Citizens for a Better Flathead is deeply concerned that the relationship between the rapid growth
occurring in Flathead County and the transportation infrastructure needed to sustain this growth
and keep our local economy thriving is breaking down. This problem is well documented in the
recently completed Kalispell Transportation Study. This study concludes that over $200 million
dollars are needed over the next twenty years to address Kalispell's growth and transportation
needs. These costs include $76 million for the Kalispell Bypass, $24 million for two additional
ramped interchanges to make this bypass function properly once built, continued investments of
federal dollars in the expansion of US Highways 93 and 2, and an estimated $112 million in other
needed transportation improvements in the Kalispell area to catch up with growth.
The study also makes clear that these costs far exceed the funds estimated to be available to
finance these improvements. At the same time, it points out that the completion of the Kalispell
Bypass is fundamental to the success of other improvements identified. The study then concludes
that many future projects will need to be financed by the private sector during the development
process to assist with the construction and expansion of the transportation infrastructure.
Given this background, the purpose of this letter is to further document for you our concerns over
the letter you issued November 28t', 2007, (attached). Your letter endorsing the Glacier Town
Center/ Mall developer's request for multiple -accesses with stoplights to US Hwy 93 north of
Kalispell is not in keeping with the findings of the new Kalispell Transportation Plan.
Furthermore, it is apparent, given MDT's failure to date to substantiate the position taken in this
letter, that it was a premature conclusion, not based in documented findings. As such, the decision
to approve this developer's request as set forth in this letter appears to be beyond your legal
authority, and in direct conflict with'hr DT policy and state and federal laws. (See attached
rationale.)

Most 'importantly MDT's decision encased in th-s`November 28'h letter,to allow a new series of
stoplights at the northern terminus of the -Kalispell Bypass, blocks the intended free -flow of traffic
from this bypass north to whitefish. By blocking. this free flow of traffic north, your decision
undermines the pledged $76 million federal dollar investment in the Kalispell Bypass. Afterall,
why build the bypass around downtown if you are just going to stop traffic again once it re-enters
US Hwy 93 north.?

Even your letter of November 28 acknowledges that MDT believes a junior interchange could
provide increased safety and mobility over stoplights. Your letter, however, concludes that you do
not believe that you have the authority to "require" the developer to install this interchange. Our
letter lays out why state and federal law (see attached rationale) do not allow you to simply
endorse this developer's request for new accesses to US Hwy 93. We also lay out a proposal for
an independent professional review to provide peer review of this access request with the goal of
finding a better solution for this and future development proposals in this corridor.
MDT's own regulations require that any modification to a controlled access resolution, as is in
place for US Hwy 93 from Kalispell north of Reserve Street to whitefish, be based on findings
considered and approved by the Montana Transportation Commission. In response to my phone
request on November 291h you acknowledged that you had no data available to Justify our

November 20' letter. In addition, you have failed to respond to subsequent
requests to provide me

any findings and supporting data upon which you based your letter. We are forced to conclude that
this information did not exist when you issued your letter on November 28th as is required by state
law MCA 2-4--103. A decision of this significance must now be subject to both the additional
review and consideration of alternatives under NEPA, the National Environmental Policy Act, and
MEPA, the Montana Environmental Policy Act before any recommendation is made to the
Transportation Commission.
Finally, we are deeply concerned regarding the timing of this letter. This coupled with the fact that
your letter was the product of a closed door, non-public meeting with the developer just the day
before the Planning Board public hearing on the Glacier Mall is suspicious. This timing prevented
reasonable public review and comment on this letter. It also allowed your letter to be used by the
developer at the public hearing to argue that the city had no authority to deny his proposed
transportation access plan for this mall despite its conflict with local planning documents and
grave concerns expressed by this board.
We urge you to withdraw your letter of November 2 $th and comply with MDT policy and state and
federal law in further consideration of this access request. We fully realize the political and
economic pressures that MDT and the City are under to reach a decision on this developer's
request for the largest commercial expansion in the County's history. Yet, if this commercial
expansion is warranted and viable then the public needs to be assured that the developer will
provide the extensive transportation infrastructure needed to make it a success without
undermining the public investment in the US Hwy 93 Bypass.
A city council member recently responded to the developer's traffic consultant's assertion that
MDT had given their mall project its "blessing." He pointed out that the MDT had also given its
blessing to highway accesses south of this project that have required subsequent and costly
modifications and still have left us with failing intersections and traffic gridlock. We can and must
do better.
The most constructive course of action at this point would be for the developer, the city, and the
MDT to place this development application on hold. Next MDT should immediately hire an
independent consultant with the expertise needed for a peer review of this transportation proposal
to help identify and understand potential effective solutions.

Rationale and Basis for Argument that the MDT Letter of November 281h is
Premature and Not Compliant with MIST Policy and State and Federal Law.
The intent and goals for the committed $76 million federal and state investment in
the Kalispell Bypass is not being upheld. If your decision stands, allowing this major
traffic increase from the Glacier Mali on to US Hwy 93 (rather than other local streets
that serve this property) through a series of stoplights, it will now prevent the intended
continued free flog of traffic north to Whitefish from this bypass. Furthermore, it will
establish some of the worse traffic gridlock in the state created by these new proposed
stoplights for the Glacier Mall to the north coupled with three intersections to the south
including the bypass terminus intersection of Reserve and US Hwy 93, all of which are
currently operating at a failing level of service of D or F at pear hours. It will also set a
problematic precedent for additional access requests in this Kalispell to Whitefish
coma. or.
The position taken by MDT in its November 28th letter endorsing signalized accesses
to US Hwy 93 is contradictory to the department's position that seven overpasses
were needed to conserve the capacity of the Kalispell Bypass and associated road
networl,cs. It is also contradictory of MDT's own extraordinary, and without
precedent, recent investment in a US Hwy 93 junior interchange just north of the
proposed .Glacier Mall to serve new development at the intersection of Church Drive
and US Hwy 93.
Analysis of the traffic impacts from the proposed Glacier Mall, a 485 acre largely
commercial project with some residential uses, were not part of the final 2006 EIS
for the Kalispell Bypass. These impacts and the proposed stoplights must now be
reviewed under NEPA for their effects on the bypass and on the capacity of US Hwy
93. This is particularly important given the fact that the three intersections to the south
including the bypass terminus intersection of Deserve and US Hwy 93 are currently at a
level of service D or F at peak hours.
MDOT regulations require that any modification to a controlled access resolution,
as is in place for US Hwy 93 from Kalispell north of Reserve Street to whitefish, is
based on findings considered and approved by the Montana Transportation
Commission. You have not only acknowledged that you had no data or findings
available in response to my phone request for it on 11 /29, but have repeatedly failed to
respond to subsequent requests to _provide me any findings and supporting data upon
which you based your letter to the Glacier Mall Developer. This information apparently
did not exist when you issued your letter on November 28th as is required by state law
MCA 2-4- 103. Your letter, absent these findings and review by the Transportation
Commission, exceeded your authority to issue a definitive position on the
transportation plan for the Glacier Mall.
The Glacier Mall Transportation Impact Study (TIS) provided by the developer was
based on false assumptions including assumptions that infrastructure improvements
to Reserve and whitefish Stage Road are already in place, yet no funding is expected
to be allocated for such improvements for many years. The public pointed this out and
your staff requested at the November 26h meeting with the developer that their
Transportation Impact Study be revised to reflect accurate assumptions. The developer
agreed at that meeting to provide these revisions later that day, yet your staff confirmed
on 112/08 that these revised figures or responses to Mike Tierney's letter of 11 /27/07
have never been provided. Thus MDT's 11/28/07 approving proposed accesses to US
Hwy 93 was based on an inaccurate TIS.
• MDOT regulations require that a decision of this significance should be subject to
additional review under NEPA, the National Environmental Policy Act, and MEPA,
the .Montana Environmental Policy Act before any recommendation is made. ARM
18.2.261.
• MDT's Montana Right of Way Manual, Chapter 8 on Access Management adopted
in March 2007. This MDT policy establishes that access to US Hwy 93, which is part of
the National Highway System, should be denied when accesses to other local roads is
available unless it is proven that there will be a` sigm*ficant benefit to the highway
network." Access to at least two other local roads is available and no data has been
provided to show any benefit from three main accesses on to US Hwy 93.
• The Kalispell Growth Policy, the Kalispell Subdivision Regulation, and the new
draft Kalispell Transportation Study. These planning documents provide findings that
call for the use of a Junior Interchange at the proposed mall location to provide. access to
.Hwy 93 so as to preserve its safety and capacity. MDT's access management policies
require the department to give local planning regulations due consideration.
MDT's TransPlan 212002 Update: Access -Management and Land Use Planning
Policy Paper and state law. This policy and state law (see below), including the afore
mentioned controlled access resolution passed by the Montana Highway Commission in
1989 for this highway corridor, empowers you and local governments with the- "authority
to require developers to mitigate transportation impacts" and to deny additional access,
despite your letter assertion that you have no such ability.
■ Local planning authority and State laws including MICA 61-8-331-332 , MCA 60-5-
10 1 -111 and. MCA 61-12-101 empower MDDT and local governments to adopt
regulations to regulate highway use to preserve safe movement of traffic. Your letter and
decision fails to honor and support local planning documents that seek to conserve
limited federal highway capacity and to ensure traffic safety.
• MDT's federally required `Five Percent Report" identified this highway corridor as
one of the top ten deadliest in the state. This finding emphasizes the need for greater
access control and review under NEPA. and MEPA of alternatives before any decision is
reached.
* MIST has the authority to eliminate at grade intersections on controlled -access
highways as provided for in MCA. 60-5-106. MCA 60-5-106 states that "Elimination of
grade crossings. (1) Each highway authority may provide for elimination of intersections
at grade of controlled -access highways or controlled --access facilities with existing
federal -aid and state highways, county roads, and city or town streets. Elimination shall
be accomplished at the boundary of the controlled -access right-of-way.
(2) After the establishment of any controlled -access highway or facility, no private or
public highway or street which is not a part of the highway or facility shall intersect it at
grade, except as may be provided in the resolution designating it a controlled -access
highway or facility. No street, road, highway, or other public or private way shall be
opened into or connected with any controlled -access highway or facility without the prior
consent and approval of the appropriate highway authority which adopted the controlled -
access resolution.
(3) The commission may, whenever it deter -mines that the public safety is not thereby
impaired, authorize the continued intersection at grade of lightly traveled farm entrances
and minor public roads as ways of access to controlled -access highways in sparsely
populated rural areas. The commission shall have sole jurisdiction to determine the
existence and location of any intersection with interstate highways, throughways, and
other federal -aid and state highways.
• The deeded easements recorded for the Glacier Mall property under the access
control resolution passed in 1989 are not adequate or consistent with the proposed
accesses for the Glacier Mall: These. existing easements are limited to 30-40 feet in
width and do not. allow four the proposed uses, necessary easements, or locations of these
uses in the Glacier Mall transportation plan.
The Glacier Mall developer does not even own the property for which he is
requesting his southern access. It is owned by another private land owner who has
not made application for this access. Access permits for city owned public roads must
be made by that local government body and these requests have not been made.
■ Allowing stoplights temporarily has not been documented as a sound alternative.
Secondary. access to the property exist that could be developed for initial access until
such time as construction of a junior interchange or similar solution. can be put in
place.
• Under SAFETEA-LU, new federal transportation. funding legislation, the statewide
plan should include measures to ensure the preservation and most efficient use of
the existing system. This has not been demonstrated for the Kalispell to whitefish �US
Hwy 93 corridor.
• According to the Federal Highway Administration, which bears ultimate
responsibility for decisions impacting national Highway System of which US Hwy 93
is a part, I`NEPA requires and FHWA is committed to the examination and
avoidance of potential impacts to the social and natural environment when
considering approval of proposed transportation projects. In addition to evaluating
the potential environmental effects, we must also take into account the transportation
needs of the public in reaching a decision that is in the best overall public interest. The
FHwA. NEPA project development process is an approach. to balanced transportation
decisionmaking that takes into account the potential impacts on the human and natural
environment and the public's need for safe and efficient transportation." The FHwA is
also committed to review and analysis of the potential cumulative environmental impacts
or effects (ecological, aesthetic, Historic, cultural, economic, social, or health) of its
projects and actions.

If it isn't bad enough that Kalispell is about to approve the BLIGHT known as Glacier
Mall/Town Center, which will give us the crush and stress of year-round Christmas
shopping, more accidents and pollution -- new you're "thinking" of putting multiple
stoplights on Hwy. 93. Has Kalispell completely lost its mind? WHY would anyone want to
intentionally create stop and go driving on a soon to be clogged roadway; more potential
accident locations, road rage, emergency calls; more pollution; and another congested,
unsightly, "Anywhere [SSA"
mistake?? Why would anyone want to encourage such nonsense by shopping there?
Has no one ever heard of an overpass, which avoids these problems? Has no one ever thought
to make Bucky Boy pay to solve 100% of the problems his greed -driven eyesore is about to
inflict on everyone in the Flathead Talley?

I am writing to express my interests of not supporting any new traffic lights between Whitefish and
Kalispell. We certainly don't need another mall and additional commercial build out in this corridor
of this scale. In this day and age of high gas prices and so many lives already lost in this corridor,
keep this highway safe and efficient to drive.
Please make my comments part of the public hearing record for both the Glacier Mall/Town Center
and the new Kalispell Transportation Plan.
9 Keep Kalispell to Whitefish Safe and Stoplight Free. Uphold current city and state policies for
limited access on US Hwy 93. Preserve Its safe and efficient operation and the special
character of our valley. Require interchanges and similar solutions for growing land use
demands and access in this corridor.
o Also, please put into place standards to ensure that new development moves forward

I have been following the Wolford Project since its inception and am amazed that they still want to invest here. I
can not believe that the people who want all individual property rights eradicated in favor of "committee rule"
continue to have a venue with you good people. Do you not understand that "fringe groups" with "fringe agendas"
just waste time and money for all involved? Have you not wasted enough of everyone's time and money? Please
let the Woldfords meet the criteria in place and get on with their project without holding them hostage any longer.
You have shamed the business community and made it clear that development is not welcome here until the
pound of flesh has been added to the fees to be levied. Be sure and implement an "impact fee" too, just in case

We are residents of Whitefish and we travel often to Kalispell on Route 93. During the past
years we all have noticed a large increase in traffic. Mr. Wolford is resisting the "Overpass
Interchange" plan simply because it would be costly for him. He i nores the safe factor of
Flathead residents who dai.ly travel this hi hwa .
It is important that this new development is done with the most intelligent design. we
encourage you to uphold current city and state policies for a limited access on Us Hwy 93.
Another very important concern is that this sensible transportation infrastructure be
constructed at the same time as the Glacier Mall center's construction. Not at a later date.
Please insist on proper overpass interchanges to insure the maximum safety for all citizens
who travel this highway.

Please make my comments part of the public hearing record for both the

Hwy 93 out of Kalispell is already becoming an extention of slow and go
traffic you'd expect to find in the middle of town. If there is to be a mall
north of Reserve (and I wish there wasn't), access to it should not be at
the expense of the clear corridor we have now.
I come from California, which I always say is a vision of everyone's future.
There are communities in California that are done well, and others that are
not done well. The difference is how far ahead the city planners were
looking, 2 years or 20 kind--of-thing.
I own a business here that employs quite a few people, all of us have young
families, and all of us live here because of the quality of life. I want my
investment in this valley to pay off. In other words, I want my investment
in my home, office buildings and communitity to grow because this is a
desireable place to live 20 years from now, vs. being second rate to some
other community that has planned better.

Greetings
I've lived inWhitefish since 1974. I used to drive to Kalispell for various reasons, but
now I avoid it as much as possible. This is because I do not feel safe. There are too
many cars traveling too fast. I don't have a magic answer. More stoplights means more
chaotic intersections, and more big rigs barely coming to a stop behind me.
I don't think more stoplights between Reserve and Hwy 40 is the answer.
I do think developments should have to look at traffic patterns FIRST when they are
planning.
I would use public transportation given the opportunity.

Dear Planners;
I see via the Daily Interlake that you're facing a dichotomy... one plan calls for a
high-speed, traffic light free, Hwy 93 between Whitefish and West Reserve, and the other
plan (for Glacier Mall) instead puts a series of stop lights along Hwy 19'3 to provide safe
access from the Mall to Hwy 93. If Hwy 93 is to be high --speed, multiple, traffic light -
controlled, accesses from Galcier Mall will prevent it.
"Frontage roads" that feed a freeway interchage are a safer solution, albeit at a higher
initial cast. But over the long term, and including as a cost the amount of fuel wasted
idling while waiting for traffic lights to change, the frontage road/interchange solution
is far more economical. rind it has the adva.ntrage of conserving an amount of fuel that
will otherwise be wasted sitting at idle..., waiting for a light to change.

It should be obvious to everyone now that the commercial expansion on the north side of Kalispell has
far outpaced our highway's ability to handle the NORMAL flow of automobile and truck traffic and is
causing a bottleneck as lengthy as all the stores that stretch alongside the roadway, plus an additional
and painful backup during high -volume times of day. Add to this a temporary lane closure due to repair
or a fender --bender and it is GRIDLOCK, pure and simple. The ongoing examples of widening
intersections, adding turnouts and fixing curbing AFTER the stores, which they intend to serve have
opened, have proven to be truly numbing experiences in more ways than one! The prospect of more, and
more massive, development in the works can only be viewed as too much too soon. Adequate planning
for CONTINUOUSLY GROWING traffic levels is crucial to make any further expansion acceptable.
Let there be no mistake, the actual trend and the announced plans are for CGNTTNUGUSLY
GROWING development and CONTINUOUSLY GROWING traffic levels. Stop and think about it.
A huge development the size of the Glacier Mall 0 Town Center requires some new thinking, new, at
least, to our concept of planned development as evidenced in the recent sprawl we are just beginning to
enjoy. We should treat it as a NEW TOWN and allow for a highway interchange to access it, in the
interest of both safety and convenience. History provides arnple evidence of the frequency and severity
of traffic accidents at high -volume intersections and turnouts that spring up along our speed -ways.
Consider 93 and West Reserve, the old Costco location. on Highway ?, and the Majestic valley Arena on
93 North during heavily -attended events. The logical course would be to strive to reduce such dangerous
situations by pursuing alternative solutions. The best solution by far is a highway interchange, which
would allow for safer frontage road access to the many elements of the NEW TOWN, and would avoid
creating the numerous high --risk intersections that a less -well -planned design would inevitably force
upon the highway. The convenience of frontage road access to business and residential areas at lower
speeds is obvious and a bonus to keeping the highway open to highway travel as it is intended.
Financing of such a promising and forward -looking solution to the problems of traffic congestion and
safety, problems which are after all a direct result of continuing development, can and should be
addressed with realistic approaches proven successful elsewhere. These should include developer impact
fees as well as bonding through creation of service improvement districts for this and similar
developments. An interchange is within our reach and should be the highest priority.
Most importantly, in order to proceed with planned development, we need planned transportation
solutions which require us to identify and consider different options, and we must do it before the
development is allowed to take place. We should look ahead far enough to ensure that our solutions will
continue to serve their intended purposes. The alternative is an inevitable "SlowWay 93".

I am writing to you in regards of the current development and proposed
development of future construct4ons between Whitefish and Kalispell. If we have
development we need restrictions on how they build, hopefully sustainable, using smart
growth and build up not out we need zoning. The growth that is happening in that area now
resembles a cancer cell and is devouring everything in sight. We don't need growth for
growth's sake, this is not true progress but disgusting and an eye sore. We need some

Surely, by now, with scores of poor planning examples in rapidly growing areas throughout

current city and state policies and establish appropriate ramp access.
If mail developers can't afford the cost of an appropriate access system, that indicates that this project is really not
viable at this time. Have no fear: This project and others like it are inevitable and it will be viable before long.
The money is there to make this happen, either now or in the near future. our focus must be to do it right so that
we don't regret decisions in the future.

route 93. l have seen the affects of poor planning over the years (1965-2007) and the congestion that it brings.
Kalispell reminds me of the city of Calgary. When coming into the city from the south, one hits stop light after stop
light. It takes for ever to get to the freeway that then allows one to move through the city. l
Please do not let the free flow of traffic become even worse by allowing developments along the 33 corridor.

Regarding the Glacier Mall proposal being considered by the Planning Board:
I already avoid the area north of Kalispell for both shopping and general travel, whereas I used to enjoy taking
drives up that way for the views. While the area is admittedly already ruined for anyone but the hard core
shopping fanatic, I still have concerns over filling hundreds of more acres with duplicative retail development.
1) Who is going to end up paying for additional services needed to accommodate this development? I have heard
that there is an issue with future sewage capacity related to the growth in the area --how is that being addressed?
2} Already impossibly slow north of town, what will traffic be like if this mall is built and how does that affect the
quality of life for commuters? My friend calls that stretch "Little Denver, " both for its appearance and the crawl of
cars encountered there.
3) Who do the stores that fill this mall imagine is going to work in their stores --and how will this enormous
mall impact existing stores' labor problems? It is a far different employment picture in Kalispell now than it was in
the days when Bucky Wolford first attempted to build his mall. Most existing retail/hospitality employers in the
area have been unable to adequately fill their positions (and retain employees) for 1 to 2 years now; we are going
to stretch the labor pool even thinner in a sector that is already hard to reliably staff. And for what? Kalispell
consumers already have the ability to buy most of the items that will be offered in mail stores, and just a few
blocks away! I think many of us out there feel strongly, "Enough is enough."

Regarding your upcoming hearing on the Glacier Mall, I would like to comment about the ever-growing
traffic problems in the Flathead Valley. I have been a resident of the Flathead since 1963 and miss the
days of easy navigation into Kalispell, where I used to do most of my shopping until traffic congestion
caused me to rethink my driving habits.
It's not unusual to sit through a red traffic light twice in Kalispell. I live between Coram and West
Glacier and I used to be able to drive virtually nonstop to Kalispell. Now there are stoplights and stop
signs in Hungry Horse, Columbia Heights, Woody's and many more through Evergreen. North of
Kalispell is even worse, so I have chosen to minimize my shopping north of FVCC.
The Glacier Mall's plan for three new stoplights on US 93 will make traffic problems even worse.
That's why I would like to see a full overpass interchange so U5 93's traffic is not further impeded.
All access points should be well thought out with a comprehensive Transportation Flan to prevent the
problems that appear to be creating a strip from Kalispell to Whitefish. Potential conflicts need to be
resolved now in the planning process before costly taxpayer corrections are required in the future.
And I would like to see this and other developments fully pay their way for the services that are going to
be provided to them, whether through Impact fees or other options. I an especially concerned that the
City has the capacity to handle all this new sewage.
Good luck with your daunting task. And as for me, well, if the Flathead's traffic becomes unbearable,
there are no sto li hts or stop.sicms for over 70 miles east between my home and Browning. Teeples'
new IGA store might become an inviting alternative to shopping in the Flathead.

face it, do NOT wish to see Bucky Wolford bring more development to our valley only to pull out later and leave

he has done business. Second, permit me to lodge my strenuous opposition to this whole mess that has been
put in place once the initial approval was granted by the planning board. overall, allowing the Glacier Towne
Center to become reality is like Custer putting out a call for more Indians. Folks don't come to the Flathead to see
more box stores and strip malls. Kindly be more creative here and deny final approval based on the increased tax
burden to our citizens, increased and unacceptable traffic congestion, lack of any meaningful careers associated
with it and the incredible burden placed on waste treatment facilities and despoliation of our groundwater. Is there
no place in the Flathead that is exempt from this continual urban sprawl? Just say no to Glacier Towne Center.

Dear Planning Board Members,
As a Kalispell resident and business person, I read with interest and concern about Glacier Mall's recent
proposal. I would like to share my following concerns:
Adding additional stop lights to Hwy 93 is not an acceptable solution for out community. Hwy 93 is a Federal
Hwy, not a frontage road. The traffic and safety impacts of stop lights are already a serious problem south of
Reserve Drive. Adding more stop lights North of Reserve makes no sense. This large development needs to
address the significant traffic impacts on our primary North -South transportation corridor.
Impact fees for required infrastructure (roads, sewage, etc.) need to be addressed in the developer's proposal. If
not, the planning board needs to address these impacts to protect taxpayers. Especially with a slowing economy
and slowing construction through -out the nation, this development will take longer than originally anticipated to
complete. Tax payers should not be responsible for paying the bills while the developer waits to sell properties
and generate tax revenue. Empty lots don't generate much tax revenue.
I appreciate your work as a board, to serve the good of the city and the Valley in general. Thank you for your

Annie asked if I could give you an agency referral on the Glacier Town Center Project. I have reviewed the
proposal and have three concerns.
1) The first concern is with the amount of impervious surface they are proposing especially around the mall. We
are concerned with the storm water runoff these amounts of impervious surface with create, and with the amount
of surface heating it will create. We suggest the developers reduce the surface area of parking by using one or
more parking garages near the commercial centers. For other parking areas, we suggest using innovating
landscaping techniques to harvest storm water to be utilized for watering vegetation that will provide overhead
cover of the paving surface. This will reduce the storm water runoff, and heat island impacts. Another impact of
the impervious surface we are concerned about is the impacts to groundwater. Any infiltration systems of storm
water should be placed in distances following EPA standards from any drinking wells on neighboring properties.
2) The second concern is over the shift in the character in the area. Some of the areas surrounding the project
are very rural in character. To the north and east of the project, we would appreciate lower densities and
adequate buffers with vegetative screening to preserve some aspects of the rural character. Currently we do not
feel the buffers and densities are appropriate. one suggestion is to eliminate lots on the north and east to
increase buffers, and to transfer that density to the center of the project in all that excess paving near the
commercial centers. We would rather see mined use then parking lots. We also suggest the developer use dark
sky principles with all lighting in the project to reduce the amount of light pollution created. Tucson, Arizona has
a very effective dark sky ordinance, and we suggest the developer use this ordinance as a model.
3) The third major concern is the impacts to the transportation system of the area. We are especially concerned
over the impacts to Rose Crossing. Extending Rose Crossing to US 93 will create a connection from US 93 to US
2 that does not currently exist. While this could elevate traffic on Reserve, it could have significant impacts on
traffic patterns on Rose Crossing on its entire length from 93 to 2. Rose Crossing is built to collector standards,
but this proposal will transform Rose Crossing to an arterial without improving its standards. Ideally we would
support this, but we know the reality that the developer will not pay for improvements to Rose Crossing from
Whitefish Stage to US 2. We propose two alternatives.
1) To aggressively use traffic calming devices such at traffic circles and or roundabouts to Rose Crossing
in the development to discourage through traffic from US 2 to US 93. A traffic light should be installed at
Rose Crossing and 93.
2) To eliminate the connection of Rose Crossing to US 93.
We are also concerned with the number of accesses onto 93. And finally, we would find it appropriate for the
developer to improve Whitefish stage from Rose Crossing to West Reserve, and the intersections of West
Reserve and the proposed access to the south, West Reserve and Whitefish stage, Whitefish Stage and the
proposed access to the south of Rose Crossing, and Rose Crossing and Whitefish Stage.

It has come to my attention that there are some serious issues regarding the Glacier Mall development
and its impact on Flathead 'Talley that need to be looked at very hard before you approve of any more
development.
I am writing you to express my concerns about these issues and to ask you to please take your time and
implement whatever cautionary measures are necessary to insure that the duality of life in Flathead
Valley that we enjoy so much is not ruined or negatively impacted by approving too much commercial
development hastily.
I ask the members of the Kalispell City Council to please consider the following actions:
a Please limit commercial growth so that it does not have any negative effects on the beautiful Flathead
Valley. Slow down the growth, please'. Limit general commercial to be in accordance with established

Please continue the public hearing regarding commercial growth and the Glacier Mall until thorough

I also believe that the Kalispell City Planning Board is holding a private meeting regarding traffic on the

My additional concerns/questions are...
Will there be adequate surer capacity expansion for this massive development?
Will there be a firm and enforceable commitment to mixed use,, or will there be a loophole so that the
developer can change the plan to 95 % commercial at a later date`?
• will taxes be going up to cover this development?
Glacier Mall is not needed and would not be pursued by cities with sensible urban plans. Kalispell has
habitually planned in a backward manner. Please do your part in stopping that behaviour.

I am greatly concerned about the Glacier Mail proposal for many reasons. Traffic in that area is going to be
horrible. You are doing a disservice to the entire valley by allowing additional commercial in an area that is
already becoming saturated with traffic and stop lights.
I am concerned about creating another "downtown" like area. You are ripping the heart out of downtown
Kalispell by allowing more commercial in additional areas. don't dismember your downtown and then spend the
next 20 years trying to revive it.
Is there sewer capacity for this gigantic project? Do not force taxpayers to underwrite the costs of providing
additional sewer capacity. A project this large will also require police, fire and emergency services. Who will pay
for these?
A project this large should have additional public hearings. Ramming this through during the holiday season is
not the way a city should conduct its business.

I wanted to get my comments to the Planning Board members in time to the hearing tonight on
the Mader Town Center. Unfortunately I am not able to be there this evening but I do have a
couple of major concerns that I feel need to be brought to the attention of those dealing with
this issue, and, I know that I will speak for a lot of others.
First and foremost, I am not writing to nit pick about the group of people that has held up this
project as that has nothing to do with my comments. What they did has been done and going
bac k serves no purpose today
The project started out as an regional mall built on land away from the city's hub and that is
good. I come from a large city where huge malls are put right in town taping away from those
small retail stores in the neighborhood, especially when stores go in that are in direct competition
to the smaller stores that were there well before the mall. There were five big malls, on the
outskirts of the city was an outlet type mall and it was built like what has now come to you to
approve. Please consider what is before you from a person's standpoint and its result that will
come -
Our outlet mall was an outdoor mall and to get from one store to another you had to go outside
and brave the heat, the elements, the cold, the snow, the wind, the ice. It wasn't tong before
the people starting shopping there less and less and one store after another would more out when
their lease ended and soon you found these stores in the enclosed malls. You could not take a
shopping tart and make your purchases in one store then push your cart to another store. The
last I talked to someone from back home the outdoor mall was with many vacant stores
Please look at this plan to make this mall an outdoor mall. Think of the handicapped, think of the
senior citizens,think of the heat of the summer, and the cold winds and icy walkways, and the
freezing rain, and freezing fog. Think of the people who will slip and fall trying to go from one
store to another in the howling winter winds. This type of shopping facility is fine for southern
California, Florida, and other places that has no w inter . You come out of a store with several
packages and you want to go to a store seven or eight stores down and while you were in the first
store a thunderstorm comes up with 50 mph winds, what do you do? You can't get down to the
store where you want to go without getting soaking wet and trying to hold on to your packages for
dear fife. or an out of the blue snowstorm moves to with howling winds and the walkways have
became icy and you are hoping you don't fall. These things can be causes for lawsuits. In this

day people sue for anything and usually win. But these things need to be considered when
approving such a plan for northwest Montana and I am sure that Mr. Wolford knows that this is
not the type of mall for here but agreed to it under all the pressure having been put on him for
years.
The saute thing can be achieved if you build this needed mail in such a way that you can go from
one store to another inside instead of outside_ What is the difference? This concept has
baff led me. Its ok to build the mall, but you have to go outside to get from one store to
another instead of going from one store to another inside. I have to say that a lot of people,
not only here in Kalispell, but elsewhere, are roiling on the floor laughing about how silly this
really is.
In concluding, I was always taught through my many years that it is ok to complain about
something, disagree with something, but when you do, also come with a solution. So, my solution
is to revert back to the original plan of this beautiful mall outside of town, and build the indoor
mall. But, to keep those who think it will be an eye sore happy, change the design outside. Build
it to it totally blends in the landscape, the outside done in tuber and log. Make it to resemble a
big wane, cozy, lodge. When you walk in the mail entrance, walk into a huge rock and stone
fireplace, with a roaring fire going, a big rustic rug and soft leather sofas and chairs, pots of
coffee, cider, hot cocoa, and have a local bakery provide treats. This would be a gathering place
where people would meet or where husbands stay while their wives shop. Outside have huge
eaves that protect the entrances and a drive up where you can drop people, seniors, handicapped
people off out of the elements. Make this mail unique and friendly and warm. Instead of bright
blinding lights at night, have the soft glow of lamp posts with the amber lights. The outside of
the mall should be done is the same type of soft glowing amber like you would see coming from a
lodge. ape the ares with a lot of pine trees so when passing by on the highways you look
through the pines and see what looks like a big lodge, not a shopping center. Have some sky
lights where the amber glow at night comes through and the sun shines inside during the days.
Instead of a huge slab of concrete for a parking lot, break it up with lanes that have pines along
there and each lane have a place built out of logs and timber to return your carts to. Make the
covered entrance big enough to accommodate the busses that will surely bring shoppers to this
beautiful malt so people can board and unboard out of the weather. Inside the main entrance
have a soothing waterfall and as you walk through the mall, have small fountains with tittle rustic
resting areas for shoppers. As the project expands, add other water features outside around
areas that will connect other phases of the total area. The idea is to not make it look like the
everyday shopping mall that is cold, ugly, and unappealing. And lastly, work with the downtown
retail businesses and not lease to stores that would directly compete with them. Downtown was
here first. But offer downtown retail stores a chance to relocate to the mall with a break is
rental. They deserve it. If they say no, then respect their business and not lease to another
business like theirs. Direct shoppers to them if they ask where can we get this or that. Why
gust follow the highway straight down to downtown Kalispell and you will find the store you are
looking for. To me one of the biggest issues was downtown would become a ghost town. Not at
all if you do it right. And the area up around 93 and Reserve needs a grocery store so badly.
Maybe Mr. Wolf ord would Build one and again make is look like Rosauer ` s, rustic, logs, inside and
out. The entrances from the highways and roadways around the mall area should all be done the
same. Made to look like you are driving into the woods, lots of pine trees.
But please, not a mall that you have to keep going outdoors to get from one store to another.

That's a big problem with what is being built in the Horne Depot area. You finish shopping at
Target and you want to go to the bookstore. You come out of Target with a bunch of sacks,
some heavy, and it is raining or snowing or blowing a cold wind. Well forget the bookstore and
you gust want to get to your car and out of the weather. You're not going to drive down to the
bookstore, park again, if you can find a parking spot, and get back out in the wind and the rain
and the snow again. You leave. The bookstore has gust lost some money they would have made
had the shopper been able to get to the book storef rom the inside. How many times have you
been in say Target and you can't get a tool that you need or some nails or some paint and you
need to go to Herne Depot- It is clear down on the other end. Would you wails all that way and
back? And if you do walk way down there, and you come out and it has suddenly started freezing
rain and everything is a sheet of ice. How do you get back to your car where you parked it at
Target? These example sound tright in the overall scheme of things, but they mean the word to
the shopper. And in the retail business it means everything to the owner to have customers, not
shoppers that come out of a store and look down the outdoor mall and see the store they want
to go to is "way down there"- They leave. That store way down there gust lost some business.
So please rethink this outdoor ,Hall concept. you're still going to have a building, a mall, so what
is the difference if you get from store to store inside or outside? Mr. Wolf ord can build his mail
if you go from store to store outside rather than from the inside. Kalispell is on the move
inwards. In just the five years I have been here I have seen a huge growth and all the name
stores are corning in. That" s what happens when you grow so we have to grow with it and build
things to accommodate the people. You are not trying to build a new downtown h ere . What you
are wanting Mr. Wo l f ord to build now, is a new downtown. You are going to force downtown out
of existence by doing this. Why was there not any of this opposition to all the other stores
going in in this sarne area? How did all the big box stores get built without a whimper from this
group that is fighting the mall so hard? How did Hutton Plaza get approval and built so fast?
Where was ail the opposition to that? Right now 93 and Reserve is a total ,Hess and cars
everywhere trying to get from one place to another. Accidents left and right. You have to sit
through three and four red fights to get out of donne Depot because there is only one way to get
out to the highway out of that entire strip mail. And more stores are going in.
Please, let Mr-. Woiford build a real mail like he wanted to do and desW it like I suggested
above so it blends in and the lighting issue is address and it will be a wonderful thing for us to
have. Work with the downtown merchants and not take their customers to the mail. Allow no
store that is already in place downtown in the mail. When the park there gets built the children
can play and the entire area can be a family thing.
Thank you for reading this and taking a good look at what you are doing, please. The senior
citizens would appreciate it, the handicapped people would appreciate it, mothers with kids would
appreciate it, downtown merchants would appreciate it, nearby homeowners wouold appreciate it,
shoppers would appreciate it, and even the little group of opposition would come to appreciate it.
And one other thing, the people themselves. When it comes time to lease to merchants, ever
think of asking the people here what kind of stores they would like in their ,Hall? And what about
having some reai res-tauran-ts in the mail or around the mail where you could go have dinner or
b:nch then go chapping? An Olive Garden, a Red L.abster, a Ruby Tuesday, a Chill" s . Again,
only one of a kind. I wish I could be at the meeting tonight but unfortunately it is not

P lannim Board Members and Staff,
Nly name is Brent Hall and I reside in Lakeside and have a business in Evergreen. I have
been involved in this project since it started through the process S years ago. It was a
ood project then ��vxth the exception of the location which was northeast of Deserve and
Highway ?. The flood plain was not conducive for a project of this magnitude; however,
there is now a major subdivision that is now being built out in this same location. My
how things change.
Being the person he is, Nfr. wolford persevered and found another sight that was well out
of the flood plain so he could move forward with his plans for the Glacier Town Center.
During the past 8 years we've seen 24 major buildings constructed in the same general
area as Wolfbrd proposed his project. These 24 buildings were constructed with very
little opposition and I feel that the wolford Group was treated unjustly and I admire them
for their staying power. His Planned Unit Development will be heads and shoulders
above the gigantic strip mall we now have centered around the Home Depot and Costco
locations.
Having served on the original Kalispell C ity/C o unty planning board I am not new to the
approval process, Fifteen to twenty conditions of approval were common and the
developer and staff could usually work things out. This PUD has 46 conditions, which I
feel is way out of line. I feel that to impose this number means only that some people
didn't do their homework. I looks as though we are telling someone who is in the retail
development business, how to do his job, with no regard to the economic impact of our
conditions we are imposing. If our goal is to put the developer out of business, so be it.
Let's work with the developer not against hire.
If we want to make the retail center people friendly, let's make it so the customer can
drive up to the store he wants to visit. Having raised sidewalks in the center parking area
makes little sense other than adding to the contractor's costs. They do little or no good.
This situation occurs at the Famous Dave' s and climbing over these raised areas is more
of a nuisance than a convenience, especially if you are older or handicapped. The same
theory applies to sidewalks on the ring road.
Connectivity to the north as proposed is something so far out it in the future that this
condition shouldn't be considered at this time. Four entrances in to the development
C om the north fit the project as drawn. We don, t need to matte every street in the
residential area a speed crap or a high traffic area. especially tivhen we eventually are

For many years nay wife and I have wintered in Phoenix and watched how they solved
their traffic problems... when we first moved there distances between major shopping
intersections were miles apart... Right-of-ways were planned and established for fixture
highways/freeways with interchanges over major intersections. (I believe these
interchanges are now one, two, or three miles apart, depending on the development of the
area.). Today traffic flows beautifully around Phoenix in all directions even though
shopping centers and residential developments are now wall-to-wall.
I realize we are not Phoenix, nor do we have the need at the present, but surely the need
exists for such planning for the future. For example, stop lights might facilitate the Rose
Crossing/-Iwy 93 intersection at this time with a major interchange planned for the
Church Road intersection. (Or just the reverse situation depending on the potential traffic
flow problems.) whitefish Stage Rd and Spring Creep Rd would then become the roads
for travel within the immediate areas with stop lights planned at intersections as the need
requires, say every mile or two. Traffic would flow east and west on Church Road and
Dose Crossing and reduce the strain on west Reserve Drive...
I am not aware of an east/west road with a bridge around the FVCC campus. would this
not also reduce the traffic congestion at the 93/West Reserve intersection?
I gander why these possibilities haven't taken precedence over the 93 Forth or 93 South
by-pass consideration so that traffic will have somewhere to go.

nd the new Kalispell Transportation Plan.
Kalispell to Whitefish Safe &Stoplight Free. Uphold current city and state policies for
limited access on US Hwy 93. Preserve its safe and efficient operation and the special character
of our valley. Require interchanges and similar solutions for growing land use demands and access
Vhis corridor.
Also, please put into place standards to ensure that new development moves forward concur-
rent with needed transportation infrastructure to ensure safe and efficient highway and road
mom
systems in the Kalispell area covered by the new Transportation Plan.
BSI support the need for the city and the state to plan for and identify transportation solutions
and options BEFORE development applications are considered for subdivision review.
