Kluesner Conflict of Interest Statement for County 2018STANDARDS OF CONDUCT (Conflict of Interest) The Flathead County Policies and Procedures Manual states that Flathead County cannot do business with or contract with any business in which you have an interest. In addition, an employee who leaves the County may not do business with the County for six months following his termination, even as an employee of any entity who contracts with the County for anything the employee was involved with at the County. State Statute 2-2-201 and Montana Code Annotated 2-2-102, upon which this policy was formed, are stated below. If a department unknowingly does business with an employee -connected business, the claim will be rejected and payment denied. It is the responsibility of the employee to read the paragraphs below and notify Finance of any business with which he has a private interest as described. (1) Members of the legislature; state, county, city, town, or township officers; or any deputy or employee, of an enumerated governmental entity may not be interested in any contract made by them in their official capacity or by any body, agency, or board of which they are members or employees. A former employee may not, within 5 months following the termination of employment, contract or be employed by an employer who contracts with the state or any of its subdivisions involving matters with which the former employee was directly involved during employment. MONTANA CODE ANNOTATED -- 2-2-102 "Private interest" means an interest held by an individual that is: (a) an ownership interest in a business; (b) a creditor interest in an insolvent business; (c) an employment or prospective employment for which negotiations have begun; (d) an ownership interest in real property; (e) a loan or other debtor interest; or (f) a directorship or officership in a business.
