REPORT TO: Honorable Mayor and City Council

SUBJECT: Ashley Park Subdivision Sidewalks
MEETING DATE: September 19, 2005
BACKGROUND: - At the last Council workshop, this item was discussed. Staff was dire ted
to develop proposed motions for Council to consider. Two motions were included in Counci
packets for your consideration this evening. I was asked- to propose a third motion for your
consideration that only addresses a warranty on the sidewalks for a period of ten years.
Alternative Motion III. I move that the City Council find, based upon the evidence presented,
that
a. the sidewalks constructed at Ashley Park, Phase 7, fail to meet the design and
construction standards of the City of Kalispell, and that,
b. there is some value in the sidewalks that are in place, and that,
C. the developer will warranty the sidewalks for a period of ten years against
material and structural defect.
d. The Public Works Department shall have sole discretion as to the removal and
replacement of failed panel(s) of sidewalk, and
e. photographic evidence of the cracked sidewalk section shall be taken by the
Public Works Department prior to the replacement of the sidewalk panel, and
f. adjacent sidewalk panels cracked -during the replacement shall also be replaced
under this agreement.
RECOMMENDATION: That Council consider the three alternative motions provided by staff
and to make and deliberate on such motion as it deems appropriate.
ALTERNATIVES: As suggested by the City Council.
