LEGAL DESCRIPTION OF PROPERTY:
See Exhibit "A," attached hereto and incorporated by reference
The Applicant has applied to the City of Kalispell for an administrative conditional use permit for
the operation of a dog day care in an existing building on the property. The permit is required due to
its location in the B-2 (General Business) zone. The matter was reviewed by the City of Kalispell
Zoning Administrator and the City of Kalispell Site Development Review Committee and, after duly
considering the application, grants the administrative conditional use permit subject to the following
conditions:
(1) The property shall be developed in accordance with the submitted plans.
(2) Per the application, no animals will be boarded overnight.
(3) Animal waste shall be removed from the site daily or as otherwise necessary to avoid the
spread of objectionable odors, insects, pests, and objectionable surface drainage. Odor
neutralizing treatment of the waste area shall be conducted as needed.
(4) Animals shall not be kept outside the building except within the designated fenced "dog
comfort station" for short periods of time as necessary per the submitted operational plan.
The fenced area shall be constructed of sound rated fencing material to reduce any noise.
(5) If it appears in the future that the operational plan relating to dogs being outside, removal
of waste, elimination of odors, or noise does not adequately mitigate such impacts on
surrounding properties, additional steps may be required to reduce the impacts to a
reasonable level as described in the submitted plans, including, but not limited to,
eliminating the fenced outdoor "dog comfort station."
(6) This permit shall be valid for a period of eighteen (18) months after which time it shall
terminate if commencement of the authorized activity has not begun.
