Patrick, City Manager Final Plat for Cottonwood Park Subdivision MEETING DATE: September 19, 2005 BACKGROUND: This is a request for final plat approval of Cottonwood Park Subdivision that plats 39 lots consisting of 31 single family lots and 8 townhouse lots on approximately ten acres. This subdivision is located at the northwest corner of Stillwater Road and Three Mile Drive. Most of the required infrastructure has been completed and constructed in accordance with City standards. The remaining improvements are being addressed with a subdivision improvements agreement and a letter of credit in the amount of 125 percent of those costs totaling $11,640. It is anticipated that the remaining improvements will be completed by July 31, 2006 in accordance with the agreement. A park has been dedicated and approximately $20,000 in park improvements is included in the SIX When the property was annexed into the city and given an R-3, Urban Single Family Residential zoning designation, the subdivision was given preliminary plat approval by the Kalispell City Council on April 4, 2005 subject to conditions. Subsequently a conditional use permit was granted allowing the conversion of four single family lots into four two unit townhouse lots subject to the same conditions as the preliminary plat. A list of the conditions of preliminary plat approval for this subdivision and a discussion of how they have been met or otherwise addressed is included with the transmittal letter attached. RECOMMENDATION: A motion to accept the subdivision improvements agreement and approve the final plat for Cottonwood Park Subdivision 4 would be in order. WITNESSETH: THAT WHEREAS, the Developer is the owner of a new subdivision known as "COTTONWOOD PARK", located in Section 2, T28N, R22W, PM,M, Flathead County and, WHEREAS, the city has conditioned it's approval of the final plat of "COTTONWOOD PARK", upon the conditions as set forth in the Preliminary Plat of the Subdivision being completed and all improvements, as cited in "Exhibit A" have not been completed at this time, and the Developer wishes to bond for the completion of those improvements set forth in "Exhibit A"; and WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide a financial security of 125% of the estimated total cost of construction of said improvements as evidenced by an estimate prepared by a licensed public engineer or the contractor included herewith as "Exhibit B", and WHEREAS, the estimated total cost of construction of said improvements is the sum of $89,312.00. NOW THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows: 1. The Developer shall deposit as collateral with the City a Letter of Credit, or other acceptable collateral as determined by the City Council, City of Kalispell, Montana, in the amount of $111,640.00. Said fetter of Credit or other collateral shall have an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following: a. That the creditor guarantees funds in the sum of $111,640.00, the estimated cost of completing the required improvements in "COTTONWOOD PARK". b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay the City immediately, and without further action, such funds as are necessary to finance the completion of those improvements up to the limited of credit stated in the letter; 2. That said required improvements shall be fully completed by JULY 31, 2006. 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: a. All required improvements are complete; b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City: c. That the Developer knows of no defects in those improvements; d. That these improvements are free and clear of any encumbrances or liens; e. That a schedule of actual construction costs have been filed with the City; and f. All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of final plans, profiles, grades and specifications of said improvements, with the certification of the registered professional engineer responsible for their preparation that all required improvements have been installed in conformance with said specifications. IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS, TO -WIT: That the Developer shall provide for inspection of all required improvements by a registered professional engineer before the Developer shall be released from the Subdivision Improvement Agreement. That if the City determines that any improvements are not constructed in compliance with the specifications, it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure such compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the specifications, or within the required time limits, it may withdraw the collateral and employ such funds as may be necessary to construct the improvement or improvements in accordance with the specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate. Dear Jim: Our office has received an application for final plat approval of Cottonwood Park Subdivision that plats 39 lots consisting of 31 single family lots and S townhouse lots on approximately ten. acres. COMPLIANCE WITH CONDITION'S OF APPROVAL Condition No. 1 That the development of the site shall be in substantial compliance with the application submitted, the site plan, materials and other specifications as well as any additional conditions associated with the preliminary plat as approved by the city council. (Kalispell Subdivision Regulations, Appendix C -- Final Plat) . Cottonwood Park Subdivision September 14, 2005 Page 2 • This condition has been met. The final plat complies with the preliminary plat that was approved. Condition No. 2 That the plans and specifications for all public infrastructure be designed and installed in accordance with the Kalispell Design and Construction Standards and a letter shall be obtained stating that they have been reviewed and approved by the Kalispell Public Works Department. (Kalispell Subdivision. Regulations, Chapter 3, Design Standards, Section 3.01). This condition has been met. A letter from the Kalispell Public Works Department dated 7/25/05 approving the infrastructure plans has been submitted with the final plat. Condition No. 3 That a minimum 20-foot buffer strip shall be established along Three Mile Drive and along Stillwater Road between the roads and the subdivision that would include a bike and pedestrian trail and buffering in the form of berming or landscaping or both. These improvements are to be coordinated with the Kalispell Public Works Department, Parks and Recreation Department, Flathead County Road Department and Montana Department of Transportation. This condition has been adequately addressed. Most of the bike and pedestrian path has been completed with the remaining improvements being covered under the subdivision improvements agreement. Condition No. 4 Lot 7 which has a substantial part of the building pad located in the 100 year floodplain be eliminated and the lots to the south be shifted to the north so that the building pad for Lot 1 will be entirely out of the floodplain. (Kalispell Site Development Review Committee) • This condition has been met. The lots have been rearranged so that there are no lots in the 100 year floodplain. Condition No. 5 Demonstrate that development within the 40 by 40 foot building area for proposed Lot 36 can be achieved without disturbance or filling the 100 year floodplain area and that the required setbacks can be net. (Kalispell Site Development Review Committee) • This condition has been met. A detailed sketch indicating; a 40 by 40 foot building area has been submitted with the final plat. Condition No. 6 That a pedestrian access be developed to access the park area from the north where Lot 7 would have been previously located. (Kalispell Site Development Review Committee) • This condition has been adequately addressed. A pedestrian path has been indicated on the plat at the north end of the subdivision where Lot 7, now Lot 6, is located. Cottonwood Park Subdivision September 14, 2005 Page 3 Condition No. 7 That a letter be obtained from the Kalispell Parks and Recreation Director approving a landscape plan for the placement of trees and landscaping materials within the five foot landscape boulevard developed between the curb and the sidewalk. (Kalispell Subdivision Regulations, Section 3.11). This condition has been met. A letter from the Kalispell Parks and Recreation Department dated 8/23/05 approving a plan for landscaping has been submitted with the final plat. Condition No. 8 That the area designated on the plat as "park" shall satisfy in part the requirements for parkland dedication and shall be developed in accordance with a plan approved by the Kalispell Parks and Recreation Director that provides recreational amenities including but not limited to pedestrian access, irrigation, landscaping and play equipment so as to provide a recreational component within the development and not simply left as passive open space. The developer shall attempt to coordinate with the developer of Blue Heron Estates and the Kalispell Parks and Recreation Department to develop a park that is integrated with the park development plans for Blue Heron Estates to the west. (Kalispell Subdivision Regulations, Section 3.19). This condition has been adequately addressed. A letter from. the Kalispell Parks and Recreation Department dated 9/ 12/05 outlining a plan for park improvements and the estimated cost of the improvements has been submitted with the final plat. The cost of the park improvements has been included in the subdivision improvements agreement. Condition No. 9 The following requirements shall be met per the Kalispell Fire Department: (Kalispell Subdivision Regulations, Section 3.20). a. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with the International Fire Code (2003) Appendix B. b. Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. C. Fire Department access shall be provided in accordance with International Fire Code (2003) Section 503. d. Due to project phasing it should be noted that hazardous weed abatement shall be provided in accordance with City of Kalispell Ordinance 10-8. e. It is recommended that consideration be given to annexation of Three Mile Drive and Farm to Market Road adjacent to the public right-of-way. • This condition has been met. A letter from the Kalispell Fire Department dated 4/4/2005 approving the subdivision has been submitted with the final plat. Condition No. 10 The roads within the subdivision shall be named and signed in accordance with the policies of the Kalispell Public Works Department and the Cottonwood Park Subdivision September 14, 2005 Page 4 Uniform Traffic Control Devices Manual and be subject to review and approval of the Kalispell Fire Department. A letter shall be obtained from the Kalispell Public Works Department stating the naming and addressing on the final plat have been reviewed and approved. (Kalispell Subdivision Regulations, Section 3.09). This condition ha been adequately addressed. Signage has been included in the subdivision improvements agreement. Condition No. I I All existing and proposed easements shall be indicated on the face of the final plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A five foot utility easement be placed behind the right-of-way along all lots to allow for the placement of utilities minus City sewer and water. The placement of utilities should be coordinated with the respective utility companies prior to construction. A letter from the Kalispell Public Works Department shall be obtained stating that the required easements are being shown on the final plat. (Kalispell Public Works Department). • This condition has been met. The required easements have been indicated on the face of the final plat. Condition No. 12 After the construction and installation of utilities are completed, the developer shall insure that all property corners are replaced by a licensed surveyor that might have been disturbed during construction. In locations where there is a conflict such as an electrical pad, an offset marketer shall be placed and recorded on the final plat. (Kalispell Public Works Department). • This condition has been adequately addressed. Required monumentation will be completed upon completion of the final site work. Condition No. 13 The developer shall provide a letter from the U.S. Postal Service approving the plan for mail service. (Kalispell Subdivision Regulations, Section 3.22). • This condition has been met. A letter from the USPS not dated has been submitted with the final plat. Condition No. 14 Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude unnecessarily onto adjoining properties. (Kalispell Subdivision Regulations Section 3.09(L)). This condition has been adequately addressed. The street lights have been purchased from FEC and the paid invoice included with the final plat application. Condition No. 15 All utilities shall be installed underground. (Kalispell Subdivision Regulations, Section 3.17). • This condition has been met. Utilities have been installed underground as verified by an on -site inspection. Cottonwood Park Subdivision Septernber 14, 2005 Page 5 Condition No. 16 That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. • This condition has been met. Improvements in excess of two thirds have been completed prior to final plat submittal. Condition No. 17 The base flood elevation of the 100 year floodplain be delineated, along with the elevation, and be indicated on the final plat. • This condition has been met The 100 year floodplain has been shown on the face of the final plat along with the BFE. Condition No. IS All areas disturbed during development of the subdivision shall be re -vegetated with a weed -free mix immediately after development. • This condition has been adequately addressed. Seeding has been included in the subdivision improvements agreement. Condition No. 19 A note shall be placed on the face of the final plat which waives protest to the creation of a special improvement district for upgrade of roads in the area to City standards which are impacted by this subdivision. • This condition has been met. The required note has been placed on the face of the final plat. Condition No. 20 That preliminary plat approval shall be valid for a period of three years from the date of approval with an automatic two year extension as each phase of the subdivision plat has been completed and filed if the subdivision is phased. (Kalispell Subdivision Regulations, Section 2.04). • This condition has been met. The final plat has been submitted prior to the expiration of the preliminary plat. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the amended preliminary plat which was reviewed and approved by the City Council on June 6, 2005. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. Cottonwood Park Subdivision September 14, 2005 Page 6 COMPLIANCE WITH THE ZONING REGULATIONS This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance and the R-3, Urban Single Family Residential, zoning designation and the conditional use permit for the creation of the townhouses for the property which governs the dimensional requirements of the lots within the subdivision as well as the uses. RECORMIENDATION: All of the conditions of preliminary plat approval have been met or otherwise adequately addressed. The staff would recommend that the Kalispell City Council approve the final plat for Cottonwood Park Subdivision. The following requirements shall be met per the Kalispell Fire Department. a. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Open space park turf areas need to be level with adequate grass, either seeded or sod. The pedestrian/bicycle path connecting the parks from Blue Herron to Cottonwood was agreed upon as being leveled and covered by turf; this would allow an avenue to walk from one area to the other. The subdivision perimeter bicycle path would be hard surfaced asphalt. You are required to submit a plan to our office showing all of these park improvements and identifying the manner in which this park area will be made accessible by Blue Herron residents. The owner is responsible to maintain the lot and road right-of-way, including side walks. Driveways shall be adequately reinforced concrete. 6. Building limits and exterior walls of the building and foundation are to be designed to meet all set backs established for the applicable zoning. 6.1 Building Size: Each dwelling unit shall be built and contain not less than 1,200 square feet of total living space; exclusive of attached garage and open porches. Houses with exact exterior designs must not be in adjoining lots. if the designs are similar they must be differentiated with such things as porch design dormers, bays or the like. Simply " flipping„ a plan would not be adequate. 6.2 Buildings should provide horizontal and/or vertical breaks in the wall planes. Establishing a rhythm of openings between solids and voids in the facade through design and proportion_ Front and Rear Elevations should be articulated with relief. Variations in set backs in both plane and elevation are encouraged. 6.3 Building Heights should take advantage of the view opportunities, while at the same time be sensitive to adjacent development, and land slope. Maximum building heights are measured in accordance with applicable zoning. 6.4 Roof Shape and Character is important to avoid vertical monotony. The use of porch or balcony roofs and dormers of all sizes contributes to the human scale. This is encouraged to provide a texture and an apparent reduction of the built mass. 6.5 Finishing for the various building faces, walls and roofs must adhere to the following notes: A. materials for roofs may be asphalt, flat concrete or fiber- cernentltile or similar composition material, metal or wood material must be approved by DRB. B. Siding Materials for walls must be lap style. Stucco, stone or brick may be incorporated as an accent. C. Materials for garage doors are preferred in a type of maintenance free construction_ 6.6 Exterior lighting is to be limited to low intensity non -glare fixtures to provide adequate illumination for safety and aesthetic enhancement. Uncovered light fixtures or non- focused, non -downward lighting fixtures are not permitted. 6.7 Building Accessories are those various attributes that are part of the atmosphere of each building. The following elements are often used and the following conditions are directed at how they may be used in Cottonwood Park. A. Antennae are restricted to interior attics applications only. B. Satellite dishes may be used if discretely located on the building and a maximum 24" diameter_ Large ground mounted satellite dishes are prohibited. C. Address identification, is mandatory and suggested near the road by the vehicle access driveway for delivery and emergency response purposes. D. Garbage must be contained near the side or rear of each residence in containers furnished by garbage disposal services. E. Fencing is to comply with applicable zoning. F. Out buildings shall be developed to coordinate with architectural motif and finish of the house. They are to be located within the back yard, and cannot be larger than 10% of the living space of the house. 6.8 Compliance with other regulations_ It remains the responsibility of the Owner/Builder to ensure that the construction of any buildings on the site conforms with State, Town or Municipal laws, regulations, by-laws or other enactment's and any encumbrances affecting the title to the property, including, without limitation, utility rights -of -way, easements and restrictive covenants and all requirements outlined in the drainage section of these covenants. 7. Landscape Guidelines All open or undeveloped area of the lot should be seeded or sodded in conjunction With any other plants, shrubs or trees and maintained appropriately. This must be done within 6 months of occupancy. 7.1 Tree planting is encouraged as part of your lot and development process. 7.2 Lawn Areas shall be seeded or sodded with a rnowable seed mixture. 7.3 Retaining 'galls are to be designed and constructed so as to blend into the natural landscape. They may take on a more natural appearance through the use of native rock, timber and plant material, or perhaps reflect the architecture presented through the building by incorporating matching or complimentary material and detail. 8. Site Guidelines The following guidelines shall be included in any construction and/or project plans for any lot located within Cottonwood Park_ These guidelines shall be strictly adhered to and shall be interpreted as the intent of these Design Guidelines, Conditions, Covenants, and Restrictions. 8.1 Purpose Use and Activities. A. No lot shall be used except for single-family residential purposes, or duplex/townhouse. B. No lot or sub lot shall be further subdivided. C. No temporary building, house trailer, mobile home, basement or partly finished building or structure shall be erected or placed upon any lot during construction. All exterial construction shall be complete within one year from the date construction begins. All homes must be new construction. Factory built homes are not allowed within the subdivision. D. The parking or storage of campers, camping trailers, pick-up campers, boats, snowmobiles, trailers, infrequently used or seasonal vehicles must be kept in the side or back yard. Street parking is reserved for short term parking such as guests. E. No advertising, billboards or advertising structures of any kind shall be erected, used or maintained on the property. F. At the time of home construction, lot owner shall construct a minimum one car attached garage. G. Home business must comply with applicable zoning and must comply with city ordinances and not create undo vehicle traffic. H. Fuel tanks are not allowed. I. All utilities shall be under ground. 8.2 Park Space(Recreational Area). A. Park space has been created as per subdivision regulations and some non home owner use can be expected but not encouraged. 8-3) Animals, Birds, and Pets No animals. Livestock or poultry of any kind shall be raised, bred or kept on any lot, except that dogs, cats, or household pets may be kept, provided that they are not kept bred or maintained for any commercial purpose and must be confined to their owners property and must be kept under their direct control, as per local ordinance. All structures upon the property shall be kept in good repair and appearance. C. No part of this property shall be used or maintained as a dumping ground or storage ground for rubbish, trash, garbage, old automobile or other waste. AN waste shall be stored in containers furnished by garbage disposal services and shall be promptly removed from the property in a timely manner. D. Property owners shall comply with a weed management plan approved by the Flathead County Noxious Weed Board. 9. General Provisions A.. These Covenants are to run with the land, and shall be binding on all parties, and all persons claiming under them, unless an instrument signed by a majority of the owners of the lots has been recorded agreeing to change said covenants in whole or in part. B. The Grantor and every person hereinafter receiving any right, title or interest in any tract in said property shall have the right to prevent or stop violation of any of the said restrictions by injunction or other lawful procedure, in law or in equity against the persons violating or threatening to violate these restrictive covenants. Any person who shall prosecute an action successfully may recover any damages resulting from such violation, and it is expressly understood by any persons purchasing this property that, if an action is successfully brought against him/her for a violation of these covenants, that a reasonable attorney's fee shall be assessed against him/her in addition to any other damages.
