Resolution 5325 - Preliminary Plat Extension - Spring Prairie Phase 3RESOLUTION NO.5325 A RESOLUTION APPROVING A ONE YEAR EXTENSION TO THE PRELIMINARY PLAT OF SPRING PRAIRIE PHASE 3, LOCATED ON THE WEST SIDE OF HIGHWAY 93 BETWEEN RESERVE LOOP AND WEST RESERVE DRIVE. WHEREAS, the City Council of the City of Kalispell granted final plat approval for Spring Prairie Center, Phase 1 on October 16, 2006 and Phase 2 on November 6, 2006, and WHEREAS, developer Goldberg Properties, Inc. now desires a one-year extension to the preliminary plat for Phase 3 in order to work with several potential partners to solidify financing for the final phase, and WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and Platting Act allows the City Council to grant a one-year extension to the preliminary plat in addition to the original three year approval; and WHEREAS, good cause exists for the request for extension by Goldberg Properties Inc. and it is in the best interests of the City that the extension be given. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. That the application of Goldberg Properties, Inc. for a one-year extension of the preliminary plat of Spring Prairie Phase 3, Kalispell, Flathead County, Montana is hereby approved.
