RESOLUTION NO. 4098
A RESOLUTION AUTHORIZING THE CITY MANAGER TO FILE AN IRREVOCABLE
ELECTION ON BEHALF OF THE CITY OF KALISPELL IMPLEMENTING THE
RETIREMENT INCENTIVE PROGRAM ESTABLISHED BY HB 517 (53rd
LEGISLATURE).
WHEREAS, HB 517, enacted by the 1993 Montana Legislature
established a retirement incentive program for certain
employees who were active PERS members on February 1,
1993 and who are eligible for early or regular service
retirement during a window period, and
WHEREAS, HB 517 authorizes the local governments to participate in
said retirement incentive program if an irrevocable
election to participate is made by the local governing
body and filed with the Public Employee`s Retirement
Board on or before June 1st, 1993, and
WHEREAS, the City of Kalispell has several employees who have
expressed an intention to voluntarily terminate their
employment with the City if the City elects to
participate in said retirement incentive program, and
WHEREAS, the City of Kalispell considers it appropriate to
participate in said retirement incentive program.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That the City of Kalispell, hereby, makes an
irrevocable election to participate in the
Retirement Incentive Program authorized by HB
517.
SECTION II. That the City Manager of the City of Kalispell
is, hereby, authorized to execute on behalf of
the City of Kalispell the Irrevocable Election
certificate provided by the Public Employee's
Retirement Board evidencing City
participation.
SECTION III. This Resolution shall become effective
immediately upon its passage by the City
Council and approval by the Mayor.
