RESOLUTION NO. 4091
A RESOLUTION AUTHORIZING LOCATION OF AN ALL BEVERAGE LIQUOR LICENSE
AT 313 2ND AVENUE WEST, KALISPELL, AND DECLARING AN EFFECTIVE DATE.
WHEREAS, AMVETS, Post 1 has made an application for an all
alcohol beverage Veterans license to operate the "American Club" at
313 2nd Avenue West, and
WHEREAS, the American Club proposed location is within 600
feet and on the same street as the Community Alliance Church, and
WHEREAS, Section 16-3-306, M.C.A., prohibits the location of
retail liquor licenses on the same street within 600 feet of a
church, synagogue, place of worship, or public school, and
WHEREAS, the American Club proposed location is within the
Central Business, B-4 classification of the Kalispell Zoning
Ordinance, which allows bars, taverns, cocktail rounges,. and clubs
as a permitted use, and
WHEREAS, the Community Alliance Church has notified AmVets,
Post 1 that the Church has no objection to locating the American
Club at 313 2nd Avenue West, and
WHEREAS, §16-3-309, MCA authorizes a city to pass a resolution
authorizing a location for a retail liquor license at any site
notwithstanding the provision of S16-3-306, MCA.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION I. That the City of Kalispell pursuant to 516-3-
309, MCA authorizes the location of the American Club at
313 2nd Avenue West, Kalispell, Montana, notwithstanding
the provision of 516-3-306, MCA.
SECTION II. This Resolution shall become effective
immediately upon passage by the City Council and approval
by the Mayor.
