AN ORDINANCE TO AMEND SECTION 2.02 OF THE CITY OF KALISPELL'S ZONING
ORDINANCE, ORDINANCE NO. 885, AS AMENDED BY ORDINANCE NO. 981, BY
COMBINING THE FUNCTION AND MEMBERSHIP OF THE CITY OF KALISPELL ZONING
COMMISSION AND THE KALISPELL CITY -COUNTY PLANNING BOARD, AND TO
PROVIDE AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
SECTION I. That Section 2.02 of the City of Kalispell's Zoning Ordinance,
Ordinance No. 885, as amended by Ordinance No. 981, is hereby amended
to read as follows:
Section 2.02
A) The Kalispell Zoning Commission is hereby established
and the same shall consist of nine (9) members, four of
whom shall be the City appointed members of the Kalispell
City -County Planning Board duly appointed and serving in
that capacity, four of who shall be Flathead County appointees
of the Kalispell City -County Planning Board duly appointed
and serving in that capacity, and a ninth member who shall
be elected by said City and County appointees and approved
by both the Flathead Board of County Commissioners and
City Council of the City of Kalispell.
B) Any City appointed member of the Zoning Commission
may be removed for cause by the Mayor subject to the
approval of the City Council upon written charges made and
served and after a public hearing thereon.
C) A vacancy in said Kalispell Zoning Commission created
by the death, resignation, or removal of City appointee shall
be filled by similar appointment for the unexpired portion of
the term of such retiring member.
D) Any vacancy in said Kalispell Zoning Commission created
by the death, resignation or removal of the elected member
shall be filled in the same manner as specified in paragraph
(A) , supra.
E) The Kalispell Zoning Commission shall adopt rules for
the orderly and reasonable calling and conduct of its meetings
and affairs. All members shall have a vote on all issues.
All members of the Kalispell Zoning Commission shall serve
without compensation.
SECTION II. The balance of the City of Kalispell's Zoning Ordinance,
Ordinance No. 885, as amended by Ordinance No. 981, not amended
hereby shall remain in full force and effect.
SECTION III. This Ordinance shall be effective thirty (30) days from
and after its final passage by the City Council and approval by the
Mayor.
