RESOLUTION NO. 4103
A RESOLUTION OF INTENTION TO CREATE SPECIAL PARKING MAINTENANCE
DISTRICT NO. 2.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
SECTION I. It is the intention of the City Council of the
City of Kalispell to create Special Parking Maintenance
District No. 2 for the property described in Exhibit "A",
attached hereto and thereby made a part hereof. Such District
will be established pursuant to the authority granted to the
City of Kalispell under Section 7-14-4711, MCA.
SECTION II. The general character of said District is to
provide for the funding of the cost of maintenance, operation,
repairs and improvements on all off-street parking lots, on -
street parking and other facilities located within Special
Parking Maintenance District No. 2.
SECTION III. The estimated amount of such costs to the said
District on an annual basis will vary from year to year,
depending on the revenues received from rental of automobile
parking spaces on off-street parking lots and facilities plus
those revenues from on -street parking spaces and other
facilities operated by the Kalispell Parking Commission.
SECTION IV. The net cost of the said District after applying
the revenues realized by the Commission pursuant to Section
III, supra, shall be determined, levied and assessed,
annually, on a pro-rata ad valorem basis on all property
within said District pursuant to the procedures set forth in
Section 7-14-4713, MCA.
SECTION V. On the 19th day of July, 1993, at a City Council
Meeting commencing at 7:00 o'clock P.M. in the City Hall
Council Chambers, the City Council will hear and pass on any
protests that may be made against the creation of said
District and the method of determining, levying and assessing
the costs thereof.
SECTION VI. The City Clerk of Council is hereby authorized
and directed to prepare and give proper notice of the passage
of this Resolution by publication and mailing as required by
law.
