Public Works Director Re: Permitting Bus Load Zone for Public Library Meeting Date: November 20, 2017 BACKGROUND: Eagle Transit is requesting the bus drop off/pick up zone for the ImagineIf library which is currently located on 3rd Street East be relocated to 1st Avenue East. The relocation of the bus zone creates a safer more efficient route for Eagle Transit customers and drivers. The current bus load zone on 3rd Street East will be converted to two 30-minute parking spaces in exchange for the two spaces being removed from the proposed bus load zone on 1st Avenue East. In order to make the proposed changes an ordinance amending Chapter 17 of the City Code entitling the creation of the bus load zone and 30 minute parking restriction for two spaces on 3rd Street East is required as follows: Chapter 17 Motor Vehicles and Traffic 17-54 Restricted or Prohibited Parking in Certain Areas. Except as otherwise provided in this section, it is unlawful for any person to stop, stand or park or permit to be parked any vehicles of any character on or in any of the following areas within the City: U. No motor vehicle shall be parked continuously at any one place for more than thirty (30) minutes between the hours of 8:00 a.m. and 6:00 p.m. at the following locations: 4. On the north side of Third Street East, in the first two parking stalls west of 1st Alley E. Z. Bus Loading Zones. Vehicular parking, other than for public transportation buses is prohibited in any parking space designated by signage for Bus Loading Only between the hours of 6am and 6pm Monday through Friday. ACTION REQUESTED: Motion to approve Ordinance 1799, an ordinance amending Chapter 17 of the Kalispell Municipal Codes entitled Motor Vehicles and Traffic. ALTERNATIVES: As suggested by City Council. ATTACHMENTS: Ordinance 1799 ORDINANCE NO. 1799 AN ORDINANCE AMENDING CHAPTER 17 OF THE KALISPELL MUNICIPAL CODES ENTITLED MOTOR VEHICLES AND TRAFFIC REGARDING PARKING IN BUS LOADING ZONES, DECLARING AN EFFECTIVE DATE AND AUTHORIZING THE CITY ATTORNEY TO CODIFY THE SAME. WHEREAS, pursuant to Kalispell Municipal Code Chapter 17, entitled Motor Vehicles and Traffic, the City of Kalispell regulates the use of motor vehicles for the purpose of providing for the safe and orderly use of such vehicles on the city right-of-ways and in city controlled public parking areas; and WHEREAS, it is in the best interests of the City and its residents and visitors that its ordinances which regulate motor vehicles and traffic be reassessed and updated from time to time to ensure that the purposes of the regulation and the interests of the public are being properly served; and WHEREAS, the Kalispell City Council finds that the amendments to KMC Chapter 17 set forth in Exhibit "A", attached hereto, are necessary and proper to align with changes to traffic development and uses within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. The City of Kalispell Municipal Code is hereby amended as set forth in Exhibit "A", attached hereto and incorporated fully herein by this reference. SECTION 2. The City Attorney is hereby authorized and directed to recodify this Ordinance. SECTION 3. This Ordinance shall take effect thirty (30) days after its final passage.
