Wilson, Senior Planner Frank Garner, Interim City Manager SUBJECT Final Plat for Leisure Heights Phase 1 MEETING DATE: November 1, 2004 BACKGROUND: This is a request for final plat approval of Leisure Heights Phase 1, a 35 lot residential subdivision and homeowners park on approximately 12.196 acres. The property is generally located on the east side of Willow Glen Drive north of Kelly Road. The property was annexed into the city of Kalispell as part of the preliminary plat review process and given an initial zoning designation of R-2, a Single Family Residential, zoning district that has a minimum lot size requirement of 9,600 square feet and is intended for single family residential development. The entire Leisure Heights subdivision contains approximately 67 lots on 32 acres which was given preliminary plat approval by the Kalispell City Council on March 17, 2003, a three-phase development, This is the first phase which lies to the north of The Willows subdivision and extends Honeysuckle Drive. An automatic two-year extension of the preliminary plat approval is granted for each successive phase of original preliminary plat. As a requirement of the preliminary plat, more than two-thirds of the required improvements have been installed and a Subdivision Improvements Agreement in the amount of $83,778.75 has been submitted to secure completion of the remaining improvements which consists primarily of curb, gutter, sidewalk and landscaping. The letter of credit addresses 125% of the estimated cost of remaining improvements. The estimated completion date is May 15, 2005 or sooner. RECOMMENDATION: A motion to accept the Subdivision. Improvements Agreement and approve the final plat for Leisure Heights Phase 1 would be in order. FISCAL EFFECTS: Potential minor positive impacts once developed. WITNESSETH: THAT WHEREAS, the Developer is the owner and developer of a new subdivision known as Leisure Heights — Phase I, located at N'/2, NWI/4, Section 21, T 28N, R 21 W, Flathead County, Montana and, WHEREAS, the City has conditioned its approval of the final plat of Leisure Heights -- Phase I upon the conditions as set forth in the Preliminary Plat of the Subdivision being completed and all improvements as cited in "Exhibit A" have not been completed at this time, and the Developer wishes to bond for the completion of those improvements set forth in "Exhibit A"; and WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide a financial security of 125% of the estimated total cost of construction of said improvements as evidenced by an estimate prepared by a licensed public engineer included herewith as `Exhibit I3' ; and WHEREAS, the estimated total cost of construction of said improvements is the sum of $67,023.00. NOW, THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows; 1. The Developer shall deposit as collateral with the City a Certificate of Deposit, in the amount of $83,778.75. Said Certificate of Deposit has an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following; Cdiv of Kalispell Subdivision Regulations Page 1 of 5 a. That the creditor guarantees funds in the sum of $83,778.75, 125% of the estimated cost of completing the required improvements in Leisure Heights — Phase 1. b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay to the City immediately, and without further action, such funds as are necessary to finance the completion of those improvements up to the limit of credit stated in the letter. 2. That said required improvements shall be fully completed by May 15, 2005, 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: a. All required improvements are complete; b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City; c. That the Developer knows of no defects in those improvements; d. That these improvements are free and clear of any encumbrances or liens; e. That a schedule of actual construction costs has been filed with the City; and, f. All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of final plans, profiles, grades and specifications of said improvements, with the certification of the registered professional engineer responsible for their preparation that all required improvements have been installed in conformance with said specifications. City of Kalispelf Subdivision Regulations Page 2 of 5 IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS, TO -WIT; That the Developer shall provide for inspection of all required i npravernents by a registered professional engineer before the Developer shall be released from the Subdivision Improvement Agreement. That if the City determines that any improvements are not constructed in compliance with the specifications, it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure such compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the specifications, or within the required time limits, it may withdraw the collateral and employ such funds as may be necessary to construct the improvement or improvements in accordance with the specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate. The preliminary plat was approved with 16 conditions as outlined below. The following is a discussion of compliance with each of these conditions as well as findings of compliance with the City subdivision regulations and zoning ordinance. COMPLIANCE WITH CONDITIONS OF APPROVAL: Condition No. 1 Development of the subdivision shall be platted in substantial compliance with the approved preliminary plat which governs the location of lots and roadways within the subdivision. The lots and roadway layout are in compliance with the preliminary plat that was approved. Condition, No. 2 That the roadways serving the subdivision shall be constructed in accordance with the adopted Design and Construction Standards for the City of Kalispell for local roads. A letter from an engineer licensed in the State of Montana certifying that the improvements have been installed according to the required specifications shall be submitted at the time of final plat approval along with a letter from the Kalispell Public Works Department stating that the required improvements have been reviewed and approved and comply with City standards. • This condition has been met or otherwise adequately addressed. Certification from Schwarz Engineering and a letter from the Kalispell Public Works Department have been included with the final plat application stating that the roads and other infrastructure have been constructed to City standards. Some remaining improvements related to sidewalks and landscaping have been included in the subdivision improvements agreement. Condition No. 3 A traffic analysis be conducted assessing the impacts to Willow Glen Drive from Leisure Drive as a result of the subdivision and mitigation measure identified and implemented in coordination with the Kalispell Public Works Department. • This condition has been met. A traffic analysis has been submitted with the final plat application that concludes all of the roads in the area will continue to function at a level of service B or higher and that no improvements would be needed. Condition. No. 4 That a letter be obtained from the Kalispell Parks and Recreation Department stating that the a landscape plan has been reviewed and approved for the placement of trees and landscaping materials within the five foot landscape boulevard developed between the curb and the sidewalk. • This condition has been met. A letter from the Kalispell Parks and Recreation Department has been submitted with the final plat application approving a landscape plan. The landscape materials have been included in the subdivision improvements agreement. Condition No. 5 That a cash in lieu payment equivalent to the cost of the landscaping be placed in a fund to provide a contribution for a match for a bike and pedestrian trail along Willow Glen Drive at the City's discretion or a minimum 20-foot wide landscape buffer be developed between the subdivision and Willow Glen Drive to provide screening and buffering in accordance with a plan approved by the Kalispell Parks and Recreation Director. • This condition will be addressed during Phase 2 of the development. The City has been working with property owners along Willow Glen Drive and the County to Final Plat --- Leisure Heights Phase 1 October 27, 2004 Page 3 facilitate the construction of a bike and pedestrian path within the proposed landscape casement area. The cash in lieu of landscaping would be used as a partial match for federal monies used for this trail. Condition No. 6 That a ten foot right-of-way reservation be designated along Willow Glen Drive within the 20 foot landscape buffer that could be acquired for the future upgrade of the roadway. • This condition has been. met. The right of way reservation has been noted on the face of the final plat. Condition No. 7 That the developer obtain a letter from the Flathead County Road Department and the Montana Department of Transportation approving the improvements to the intersection of Leisure Drive and Willow Glen. Drive certifying that any necessary improvements have been made. • This condition has been. met. An approach permit was issued by the Montana Department of Transportation approving the approach an improvement. Most of those improvements will take place during the completion of Phase 2. Condition No. 8 The road within the subdivision shall be named and signed in accordance with the policies of the Kalispell Public Works Department and the Uniform Traffic Control Devices Manual and be subject to review and approval of the Kalispell Fire Department. This condition has been adequately addressed. The road signs are included in the subdivision improvements agreement. Condition No. 9 The developer shall provide a letter from the U.S. Postal Service approving the plan for mail service. • This condition has been met. A letter from the USPS approving a mailbox location has been submitted with the final plat application. Condition No. 10 Street lighting shall be located within the subdivision and shall be shielded so that it does not intrude unnecessarily onto adjoining properties. • This condition has been adequately addressed. Street lighting has been included in the subdivision improvements agreement. Condition No. 11 That the parkland dedication requirements shall be met by designating the homeowners park area on the plat and that improvements be made to provide access to that area and recreation amenities such as play equipment and / or picnic tables. • This condition has been adequately addressed or otherwise met. The homeowners park area has been platted with this phase of the subdivision. improvements to Final Plat — Leisure Heights Phase I October 27, 2004 Page 4 the park area will need to be made as part of the development of Phase 2 or bonded for as part of Phase 2. Condition No. 12 All utilities shall be installed underground. • This condition has been met. Utilities have been installed underground as certified by the engineer and verified by an on -site staff inspection. Condition No. 13 That the fire access and suppression system comply with the Uniform Fire Code and a letter from the Kalispell Fire Department approving the access and number and placement of fire hydrants within the subdivision as well as fire flows and access shall be submitted with the final plat. The fire access and suppression system shall be installed and approved by the fire department prior to final plat approval. • This condition has been met. A letter from. the Kalispell Fire Department approving the fire flows, hydrant locations and access was submitted with the final plat application. Condition No. 14 That a minimum of two-thirds of the necessary infrastructure for each phase for this subdivision shall be completed prior to final plat submittal. • This condition has been met. Most of the infrastructure for Phase 1 has been completed with the exception of sidewalks and landscaping which have been made part of a subdivision improvements agreement. Condition No. 15 All areas disturbed during development of the subdivision shall be re -vegetated with a weed -free mix immediately after development. • This condition has been adequately addressed. Seeding has been included in the subdivision improvements agreement. Condition No. 16 That preliminary plat approval shall be valid for a period of three years from the date of approval with an automatic three-year extension as each phase of the subdivision plat has been completed and filed. • This condition has been. met. The plat for this phase was submitted prior to expiration of the preliminary plat. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in compliance with the preliminary plat which was submitted and approved. Final Plat — Leisure Heights Phase 1 October 27, 2004 Page 5 COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision complies with the Kalispell Zoning Ordinance and the R-2 zoning. RECOMMENDATION: All of the conditions of preliminary plat approval have been adequately addressed. The staff recommends that the Kalispell City Council approve the final plat for this subdivision. Please note that the Subdivision Improvements Agreement should be accepted along with the final plat approval. The plans and specifications are hereby approved. One set of plans and specifications bearing the approval stamp of the Department of Environmental Quality is enclosed. Approval is based on plans and specifications received October 24, 2003 under the seal of: John P. Schwarz, P.E. # 11258PE. Approval is also given with the understanding that any deviation from the approved plans and specifications will be submitted to the Department for reappraisal and approval. As I understand it, the subdivision will have 67 lots, with I 1 of those lots bordering Secondary 317. We are requesting that the developer build the homes leaving a buffer between the current R/W and the new horses that border S--317. This will make the necessary R/W acquisition for future projects in the area less impactive to the adjacent landowners. MDT's current standard is to acquire a minimum of 65, or 10' beyond the construction limits on either side of centerline for a collector road. The developer should not only consider the 65' distance from centerline to the future R/W, but a buffer between the future R/W and the homes. This will again reduce the impact to homeowner if the homes are far enough away from the future R/W. Currently, the county has made this section of roadway their next priority for secondary work in Flathead County. The project has not been programmed, and has to go through the Secondary Roads Committee for approval before it is programmed. Right now, reconstruction of this road would likely happen eight to ten years from now. It will make it easier on everyone if there is room for expansion. Leisure Heights is a 67 lot, single-family residential subdivision. In Recommendation 3, staff requests that "a traffic study analysis be conducted assessing the impacts to Willow Glen Drive as a result of the subdivision..." Schwarz Architecture & Engineering, Inc. has conducted traffic studies of the Leisure Drive and Willow Gen, and the Kelly Road and Willow Glen intersections to evaluate the effects of the subdivision on the road system. The traffic movement counts used in the studies were collected on January 29, 2003. The counts were taken with the Manual Counting method between the hours of 7 am and 7 pm. Manual counting was used because it allows for accurate grouping of classes of vehicles, and type of turning movements. The recorded data and the results of the subsequent analysis are outlined in the following report. EXISTING CONDITIONS A traffic system can be broken up into three primary components. These components are Arterials, Collectors, and Local Roads. An arterial's primary purpose is to conduct traffic from one point to another with freedom of mobility as the highest priority service. Providing local access and access to abutting properties is the lowest priority service for an arterial. Collectors are designed to provide both fond access and the freedom of movement as equal priorities. Currently, Willow Glen Drive is a paved road with 1 1-foot lanes and 1.5-foot shoulders. The posted speed limit is 35 MPH and there are no passing zones provided. Willow Glen has approximately 35 access points per mile. Many of these access points are driveways that serve single-family homes. The road is generally level with a few rolling hills. A picture of the subject portion of Willow Glen is provided in Figure 2. Figure 2 - Willow Glen Drive as Viewed from the Intersection with Kelly Road In conducting our analysis of the impacts on the traffic system, we focused on the function of the two -access points or intersections along Willow Glen that will be affected by the proposed development. These two intersections are Willow Glen with Leisure Drive, and Willow Glen and Kelly Road. The intersection at Kelly Road is a 4-leg intersection with two stop signs placed along the Kelly Road approaches. The Kelly Road approach from the west has two 12-foot asphalt travel lanes with no shoulders or curb. The approach from the east has two 15-foot asphalt travel lanes with curb. The approach from the east has a moderate grade. Willow Glen has the geometry noted above. Figure 3 indicates the intersection geometry as viewed from the Willows subdivision looking west. The Leisure Drive intersection is a T intersection with a single approach from the east. This approach has two t 2-toot asphalt lanes with no shoulder or curb. Figure 5 provides an overall aerial view of the subject area. Please note that the photo was taken in 1990 and may not include the most recent improvements to the subject area. Schwarz Architecture & Engineering, Inc. conducted 12-hour manual traffic counts of both Willow Glen's intersection with Leisure Drive and Kelly Road. The total number of turning and through movements at the Kelly Road intersection was 422 for the peak hour which occurred between 7:45 and 8:45 am and 3,153 for the entire day. The peak hour number for Leisure Drive, which also occurred between 7:45 and 8:45 am, was 391 with a total turning movement count for the day of 2,822. The peak Dour turning movement counts can be reviewed in Appendix A. The overall totals for the day are commensurate with numbers collected in a 12-hour period by the Montana Department of Transportation (MDOT) along Willow Glen. The MDOT numbers indicate a total vehicle count of 2,797 vehicles for the same 12-hour period on .Tune &h, 2001. These counts can be reviewed in Appendix B. Figure 6 outlines the total turning movement counts for both intersections throughout the day. Level of Service is a qualitative measure based on specific service measures such as speed of travel and freedom of movement. There exist six possible LOS; A through F. The American Association of State Highway and Transportation Officials (AASHTO) suggests that for arterials and their auxiliary facilities, a LOS of B be used in design except in mountainous regions where C is acceptable, As the density of the surrounding population increases, the LOS recommended may drop to level D. Currently, the intersections are functioning within the recommended design parameter as defined by AASHTO. TRIP GENERATION AND TRAFFIC DISTRIBUTION MODEL In order to estimate the number of trips produced by the subdivision, we used the 6r" Edition of the dip Generation Manual published by the Institute of Transportation Engineers. This manual has compiled data starting in the 1960's and proceeding through the 1990's from the U.S. and Canada on types of land use and the numbers of trips they generate at specific times. For our analysis we used Land Use Category 210, Single Family Detached Housing. This group includes single-family detached house on individual lots. The data is compiled from a wide variety of units varying in price, size, location, and age. Using the equations provided, we calculated at 100% build out, the 7'rafflc Study, Wind River Development 3/3/2003 Leisure Drive, Kalispell, hlantana Page 5 of 6 subdivision would produce an additiohal 717,average vehicle trips on a weekday with 54 of those occurring `d-ofing the morning peak hours and 76 occurring during the evening peak hours. These calculations have been provided in Appendix D. After generating the number of trips created by the proposed improvements, the additional trips were distributed between the two intersections. The distribution was based on subdivision layout and proximity to each intersection. Using those criteria, 64% (38 trips during am peak) of the additional trips were allotted to Leisure Drive, and 36% (21 trips during am peak) to Kelly Road. All additional trips were assumed to be leaving the subdivision. This places all the load on one leg of the intersection, providing for a conservative analysis. The trips were then broken down by the percentage of vehicles making that turning movement at the corresponding am peak hour. For example, during the am peak at Kelly Road two vehicles made a left hand turn leaving the Willows Subdivision. During that some time period, a total of 27 vehicles passed through that leg of the intersection leaving the subdivision. The turning count numbers with the proposed improvements can be viewed in Appendix E. After calculating and distributing the additional trips created by the proposed project, we again analyzed the two intersections directly affected by the subdivision by the methodology outlined in the HCM2000. This analysis revealed that both intersections still functioned at a Level of Surface B or higher. See Appendix F for calculations and results. CONCLUSION The American Association of State and Transportation Officials has recommended that the component facilities of arterials function at a LOS of B or higher except in mountainous regions where C is acceptable. As the intersections are currently functioning at or above the recommended LOS and the proposed development will not alter that fact, we do not recommend any improvements to the intersections at this time.
