The incorporation involves the construction of a well facility and all the equipment required for the operation of a well facility. Section 36 Well and water rights were entrusted to the City, along with the dedication of a wellhead easement and protection zone, as part of the Timberwolf Center Phase I and I final plat. The well and easement are located within State School Trust Land (Section 36); allowing the State of Montana to subsequently grant Flathead County an easement for the 911 Center on the same land that occupies the City's Section 36 Well easement. Due to the "stacked" easement arrangement, the State of Montana requires an agreement between both parties acknowledging responsibilities associated with the improvements within the "stacked" easements. As such, each easement holder is required to sign and execute an Agreement to Mitigate Easement Improvement Damages. The Agreement to Mitigate Easement Improvement Damages for the Section 36 Well Facility was authored by the State and is attached for reference. The City's responsibilities outlined in the agreement have been reviewed by the City Attorney and will be incorporated into the design and construction of the Section 36 Well Facility. The agreement was brought forward to Flathead County and signed by the Commissioners at the January 91h meeting. ACTION REQUESTED: Motion to adopt the Agreement to Mitigate Easement Improvement Damages between Flathead County and the City of Kalispell and authorize the City Manager to sign the agreement on behalf of the City of Kalispell. ALTERNATIVES: As suggested and approved by the City Council. ATTACHMENTS: Agreement to Mitigate Easement Improvement Damages AGREEMENT TO MITIGATE EASEMENT IMPROVEMENT DAMAGES WHEREAS, the State of Montana dedicated to the City of Kalispell (hereinafter referred to as "City") a wellhead easement and wellhead protection zone with the filing of the final plat of the Timberwolf Center, Phase 1 A and 1 B; and WHEREAS, the State of Montana subsequently granted Easement No. D-13363 to Flathead County (hereinafter referred to as "County") for the purpose of a 911 Emergency Coordination Center upon Timberwolf Center, Phase 1 B; and WHEREAS, the County has provided landscaping improvements to their easement area which are encompassed within the dedicated wellhead easement and associated protection zone; and WHEREAS, for safety and other reasons the City is desirous of constructing a well house to protect the dedicated wellhead area. Construction of said well house will otherwise remove or alter the existing landscaping improvements provided by the County for the 911 Emergency Coordination Center located on Timberwolf Center, Phase 1B. NOW, THEREFORE, The City and County agree that the landscaping improvements of the County upon the 911 Emergency Coordination Center easement area will be removed. Mitigation by the City will include construction of the well house to state and local standards, using exterior materials consistent with the exterior of the 911 Emergency Coordination Center. The City additionally agrees to design landscaping and drainage to meet the current land uses the 911 Emergency Coordination Center utilizes. The County agrees to not construct any facilities or landscaping within the wellhead easement and protection zone area as shown on the plat for Timberwolf Center, Phase 1 B unless there is mutual agreement with the City for the same.
