Ford 610 Benton Missoula, MT 59801 Ashley Square Partnership 1325 Highway 2 West Kalispell, MT 59901 Subscribed and sworn to before me, a Notary Public for the State of Montana, this /51;��� day of 1 19950 eilj- - L...f Notary PublIc , State of Montana Residing at Kalispell My Commission expires NOTICE OF PASSAGE OF RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT NO* 342 AND TO ISSUE THE CITY' S SPECIAL IMPROVEMENT DISTRICT NO* 342 BONDS IN THE AGGREGATE PRINCIPAL AMOUNT OF $209,f 000,o 00 SECURED BY THE CITY'S SPECIAL IMPROVEMENT DISTRICT REVOLVING FUND CITY OF KALISPELL, MONTANA NOTICE IS HEREBY GIVEN that on July 24, 1995 the City Council of the City of Kalispell, Montana (the *Cityn ), adopted a Resolution of Intention to Create Special Improvement District No. 342 (the " District" ) f or the purpose of f Inancing the costs of certain local improvements (the 0 Improvementsx ) and paying costs incidental thereto, including costs associated with the sale and security of special improvement district bonds of the City drawn on the District (the "Bonds' ) , the creation and administration of the District, the funding of a deposit to the Citys s Special Improvement District Revolving Fund (the a Revolving Fundx and the establishment of a reserve account securing the Bonds in the District fund (the I Reserve Accountm ) . The Improvements shall be constructed - and installed pursuant to plans and specif ications prepared by the Carver Engineering, and approved by the City Engineer. A complete copy of the Resolution of Intention (the "Resolution' is on file with the City Clerk of Council which more particularly describes the nature of the Improvements, the boundaries and other matters pertaining thereto and further particularse A map of the proposed District accompanies this notice. The Improvements consist of building storm sewer, water mains, street lights, curb and gutter and paved road, on Corporate Drive, The total estimated costs of the 'Improvements including incidental costs, are $209,000.00. The City would issue the Bonds in an aggregate principal amount not to exceed $209,000-00 in order to finance the costs of the Improvements,. Principal of and interest on the Bonds will be paid from special assessments levied against the property in the District in the aggregate principal amount of $209,000*00 and such payment will be secured by the Reserve Account and the Revolving Fund. Subject to the limitations of Montana Code Annotatedr Section 7-12-4222, the general fund of the City may be used to provide loans to the Revolving Fund or a general tax levy may be imposed on all taxable property in the City to meet the financial requirements of the Revolving Fund. All properties in the District are to be assessed for a portion of the costs of the Improvements, as specified herein. The costs of the Improvements shall be assessed against the property in the District benefitting from the Improvements, based on the following: The District's cost of constructing and installing the storm sewer water mains, street lights, curb and gutter and paved road on Corporate Drive, shall be assessed by determining the lots fronting upon the Improvements and assessing each lot as its frontage bears to its proportion of the whole cost of the Improvements. Lots not fronting shall be assessed based upon an average fronting of those lots fronting the Improvements* On August 21, 1995,, at 7:00 PsM* M*D,T,,, in the Council Chambers at.City Hall,, 312 Ist Avenue East, Kalispell Montana, the City Council will conduct a public hearing and pass upon all written protests against the creation or extension of the District, or the making of Improvements that may be filed in the period hereinafter described* Written protests against the creation of the District and the making of the Improvements may be filed by an agent, person, firm, or corporation owning real property within the proposed District whose property is liable to be assessed for the Improvements. Such protests must be delivered to the City Clerk of Council at the City of Kalispell, 312 1st Avenue East, P*O.
