ORDINANCE NO. 625
AN ORDINANCE PROHIBITING THE ABANDONMENT OR PLACING OF ICE BOXES,
REFRIGERATORS AND SIMILAR CONTAINERS OUTSIDE OF BUILDINGS ACCESSIBLE TO
CHILDREN, WITH CERTAIN EXCEPTIONS: MAKING A VIOLATION OF THIS ORDINANCE
A NUISANCE: PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE AND PENALTIES
FOR THE VIOLATION THEREOF, INCLUDING THE ABATEMENT OF SUCH NUISANCE:
DECLARING AN EMERGENCY: AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES
IN CONFLICT HEREWITH.
WHEREAS, it appears that many children through the United States
have suffocated to death by reason of having been trapped inside abandoned
refrigerators or the like, and that in order to promote the safety and
welfare of the people of Kalispell, it is necessary to prohibit the leaving
of such containers in places accessible to children under certain circum-
stances, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, STATE
OF MONTANA:
Section 1. Abandonment of ice boxes unlawful where. It shall be
unlawful for any person, rm or corporation to leave or abandon outside
of any building or dwelling, or inside any unlocked and unoccupied
building, in a place accessible to children, any unattended ice box,
refrigerator or any other container of any kind large enough for a child
to get in, which is substantially air -tight and which has a door that
automatically locks when closed so that it. cannot be opened by anyone
inside such ice box, refrigerator or container; provided, however, that
this ordinance does not apply to any such box the door of which is
securely locked by padlock or the like from the outside so that the door
cannot be opened by children.
Section 2. Violation constitutes a nuisance and misdemeanor;
abatement and enalties. Any violation of is ordinance shall constitute

the City of Kalispell of 1947, as the same exist or may be amended, and
any person, firm or corporation violating this ordinance shall be guilty
of a misdemeanor, punishable as such.
Section 3. Enforcement. It shall be the duty of the Chief of
Police to inspect the city at reasonable inyervals in order to discover
possible violations, and to initiate appropriate prosecutions of offenders
hereunder.
Section 4. Repealing Conflicting Ordinances. All ordinances and
parts of ordinances in conflict herewith are hereby repealed.
Section 5. Declaring Emergency. An emergency is hereby declared
to and does exist and this ordinance shall be in full force and effect
from and after its passage and approval.
PASSED by the City Council of the City of Kalispell, Montana,
this 7th day of December, 1953, and APPROVED by the Mayor of said City
this 7th day of December, 1953.
