SUBJECT: Request for Sewer Treatment from Property Owners Outside of Agreement Service Area
MEETING DATE: February 12, 2018
BACKGROUND: The City of Kalispell entered into a Sanitary Sewer Treatment Agreement with
Flathead County Water and Sewer District No. 1 Evergreen on July 2015 with a subsequent
amendment in August of 2016. The Agreement delineated the provision of service and
responsibilities of Kalispell and Evergreen with respect to Municipal wastewater services.
A Service Area was defined within the Agreement obligating the City to accept normal municipal
sewage from the District as shown in the defined area. The volume rate from the District
associated with the defined area shall not exceed 782,000 gpd, and consent is required by City
Council, or designee, prior to connection to the District for owners of property outside of the
defined Service Area. Kalispell may decline the application for service outside of the Service Area
for any reason. The Service Area Boundary is delineated on the map in Exhibit A.
The Kalispell's treatment plant is designed to treat 5.4 million gallons per day (MGD) of
wastewater and is currently treating on average 2.8 MGD. Currently, Evergreen's average daily
flows are around 437,282 gpd. Information regarding Evergreen growth projections and system
limitations are provided in Exhibit B.
OPTIONS: Council has several options in consideration of the request for sewer treatment service
outside of the defined Service Area.
Option 11: Approve the request to provide sewer treatment service for a property, per the current
Agreement. The sewer flows associated with said property would not be considered part of the
Evergreen District not to exceed volume rate (782,000 gpd) average daily flows. The property
owner would be required to waive the right to protest annexation, provide consent to withdraw
from the rural fire district, enter into a development and or pretreatment agreement with the City of
Kalispell, meet pretreatment regulations, and pay the treatment plant impact fee.
Option 22: Collaborate with Evergreen District and change the Service Area boundary in the
Agreement to include a property. Both the City Council and the District Board Members would
have to agree to adopt an amendment of the Sanitary Sewer Treatment Agreement. The flows
generated from the property would be included as part of the not to exceed volume rate of 782,000
gpd.
Option 33: Deny the request to provide sewer treatment service to a property, per the current
agreement.
REQUEST: Three property owners are requesting consent from the City of Kalispell for sewer
treatment services via conveyance through the Evergreen District sewer system. These properties
are depicted on the map figure in Exhibit A. The property descriptions and information are as
follows:
1. Sandmussen LLC owns two parcels in Evergreen, tract 1 IAE in Section 4 (Assessor Number
076450) and Tract 14A in Section 5 (Assessor Number 0974029). The properties are bound
to the west by the railroad, to the south by the Whitefish River and to the east by River Road.
The east property boundary which is adjacent to River Road borders the Agreement Service
Area. The parcels together total 20.3 acres of vacant land. This request for treatment service
was prompted to promote the sale and development of the property. Sandmussen LLC's
request for service letter and supporting documentation are provided in Exhibit C.
2. William Lincoln owns one parcel in Evergreen, tract 6 (Assessor Number 0802675). The
property is bound to the west by the Stillwater River, to the South and West by Conrad
Drive, and to the north by Ainley Ln. The north property boundary along Ainley Ln. borders
the Agreement Service Area. The parcel is 46.4 acres of vacant land. This request for
treatment service was prompted to promote the sale and development of the property. Mr.
Lincoln's request for service letter and supporting documentation are provided in Exhibit C.
3. Ronald and Lana Ferron own one parcel west of Kalispell at 231 W. Reserve (Assessor
Number 0943305). The parcel is 12.5 acres and has one dwelling unit with a shop. The
property is triangular in shape, bound to the north by the Whitefish River and to the south by
West Reserve Drive. The Whitefish River separates the property from the Agreement Service
Area. This request for treatment service was prompted to promote the sale and development
of the property.
Upon review with Council at the work session, Staff will move forward with the tasks associated
with the recommend option or any alternatives per Council's direction.

Exhibit B: Evergreen Population, Growth Projects, Sewer System Limitations, Boundaries
Evergreen Water and Sewer District was formed in 1964 for the public water supply, and the
sewage collection was installed in the early 1990's. The Evergreen District is governed through
a Board and the District's boundary is subject to change based on Board's policy and ability to
"annex" properties into the District.
There are three boundaries associated with Evergreen Water and Sewer District in regard to
Kalispell and the Sanitary Sewer Treatment Agreement. The first is the Evergreen Water and
Sewer District boundary that was formed in 1964 for the public water supply. This boundary is
ever changing based on the Board's decision to "annex" area into the District. The second is the
RSID boundary, which was developed around 1990 as a means to fund the necessary
improvements to the sewer system and enable the District to collect and pump waste water to the
Kalispell Wastewater Treatment Plant. The District's sewer improvement project was funded
through an EPA grant and the RSID. The RSID boundary was formed by the District with
collaboration of property owners who agreed to be a part of the sewer improvement project. The
RSID bond was officially closed out in 2012. The third boundary is the Service Area as defined
in the Sanitary Sewer Treatment Agreement between Evergreen District and the City. The
original Agreement was created in 1990, and the Evergreen District Service Area created was
identical to the RSID boundary. The Service Area was updated and expanded as a part of the
2015 and 2016 Sanitary Sewer Treatment Agreement. Exhibit A provides a layout of each
boundary to date.
Evergreen Sewer District: Evergreen District's sewer collection system was designed for an
equivalent population of 6,473 which calculates to 433,700 gallons per day (gpd). Currently,
Evergreen's average daily flows are around 437,282 gpd.

1. Starting point for analysis is 2015 and is based upon average annual flow for calendar year 2015 at 399,225
gpd, 67 gpcd, 188 gpd/ERU and 2.0806 persons/ERU. (399,225/188 = 2,123.5 ERUs equivalent)

Sewer System Limitations: The following facts are referenced from the Sewage Treatment in the
2014 Flathead Basin Report by Carver Engineering. Additional information and limitation for
the Evergreen District are further described in the report.
• Additional future growth in Evergreen is possible on the remaining vacant property or on
currently underutilized parcels. The Evergreen sewer system was designed for an
equivalent population of 6,473 which projects for an average daily flow of 433,700
gallons per day. The main station has plenty of capacity to handle whatever growth might
reasonably occur within and arguably adjacent to the District, subject to the limits of the
existing collection system to get the wastewater to the station. In general, there is some
excess capacity in the collection system, but it's a case by case analysis for Evergreen.
• Evergreen sewage collection system has a total of 25 lifts stations. The Main Lift Station
for Evergreen is located south of Snappy Sport Center, and is the lift station that pumps
sewage though 5 miles of force main to the WWTP. The estimated ERUs limit is 3,640
for the Main Station, see table below.

• Additional improvements and upsizing would be required to be made to Evergreen
District's sewer system, especially near the boundary limits, to utilize the maximum
pumping capacity of the Main Station.

I'm making a request to have the city of Kalispell's approval for 231 W. Reserve be annexed into
the Evergreen Sewer and Water District. I have submitted a request to the District and they are
requesting first the city of Kalispell's approval then they will annex the property into the district.
The property is just to the north of the hill headed east on Reserve. It is very isolated and the
sewer district has within two hundred yards a sewer main. We are looking for approval due to
the fact that the property is listed and we have interested parties that want to develop the property
for an assisted living facility and they would like to have public sewer and water. The property
sits on 12.5 +/- acres and is located adjacent to the Whitefish river. Please call to discuss.

0974029, respectively.
The east boundary of this property fronts River Road. There is an existing 10-inch
diameter Evergreen Water & Sewer District septic tank effluent sewage collection
main located in the right-of-way of River Road.
The property is presently situated contiguous to but outside of the Evergreen
Sewer District as defined in Exhibit A of the 2015 Interlocal Agreement between
the City of Kalispell and the Evergreen Water & Sewer District.
We are formally requesting inclusion of our property in the Exhibit A Sewer District
and approval to connect residential development on this property to the existing
Evergreen sewer main in River Road.

Westside Interceptor Project Update and Discussion
February 12, 2018
BACKGROUND: The Westside Interceptor (WSI) project has been progressing on schedule for
construction to occur and be completed in 2018. This is a very large project for the City of
Kalispell and includes over 42,000 feet of new sewer main installation. As the project progresses
towards construction, we will be coordinating with the State Revolving Fund (SRF) for funding
of the project.
The purpose of the discussion at the Council Work Session is to provide an update on the project,
discuss a potential land trade for an easement, discuss upcoming items that will require council
action, and provide a general overview of the tentative upcoming schedule for completion of this
project.
