RESOLUTION NO. 4087
A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF THE
SUBDIVISION OF TRACT NUMBER 6G IN SECTION 12, TOWNSHIP 28 NORTH,
RANGE 22 WEST, P.M.M., FLATHEAD COUNTY, MONTANA.
WHEREAS, Greenbriar Enterprises, the owner of certain real
property described as Tract Number 6G in Section 12, Township 28
North, Range 22 West, P.M.M., Flathead County, Montana, has
petitioned for the approval �,of the Subdivision Plat of said
property, and
WHEREAS, the Flathead Regional Development Office has reviewed
the proposed subdivision and made a report to the City Council of
the City of Kalispell, said report considering and weighing all
public interest criterion set forth in Section 2.2(F)(3),
Subdivision Regulations of the City of Kalispell, and
WHEREAS, the City Council of the City of Kalispell has
reviewed the report of the Flathead Regional Development Office and
has found from the preliminary plat, and evidence, that the
subdivision is in the public interest, and
WHEREAS, the City Council of the City of Kalispell held a
public hearing pursuant to 2.2(F), Subdivision Regulations of the
City of Kalispell, on the proposed subdivision on the 4th day of
January, 1993, and
WHEREAS, the City Council has based its public interest
findings upon the following findings of fact:
A. EFFECTS ON PUBLIC HEALTH AND SAFETY:
The effects and/or impacts of fifty-four single-family
lots at this location is expected to be minimal relative
to public health and safety. This subdivision, upon
annexation, will be within the jurisdiction of the
Kalispell Police and Fire Departments. Emergency medical
support is located nearby at Kalispell Regional Hospital.
The proposed lots are on property well -suited to
accommodate residential development. A small portion of
the property along Spring Creek is within the 100-year
floodplain; this area is not slated for residential
development. Access to the site is available via Two
Mile Drive, a County road.
B. EFFECTS ON WILDLIFE AND WILDLIFE HABITAT:
The subject property lies in an area which is residential
in character; there appears to be no .residual wildlife
habitat of significant value remaining on the site, other
than that area immediately adjacent to Spring Creek. A
recommended condition of approval will preserve that area
in its natural state.

C. EFFECTS ON THE NATURAL ENVIRONMENT:
The proposed

D. EFFECTS ON TAXATION:
According to figures obtained from the County Appraiser's
office, the unimproved value of the subject property is
$64,000 and annual taxes are $895. It is estimated that
following subdivision, the individual lots will have an
average value of approximately $15,000 and, assuming each
lot is developed with a $125,000 home, will generate
$1,959 in taxes. The 54 lots would represent
approximately $105,800 in tax revenue.
E. EFFECTS ON LOCAL SERVICES:
1. Schools:
Based on the county -wide average of 0.4 children of
school age per household, development of 54 single-family
lots is likely to contribute approximately 22 school aged
children to the Kalispell School District.
2. Fire Protection:
The subdivision will be served by the Kalispell Fire
Department. The Department has no expressed concerns
relative to subdivision design or its ability to
adequately serve the development. Once final design of
the road system is complete, the Department will
determine its needs with respect to placement and number
of on -site fire hydrants.
3. Police Protection:
The Kalispell Police Department can adequately serve the
additional 54 lots. No additional manpower or equipment
will be necessary.

4. Roads:
The subject property has frontage on Two Mile Drive, a
County road. The estimated 540 average daily trips which
this subdivision will generate is certain to impact
traffic on Two Mile Drive, a substandard arterial. There
is a great need for a street in this vicinity which would
connect Two Mile Drive with Highway 2 West. To this end,
the owner of the subject property, as a recommended
condition of approval, will be required to dedicate to
the city a 30-foot-wide road and utility easement along
the site's southerly property line.
5. Water:
City of Kalispell water service will be available upon
annexation to the City. All main extensions will be the
sole responsibility of the developer.
6. Sewer:
City of Kalispell sanitary sewer is also available for
extension to the site upon annexation.
7. Public Health Services:
Existing medical facilities in Kalispell will be able to
accommodate the medical needs and emergencies of the
residents of this subdivision.
8. Parks:
The applicant has proposed the dedication of 1.64 acres
of parkland in the southwest corner of the development.
The City's Director of Parks and Recreation and the FRDO
staff are recommending that a twenty -foot -wide corridor
adjacent to Spring Creek be dedicated to the City, as
well as that property identified as Lot #15 on the plat.
It is the city's intent to develop a pathway adjacent to
the creek, with Lot #15 serving as an access to that
creekside path. The developer will also be required to
dedicate to the city a 30-foot-wide road and utility
easement at the southerly edge of the development. This
easement will require lots in the vicinity of the
proposed park to be reconfigured to accommodate the
easement and the relocation of Lot #15.
F. EFFECTS ON AGRICULTURE:
The proposed subdivision will have no direct or indirect
impacts on agricultural activities.

G. EXPRESSED PUBLIC OPINION:
Property owners within 150 feet of the property have been
notified of the application for preliminary plat. To
date, no one has expressed a comment on the proposed
subdivision.
H. NEED FOR SUBDIVISION:
The applicant has not provided evidence of a true need
for this subdivision. The growth which the county is
experiencing does require a range of housing
opportunities however, and it is expected that there is
a market and a need for this type and scale of
residential development.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA:
SECTION I. That the application of Greenbriar
Enterprises for approval of the subdivi§ion of the
property described as Tract 6G in Section 12, T28N, R22W,
P.M.M., Flathead County, Montana is hereby approved
subject to the following conditions:
1. That the subdivision gain approval to file plat from
the State Department of Health and Environmental
Sciences.
2. That the final plat be substantially in accord with
the "Preliminary Plat of Greenbriar" as prepared by Smith
Surveying of Kalispell, MT except as modified by
conditions contained herein.
3. That all structures and lot sizes comply with the
bulk and dimensional requirements of the city of
Kalispell's R-4 zone district. The covenants shall make
reference to the underlying zone district.
4. That the owner dedicate an easement encompassing the
southerly 30 feet of the subject property to the City of
Kalispell for future road and utility purposes.
5. That the owner dedicate to the city, as fulfillment
of the parkland dedication requirement, the following:
a. That area identified on the preliminary plat as Lot
#15;

b. A thirty (30) foot wide corridor adjacent to the
centerline of Spring Creek where said centerline forms
the property line of the subject property; and
C. Additional parkland in the southwest corner of the
of Section
plat as needed to satisfy the requirements
24A-37 of the City of Kalispell's Subdivision
Regulations.
6. All water lines, sewer mains and sewer lift stations
shall be built according to plans and specifications
approved by the City of Kalispell Public Works
Department. All water and sewer main extensions onto
private property shall be placed within suitable
easements.
7. The internal road system shall be built to City of
Kalispell standards and approved by the city's Public
Works Department.
8. The applicant shall submit a detailed landscape,
signage and entry plan addressing treatment of the
entrance to the subdivision from Two Mile Drive. The
applicant shall also consult with the Kalispell School
District, and provide a school bus pull-out lane adjacent
to Two Mile Drive if requested by the district.
9. A storm water drainage plan prepared by a licensed
engineer shall be submitted to and approved by the City's
Public Works Department.
10. Placement of fire hydrants shall be approved by the
City of Kalispell Fire Department.
11. A common mailbox site shall be identified and
approved by the U.S.P.S.
12. That street lights, with underground wiring, shall
be installed based upon a plan approved by the Director
of Public Works.
13. An additional 10 feet of right-of-way dedicated for
road purposes on Two Mile Drive.
14. That the subdivision can be built in phases. If the
subdivision is built in phases, all improvements not in
place at the time of final plat shall be included in a
subdivision improvement agreement entered into between
the developer and the City of Kalispell.

SECTION II. The classification of said premises under
the Kalispell Zoning Ordinance shall not be changed by
the action.
SECTION III. That this preliminary plat should be
effective for a period of one year following passage of
this Resolution.
SECTION IV. That upon proper review and filing of the
final plat of said subdivision in the office of the
Flathead County Clerk & Recorder, said premises shall be
a subdivision of the City of Kalispell.
