(SEAL) City Clerk ORDINANCE NO.1804 ORDINANCE RELATING TO THE MODIFICATION OF THE WEST SIDE URBAN RENEWAL PLAN TO INCORPORATE THE CORE AREA PLAN AND TO APPROVE A PROJECT AS AN URBAN RENEWAL PROJECT. WHEREAS, pursuant to the Act and Ordinance No. 1259 adopted by the City Council (the "Council") of the City of Kalispell, Montana (the "City") on March 17, 1997, as amended by Ordinance Nos. 1347 and 1704, adopted by the Council February 7, 2000 and November 21, 2011, respectively (as so amended, the "Ordinance"), the Council created the West Side Urban Renewal District (the "District") and approved the West Side Urban Renewal Plan (the "Plan") containing a tax increment financing provision; and WHEREAS, the City's planning staff studied the City's "Core Area," identified as the area affected by the railroad tracks traversing central Kalispell from east to west and which includes approximately 364 acres along the rail corridor within City limits, which is within the boundaries of the District; and WHEREAS, the City's planning staff and Planning Board evaluated the resulting Core Area study and determined that it would be appropriate to amend the City's growth policy to incorporate the Kalispell Core Area Plan (the "Core Area Plan"), a copy of which is attached as Exhibit A hereto; and WHEREAS, by Resolution No. 5601A adopted by the Council on December 17, 2012, following a duly noticed and held public hearing, the Council amended the Kalispell Growth Policy 2020 to incorporate the Core Area Plan; and WHEREAS, the Core Area Plan sets forth redevelopment goals and priorities for the Core Area, including, as primary goals, the relocation of the railroad tracks from the Core Area and the creation of a green belt extending from Woodland Park to Meridian Road, providing pedestrian and bike access and greenery through the Core Area; and WHEREAS, the Core Area Plan recognizes that relocation of the railroad tracks from the Core Area will require creation of a new rail terminus and rail -served industrial site (the "Rail Park") and relocating the existing rail -dependent businesses in the Core Area to the Rail Park; and WHEREAS, by Resolution No. 5605, adopted by the Council on February 4, 2013, the Council determined that the Core Area Plan should be incorporated into the Plan; and WHEREAS, the City has been working with the Flathead County Economic Development Authority ("FCEDA") to undertake the Core Area and Rail Park redevelopment, and the City and FCEDA have received a federal TIGER grant in the amount of $10,000,000 to help pay the costs of such redevelopment; and WHEREAS, in connection with the Core Area and Rail Park redevelopment, and pursuant to the Core Area Plan, the City proposes to undertake (1) the relocation of rail - dependent occupants from the Core Area to the Rail Park, which requires the design, 2 engineering, construction and installation of certain public improvements to the Rail Park to allow for such relocation; (2) removal of the railroad tracks from the Core Area and the design, engineering, construction and installation of a linear public park in the Core Area on the land previously occupied by the railroad tracks; and (3) related improvements (collectively, the "Project"); and WHEREAS, the Plan provides that the Council may amend the Plan by enacting an ordinance providing for and setting forth the modification and amendment, after a public hearing, following notice of the public hearing being published in the official newspaper once a week for two consecutive weeks preceding the hearing; and WHEREAS, by Resolution No. 5853, adopted by the Council on February 5, 2018, the Council set forth its intention to modify the Plan to incorporate the Core Area Plan and to approve the Project as an urban renewal project under the Plan, made certain preliminary findings related thereto, and called a public hearing thereon; and WHEREAS, a duly called and noticed public hearing on the proposed modifications to the Plan was held on February 20, 2018, and all persons attending were given the opportunity to speak. NOW, THEREFORE, BE IT ORDAINED by the Council of the City as follows: Section 1. Findings. The Council hereby finds as follows: (a) No persons will be displaced from their housing by the Project; (b) The Plan, as modified to include the Core Area Plan, conforms to the City's growth policy; (c) The Plan, as modified to include the Core Area Plan, will afford maximum opportunity, consistent with the needs of the City as a whole, for the rehabilitation or redevelopment in the District by private enterprise; and (d) Sound and adequate financial programs will exist for the Project using tax increment of the District, contributions from FCEDA and funds from the TIGER grant; and (e) the Project constitutes an urban renewal project within the meaning of the Act and the Plan, as modified to include the Core Area Plan. Section 2. Amendment of Plan. The Council confirms the findings in Resolution Nos. 5605 and 5853 and hereby amends the Plan to incorporate the Core Area Plan into the Plan, and designates the Project as an urban renewal project within, and under, and to be undertaken pursuant to the Plan. Except as specifically amended by this ordinance, the provisions of the Ordinance and the Plan are hereby confirmed and remain in full force and effect. All actions of the Council heretofore taken with respect to the Project, to the extent not inconsistent herewith, are hereby ratified and confirmed. 3 Section 3. Use of Tax Increment with Respect to The Project. Pursuant to Section 7-15- 4288 of the Act, costs eligible to be paid from tax increment financing include acquisition, construction and improvement of public improvements or infrastructure, including acquisition and improvement of land to be designated as public park or open -space land, and costs incurred in relocation of occupants. The City will use tax increment revenues and tax increment financing to pay eligible costs of the Project, in accordance with Section 7-15-4288 of the Act. The costs incurred in relocation of current occupants of the District include costs of certain improvements in the Rail Park, including without limitation, costs of making rail -served properties available to certain of the current occupants of the District, recognizing that without such amenities, achieving the governmental purpose of relocating certain current occupants out of the District to the Rail Park would not be feasible. Costs of the Project in excess of the proceeds of tax increment bonds and tax increment funds the City has on hand and available therefor will be paid from contributions from FCEDA and TIGER grant funds. Section 4. Modification of Project. The Project herein designated and approved may be modified by the Council if the Council determines by resolution that an adjustment to the Project is required and in the best interest of the City. Section 5. Effect. This Ordinance shall take effect from and after 30 days of its passage by the Council and approval by the Mayor.
