Resolution 4104 - Resolution of Intent - Providing Funding of Maintenance for Special Parking District No. 2• RESOLUTION NO. 4104 A RESOLUTION OF INTENTION TO PROVIDE FOR THE FUNDING OF THE COST OF MAINTAINING, OPERATING, REPAIRING, AND IMPROVING SPECIAL PARKING MAINTENANCE DISTRICT NO. 2; PROVIDING FOR A MAXIMUM ESTIMATE OF TOTAL EXPENSES CONNECTED THEREWITH WHICH MUST BE COLLECTED BY AD VALOREM TAXES; TO PROVIDE FOR A PROTEST PERIOD; AND TO SET A DATE FOR A PUBLIC HEARING FOR THE PASSING ON PROTESTS AND PROVIDE A DATE FOR THE FIXING, LEVYING AND ASSESSING OF THE AMOUNT TO BE RAISED BY AD VALOREM TAXES UPON ALL THE PROPERTY WITHIN SPECIAL PARKING DISTRICT NO. 2. WHEREAS, the City of Kalispell anticipates creating, on the 19th day of July, 1993, by Resolution, Special Maintenance District No. 2, for the purpose of providing the funding for the cost of maintaining, repairing, operating and improving all off-street parking lots and facilities located within said District; and WHEREAS, the annual cost of the District shall be determined each year depending upon the net cost of the maintenance, operation, repairs, and improvements of the off-street parking lots within the District after deducting the revenues received from the rental of automobile parking spaces thereon and the revenues received from the rental of on -street parking spaces within the District and all other revenues from all other Commission operated off-street and on -street parking facilities. Such annual net costs shall be determined, fixed, levied and assessed annually on an ad valorem basis on all property within said District pursuant to the authority and procedures as set forth in Section 7-14-4713, MCA, and WHEREAS, on the 21st day of June, 1993, the City Council made an Annual Statement and Estimate of Expenses of the proposed District for fiscal 1994 pursuant to Section 7-14-4713, MCA, and has caused notice to be published thereof, and WHEREAS, it is the duty of the City Council of the City of Kalispell to have a hearing on said Statement and Estimate of Expenses, and WHEREAS, said Statement indicates that the proposed District will have revenues totaling $142,500.00 and expenses totalling $195,950.00, leaving a total of $53,450.00 to be levied and assessed against property within the District based upon Section 7-14-4713, MCA. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: RESOLUTION NO. 4104 Page 1 of 3 E ••i SECTION I. That it is the intention of the City of Kalispell to provide for the fixing, levying, assessing, and collecting by ad valorem taxes the estimated expenses of maintaining, operating and improving for the area described in Exhibit "A" attached hereto and made a part hereof and Identified as Special Parking Maintenance District No. 2. SECTION II. The Annual Statement and Estimate of Expenses as determined by the City Council shows that proposed Special Parking Maintenance District No. 2, will require the additional sum of $53,450.00 after all revenues from various sources are allocated. SECTION III. The Cost shall be levied and assessed against each lot or parcel of land in said Special Parking Maintenance District No. 2, except public streets and rights -of -way on the basis of 4% of total taxable valuation of the various properties. SECTION IV. On the 19th day of July, 1993, at 7:00 o'clock P.M. , in the Council Chambers of City Hall, in the City of Kalispell, at the regular meeting of the City Council, the City Council will hear and pass on any protests that may be made against the Statement and Estimate of Expenses for the cost of maintaining, operating, repairing and improving Special Parking Maintenance District No. 2. SECTION V. The City Clerk of Council is hereby authorized and directed to give proper notice of the passage of this Resolution by publication to be made in a daily newspaper published in the City of Kalispell, Montana.
