parking Maintenance District No. 2, described in Exhibit "A" attached hereto and by this reference made a part hereof. SECTION II. The net costs of said District to said District will vary from year to year, depending on the revenues received from rental of automobile parking spacF:s on off-street parking lots and facilities plus those revenues from on -street parking spaces and other facilities operated by the Kalispell Parking Commission, and all money appropriated or made available by the City and proceeds of all financial assistance or aid by City, State or Federal government. 1 RESOLUTION NO. 4110 Page 1 of 2 M SECTION III. The net costs of the said District after applying the revenues realized by the Commission pursuant to Section II, supra, shall be determined, levied and assessed, annually, on a pro-rata ad valorem basis on all property within said District pursuant to the procedures set forth in Section 7-14-4713, MCA.
