1, the undersigned, being the duly qualified and acting recording officer of the City of

COUNTY, MONTANA (PREVIOUSLY ZONED COUNTY I-1, LIGHT INDUSTRIAL) TO CITY
1-1 (LIGHT INDUSTRIAL), IN ACCORDANCE WITH THE KALISPELL GROWTH POLICY
2020� AND TO PROVIDE AN EFFECTIVE DATE" (the "Ordinance"), on file in the original
records of the City in my legal custody; that the Ordinance was duly adopted on second reading by
the City Council of the City at a regular meeting on November 21, 2005, and that the meeting was
duly held by the City Council and was attended throughout by a quorum, pursuant to call and notice
of such meeting given as required by law; and that the Ordinance has not as of the date hereof been
amended or repealed.
I further certify that, upon vote being taken on the Ordinance at said meeting,, the following
Council members voted in favor thereof: Jim Atkinson, Kari Gabriel, Bob Hafferman Bob Herron,
Randy Kenyon, Tim Kluesner, Duane Larson, Hank Olson, and Mayor Pamela B. Ken ; voted

AN ORDINANCE TO AMEND SECTION 27,02.010, OFFICIAL ZONING MAP, CITY OF
KALISPELL ZONING ORDINANCE, (ORDINANCE NO, 1460)9 BY ZONING CERTAIN REAL
PROPERTY DESCRIBED AS PARCEL A OF CERTIFICATE OF SURVEY 16337 LOCATED IN
SECTION 33, TOWNSHIP 28 NORTH, RANGE 21 WEST, PM.M, FLATHEAD COUNTY,
MONTANA (PREVIOUSLY ZONED COUNTY 1-1, LIGHT INDUSTRIAL) TO CITY 1-1 (LIGHT
INDUSTRIAL), IN ACCORDANCE WITH THE KALISPELL GROWTH POLICY 2020, AND TO
PROVIDE AN EFFECTIVE DATE.
WHEREAS, Montana Venture Partners, the owners of the property described above, petitioned the City of
Kalispell that the zoning classification attached to the above described tract of land be zoned
1-19 Light Industrial, on approximately 55 acres of land, and
WHEREAS, the property is located on the northeast corner of Rocky Cliff Drive and Demersville Road,
and
WHEREAS, Montana Venture Partners' petition was the subject of a report compiled by the Tri-City
I dated June 14 2005, in which the Tri-City
Plann*ng Office, Staff Report #KA-05-11,
Planning Office evaluated the petition and recommended that the property as described above
be zoned I-1, Light Industrial as requested by the petition, and
WHERF,AS, after considering all the. evidence submitted on the proposal to zone the property as described

I-L Light Industrial, the City Council finds such initial zoning to be consistent with the
Kalispell Growth.Policy 2020 and adopts, based upon the criterion set forth in Section 76-3-

6ft M.C.A., and State, Etc. v. Board of Coun1y, Commissioners, Etc. 590 P2d 602, the
findings of fact of TCPO as set forth in Staff Report No. KA-05-11.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS
FOLLOWS:
SECTION 1. Section 27.02-010, of the Official Zoning Map of the Kalispell Zoning
Ordinance, (Ordinance No. 1460) is hereby amended by designating the
property described above as 1-1, Light Industrial, on approximately 55 acres
of land.
SECTION H. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell
Zoning Ordinance not amended hereby shall remain in full force and effect.
SECTION M. This Ordinance shall be effective thirty (30) days from and after the date of
its final passage and approval by the Mayor.
