LEGAL DESCRIPTION: The North 100 feet of the East 142 feet of Lot 1, Block I Northeast
Addition in Section 8, Township 28 North, Range 21 West, P.M.M.,
Flathead County, Montana
ZONE: R-3, Urban Single Family Residential
The applicant has applied to the City of Kalispell for a conditional use permit to allow three
8' x 40' steel storage containers to be located west of an existing building. The building is used as a
community service center and is a non -conforming use in the R-3 zone. The containers would
replace existing storage areas, allow for more storage of donated items and free existing space within
the building.
The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on
September 11, 2007, held a public hearing on the application, took public comment and
recommended that the application be approved subject to eight conditions.
After reviewing the application, the record, the Kalispell Planning Department report, and
after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell
Zoning ordinance, hereby adopts Kalispell Planning Department Conditional Use Report #KCU-07-
5 as the Council's findings of fact, and issues and grants to the above -described real property a
conditional use permit to allow three 8' x 40' steel storage containers in the R-3, Urban Single
Family Residential zoning district subject to the following conditions:
1. That the proposal will be developed in substantial conformance with the approved site plan.
2. That the conditional use permit is valid for a period of 18 months from the date of
authorization.
3. The driveway and parking lot shall be paved within 6 months of installation of the storage
containers and in accordance with the approved site plan.
4. The existing 9' x l 2' storage shed as well as the existing storage along the north side of the
building shall be removed upon installation of the storage containers.
5. The storage containers shall be placed on permanent foundations. A foundation permit shall be
obtained from the Building Department prior to construction. The owner shall also provide the
Building Department the locking mechanisms for the storage containers for the Department's
review.
6. The storage containers shall meet the following location requirements and use restrictions:
* No shipping containers shall be closer than 20 feet to a building;.
• Shipping containers shall maintain a minimum distance of 10 feet from any property line.
■ Shipping containers shall be separated from each other by 10 feet.
The containers shall not contain any sources of ignition, including electricity.
• Storage inside the shipping containers shall be orderly and in accordance with the
International Fire Code, 2006 Edition.
* Any storage of flammable and combustible liquids inside the shipping containers shall be in
accordance with the International Fire Code, 2006 Edition.
7. Prior to issuance of a foundation permit from the Building Department the following shall
occur:
a. The containers shall be reviewed and approved by the Kalispell Architectural Review
Committee. As part of the application materials submitted to the committee the
applicant shall include a landscaping and/or fencing plan to screen the containers from
properties to the north and west.
b. A revised scaled site plan shall be submitted which shows the property boundaries and
the existing building, storage containers, parking lot layout and associated landscaping
for the parking lot. Storage container locations shall be 'n accordance with condition
number 6. The type and size at planting for the landscaping shall be shown on the plan.
A minimum of 12 parking spaces shall be provided on the site. The revised site plan
shall be reviewed and approved by the Planning Department, Parks and Recreation
Department and Fire Department.
8. The approved screening plan for the containers and the landscaping associated with the parking
lot shall be installed per the approved plan.
