Resolution 5841 — KGPA-17-02 — Resolution of intention to adopt,
adopt with revisions, or reject the DRAFT — The Downtown Plan

BACKGROUND: The Downtown Plan addresses a number of key topics that affect the future growth
and development of Downtown Kalispell. The plan includes a vision for Downtown Kalispell, key
issues and strategies, and implementation goals to make the vision a reality. At their work session on
October 9, 2017, the Council discussed the plan and directed staff to move the plan forward for their
consideration.
Procedurally, The Downtown Plan needs to be adopted as an amendment to the Kalispell Growth
Policy Plan — It 2035, as it would become a neighborhood plan. Section 76-1-604, M.C.A. requires
that the council adopt a resolution of intention to adopt, adopt with revisions or reject the proposed
plan and call for a public hearing. At the subsequent Kalispell City Council meeting on November
6`h, the Council will hold the public hearing and take public comment on the plan.
The Kalispell Planning Board held a duly noticed public hearing August 15, 2017, to consider The
Downtown Plan, which they had discussed at three (3) previous work sessions. Staff presented The
Downtown Plan, providing the history of the document and its contents. Staff noted that numerous
public comments had been received that should be considered, and recommended the Board open up
the public hearing for additional public comment. Two members of the public spoke in favor of the
plan; however, they had concerns about gaming and signage for the bypass. There being no further
public comment, the public hearing was closed and a motion was presented that recommended to the
Kalispell City Council that The Downtown Plan be adopted as an amendment to the Kalispell Growth
Policy Plan -It 2035, and authorize the Planning Board President to sign Resolution KGPA-17-02, a
resolution amending the Kalispell Growth Policy Plan — It 2035 by approving The Downtown Plan as
a neighborhood plan. The Board discussed the plan, at which point they voted to table the plan and
directed staff to address the public comment that had been received.
At the following meeting on September 12, 2017, a motion was unanimously approved to remove
The Downtown Plan from the table. Subsequently, staff presented the changes that had been made to
the document based on the public comment that had been received. Following the presentation, the
Board continued discussion of the plan, at which point they felt it was appropriate and the original
motion passed unanimously upon roll call vote.
RECOMMENDATION: It is recommended that the Kalispell City Council approve Resolution
5841, a resolution setting a public hearing date of November 6, 2017 for The Downtown Plan.
FISCAL EFFECTS: There are no anticipated fiscal impacts at this time.
ALTERNATIVES: Deny the request.

A RESOLUTION OF INTENTION TO ADOPT, REVISE OR REJECT A
RECOMMENDED AMENDMENT TO THE KALISPELL GROWTH POLICY PLAN IT
2035 TO AMEND THAT PORTION OF THE GROWTH POLICY THAT IS THE
KALISPELL DOWNTOWN PLAN CONCERNING REAL PROPERTY LOCATED IN
KALISPELL, FLATHEAD COUNTY, MONTANA AND TO CALL FOR A PUBLIC
HEARING.
WHEREAS, the Kalispell City Council first adopted a City growth policy on February 18, 2003
pursuant to the requirements of MCA 76-1-601; and
WHEREAS, on July 3, 2017, the Kalispell City Council passed Resolution No. 5821 amending its
growth policy with the Plan It 2035 Amendment determining that such amendment
was in the best interest of the City of Kalispell and the residents of the jurisdictional
area of the Kalispell Growth Policy; and
WHEREAS, the Plan It 2035 Amendment calls for development of a Downtown Plan as a key
project to have a tangible positive impact on the citizens of Kalispell; and
WHEREAS, the area to be included in the Downtown Plan is set forth in the map attached hereto
as Exhibit "A"; and
WHEREAS, a Downtown Plan has been developed through significant public outreach and
response from the Kalispell residents and stakeholders and is described and set forth
within Planning Board Resolution #KGPA-17-02; and
WHEREAS, on August 8, 2017, the Kalispell City Planning Board held a public hearing, after due
and proper notice, received written and oral public comment, and reviewed The
Downtown Plan, which evaluated the proposal based upon the goals and objectives
of the Growth Policy, the purpose of zoning and current circumstances in the
planning jurisdiction; and
WHEREAS, after due consideration of the proposed amendment, the Kalispell City Planning
Board adopted Resolution #KGPA-17-02 as the findings of fact and recommended
approval of the proposed Growth Policy amendment; and
WHEREAS, the City Council of the City of Kalispell considers it advisable that they consider the
proposed Growth Policy Amendment and the recommendations of the Kalispell City
Planning Board, and adopt a Resolution of Intention to Adopt, Revise or Reject a
Proposed Amendment to the Kalispell Growth Policy Plan It 2035.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION 1. That pursuant to Section 76-1-604, MCA, the City Council of the City of
Kalispell intends to consider a proposed amendment to the Kalispell Growth
Policy Plan It 2035, and a recommendation by the Kalispell City Planning
Board to grant said amendment, consisting of the adoption of the Downtown
Plan for an area of land as set forth in Exhibit "A", attached hereto and fully
included herein by reference, and located in the City of Kalispell, Flathead
County, Montana.
SECTION 2. The City Council will hold a public hearing on the proposed growth policy
amendment on November 6, 2017, at 7:00 p.m. in the City Hall Council
Chambers located at 201 First Avenue East, Kalispell.
SECTION 3. At the regular meeting of November 20, 2017, the City Council will consider
Resolutions to Adopt, Revise, or Reject said proposed amendment.
SECTION 4. The City Clerk is authorized and directed to give notice of said meeting in
accordance with Section 7-1-4127, MCA.

Notice is hereby given that the City Council of the City of Kalispell is considering an
amendment to the Kalispell Downtown Plan portion of the Plan It 2035 Growth Policy document for
the City of Kalispell.
The Kalispell City Planning Board has considered the amendment, held a public hearing on
August 8, 2017, adopted Resolution #KGPA-17-02 as the findings of fact and recommended
approval of the proposed Growth Policy amendment to the Kalispell City Council. The City Council,
on October 16, 2017, passed a Resolution of Intention to Adopt, Revise or Reject a Recommended
Amendment to the Plan It 2035 Growth Policy.
On November 6, 2017, at 7:00 pm in the City Hall Council Chambers, 201 First Avenue East,
Kalispell, the City Council of the City of Kalispell will hold a public hearing regarding the proposed
amendment. Council may consider Resolutions to Adopt, Revise, or Reject said amendment at the
