RESOLUTION NO. 3970
A RESOLUTION AUTHORIZING THE PURCHASE OF LOTS 13, 14, 15 AND 25'
OF AN ABANDONED ALLEY, IN BLOCK 25, KALISPELL ORIGINAL FROM THE
FIRESTONE TIRE AND RUBBER COMPANY AND AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID PROPERTY ON BEHALF OF THE CITY CIF
KALISPELL.
WHEREAS, the City of Kalispell has the authority pursuant to
Section 7-15-4258, Montana Code Annotated to purchase real
property and to hold, improve, clear or prepare said property for
redevelopment, and
WHEREAS, the City by Ordinance No. 1065 passed on the 4th day of
November, 1985, did designate certain projects within the
Downtown Redevelopment Area as Urban Renewal Projects, and
WHEREAS, on of the projects designated by Ordinance No. 1065
consisted of the acquisition by the City of certain parcels of
land deemed "blighted" within the Project Area and the
undertaking of clearance and demolition activities necessary to
make the land available for redevelopment by private enterprise,
and
WHEREAS, the Firestone Tire and Rubber Company, a corporation
owns certain real property, to -wit: Lots 13, 14, 15 and 25' of an
abandoned alley in Block 25, Kalispell Original, Flathead CountIl,
Montana, said real property being within the Project Area, and
WHEREAS, the Firestone Tire and Rubber Company has offered to
sell said real property to the City for the sum of $164,500, and
WHEREAS, the City Council after reviewing the offer made by the
Firestone Tire and Rubber Company deem it appropriate, pursuant
to Ordinance No. 1065, and in the best interest of the Kalispell
Redevelopment Plan, that the City accept the offer made by the
Firestone Tire and Rubber Company, and purchase the property for
the purpose of making it available for redevelopment by private
enterprise.
NOW AND THEREFORE, be it resolved by the City Council of the City
of Kalispell, as follows:
SECTION I. That the City Manager is authorized and
directed.to purchase from the Firestone Tire and Rubber
Company Lots 13, 14, 15, and 25' of an abandoned alley
in Block 25, Kalispell Original, Flathead County,
Montana, for the sum of One Hundred and Sixty Four
Thousand Five Hundred Dollars ($164,500.00).
SECTION II. That the City Clerk is authorized and
directed to pay in accordance with instructions from
Firestone Tire and Rubber Company the sum of One
Hundred and Sixty Four Thousand Five Hundred Dollars
($164,500.00) with funds properly appropriated from the
cash flow of the Tax Increment Financing District of
the City of Kalispell.
SECTION III. That the City Attorney is authorized and
directed to prepare any documents necessary to effect
this Resolution and the City Manager is authorized and
directed to accept and properly record on behalf of the
City of Kalispell the deed to said property.
