SUBJECT. Parking Lot and Loading ,Area Design Standards

BACKGROUND: The current parking standards were generally adopted between
the 1940s and 1992. Staff began a periodic review of the ordinance in order to ensure
that it is up-to-date and reflects current practices both locally and within similar
communities throughout the region. The review of the parking and loading provisions
was based on local experience and ordinances from a number of comparable cities
throughout Montana and the rest of the region including: Missoula; Bozeman;
Billings; Couer d'Alene, ID; Boise, ID; Bend, OR; Salem, OR; and Flagstaff, AZ.
A proposal was submitted to the Planning Board in October 2007, and, a favorable
recommendation was forwarded at the January 8, 2008, meeting. The proposed
update to the zoning ordinance is now in front of the Council for consideration.
The more significant areas of the proposed amendment are listed 'below. Additional
information is available in the staff report submitted to the Planning Board and
attached to this memo.
* Clarifying that the change of use of a building may trigger a review of the
parking conditions of the property. (i.e. storage building changes to office
complex)
* Requiring all commercial/%ndustrial parking areas to be landscaped and have
proper drainage, not just those over 4 parking spaces in size. Based on
discussion, the new requirement for landscaping inside a parking lot is limited
to those lots of ten spaces or more.
Updating the language on lighting to reflect our new lighting ordinance.
* Removing the compact parking provisions which allow up to 20% of all parking
to be met by compact spaces measuring 8' x 16' versus our standard 9' x 20'.
This provision was created for the Kalispell Center Mall because they could not
meet their original parking ratios without relief.

* Allowing up to a 5'% reduction in required parking with a provision of bike
racks.
■ Defining situations where usable areas in basements count towards required
parking.
• Lowering shopping center parking from 5 spaces / 1,000 sq. ft. to 4 spaces / 1000
sq. ft.
+• Moving towards a "300 square foot per parking space" standard for more uses
so that we do not inadvertently create parking shortfalls when a building is
converted to a different use. We propose moving banks (150 sq ft./ space),
convenience grocery (100 sq ft/ space) and medical/ dental (200 sq. ft. / space)
to a rrarnmum. 300 sq. ft/ space standard and at the same time taking
professional offices from 400 sq. ft. / space to 300 sq. ft.
Reducing the multi -family housing ratio from 2.5 spaces per unit to 2 spaces
and allowing a one space/ unit requirement for efficiency units.
Under off-street loading standards we propose reducing the number of off-street
loading berths required for various uses as more deliveries are done by small
package delivery trucks (UPS, Federal Express) than over the highway semi's in
today's market.
■ Applying clear vision triangle provisions to location of parking spaces.
• Providing for administrative adjustments by using a "placer -holder" until the
specific procedures and standards are developed.
RECOMMENDATION: If desired by the Council, staff should be directed to place
the zoning text amendment on the next available Council agenda.
ALTERNATIVES: As suggested by the Council.
ATTACHMENTS: The proposed zoning text amendment is attached, with both
"strike -through" and unmarred versions of the same text. Also attached is the staff
report submitted to the Planning Board.

This is a report to the Kalispell City Planning Board and the Kalispell City Council
regarding a request for a text amendment to the Kalispell zoning Ordinance to revise
the Off-street Parking and Loading chapters of the ordinance. A public hearing was
held before the Planning Board on October 9, 2007, in the Kalispell City Council
Chambers, and discussion was continued. The Planning Board will forward a
recommendation to the Kalispell City Council for final action.
BACKGROUND INFORMATION
The City of Kalispell is proposing to amend the Off-street Parking and Loading
chapters of the Kalispell zoning ordinance for the purpose of updating standards and
provisions of these chapters relating to design standards, landscaping requirements,
and minimum number of required parking spaces. This proposal is based on a staff
review and subsequent work session with the Planning Board, and is part of an
overall effort to review and update the entire zoning ordinance.

B. Area Effected by the Proposed Changes: Any area within the Kalispell zoning
jurisdiction could be affected by these proposed standards.
C. Proposed Amen eats: Attached are both a strike -though version of the
proposed changes indicating specific deletions and additions, as well as a version
containing only the updated language. Each version contains changes discussed
at the October 9 meeting. The more significant areas of the proposed amendment
are listed below.
• Clarifying that the change of use of a building may trigger a review of the
parking conditions of the property. (i.e. storage building changes to office
complex)
• Requiring all commercial / industrial parking areas to be landscaped and have
proper drainage, not just those over 4 parking spaces in size. Based on
discussion, the new requirement for landscaping inside a parking lot is limited
to those lots of ten spaces or more.
• Updating the language on lighting to reflect our new lighting ordinance.
Removing the compact parking provisions which allow up to 20% of all parking
to be met by compact spaces measuring 8' x 16' versus our standard 9' x 20'.

This provision was created for the Kalispell Center Mall because they could not
meet their original parking ratios without relief. There was some sentiment at
the work session to retain compact spaces due to the reduction in asphalt and
flexibility of design in order to provide the minimum number of required
parking spaces. Staff believes that other changes within the proposal,
including, but not limited to, a reduction in the number of required spaces and
reductions available for providing bike racks, accomplishes the Board's goal
without incurring some of the problems associated with compact parking
spaces. For present purposes, the proposal does not include compact spaces,
but the provision can be added at the Board's discretion.

space for 5 bicycles.
■ The provision defining areas such as basements for purposes of calculating
gross square footage for parking purposes remains, but is open for discussion.

EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change in zoning is set forth by 7 6 - 2 - 2 0 5 , M.C.A.
Findings of Fact for the zone change request are discussed relative to the itemized
criteria described by 76- 2-203, M. C.A.

Reasonable parking and loading area design requirements are consistent with
the growth policy's goals, intent, and objectives.

The parking and loading provisions are designed to mitigate the impact of
vehicular traffic in the streets by providing an area to park on the property.
3. Will the requested zone secure safety from fire panic and other dangers?
The parking and loading provisions help mitigate traffic impacts in the street,
which help secure the public from fire, panic, and other dangers.
4. Will the requested change promote the health and general welfare?
The general health and welfare of the public will be promoted by mitigating
traffic impacts in the street and by providing a well -designed area on the
property for traffic flog and. parking.
5. Will the requested zone provide for adequate light and air?
The parking and loading provisions contain provisions which help provide
adequate light and air.
6. Will the requested zone prevent the overcrowdm* of land or undue
concentration of people?
The parking and loading provisions are designed to account for the vehicular
impacts associated with a use, which help avoid overcrowding and undue
concentrations of people.
7. Will the reguested zone facilitate the ade uate vrovision of trans ortation
crater, sewerage, schools arks and other public requirements?
The amendments are most closely tied to transportation, and are designed to
help mitigate impacts related to traffic, and parking in particular.

OFF-STREET PARKING DESIGN STANDARDS
}. Location. Off-street parking facilities shall be located as herein -after
specified. When a distance is specified, such distance shall be in
walking distance measured from the nearest point of the parking
facility to the nearest point of the building that such facility is required
to serve. Parking and maneuvering area(s) shall be located entirely
outside of a public and/or private right-of-way, except single family

residential and duplexes, which may utilize driveways provided that
the parking , for separate units within a duplex does not conflict. For
any use other than single family residential and duplexes, parking
spaces which back into an alley shall be set hack ten (10) feet from the
alley right-of-way line.

designed in accordance to the standards of Figure 1, Appendix A.

these regulations.

BOARD DISCUSSION P.J. Sorensen, representing the Kalispell Planning
Department reviewed the amended staff report KZTA--07-03
for the board.
Sorensen noted the only outstanding issue was a method to
calculate the gross floor area of basements for purposes of
parking ratios.
Schutt said he thought basements should count as space
towards the parking requirement if the space could pass a
fire code inspection for legally occupied space.
Clark said there was also a height restriction at 7 feet which
didn't make any sense to him.
Sorensen said staff was attempting to create a standard for
discussion purposes and the criteria suggested was 5 foot
ceiling heights, an access such as a door or stairway, and a
hard floor surface. Having the definition would assist the
staff and lay person in determining whether or not the
basement would be habitable space and therefore counted
toward the parking ratios. Staff' is asking for clarification of a
gray area in the ordinance.
Hinchey said he has several basements on. Main street that
fit that criteria but are not habitable so it provides some
merit to what Schutt was saying. Jentz reminded the board
that this pertains mostly to new construction.
Schutt noted there are yearly inspections by the fire marshal
and Jentz said yes there are but there are a lot of unfinished
basements and the fire marshal may come back next year
and find habitable space and by then it is too late to assign
additional parking space requirements.
Further discussion ,was held and the board suggested the
following amendment-,
"Where a calculation is based on gross floor area of a
structure, any space including, but not necessarily limited
to, a basement or crawl space with (a) a clearance of seven
(7) feet or more; (b) and 2 code compliant accesses; and (c) a
hard floor surface such as steel, wood, or concrete, is to be
considered as gross floor area."
Hinchey discussed item 11 on page to of the amendments
and said it seems to him they are converging on a 300
square foot gross floor area to trigger a parking stall except
for north of Center Street which is 250 square feet and why
isn't it consistent. Sorensen responded the only piece of
property north. of Center, in the Special Parking Maintenance
District, is the mall and the retail shopping center ratio is
currently S per 1000 or 1 to 200. Staff is recommending

dropping that ratio to 4 per 1000 or 1 to 250.
MOTION
Hinchey moved and Balcom seconded a motion to adopt staff
report KZTA-07-03 as findings of fact and recommend to the
Kalispell City Council that the amendments to the Parking
Standards be approved with the amendment noted above.
BOARD DISCUSSION
Clark asked for further clarification on the description of a
basement. Jentz said when someone comes in with a
structure that has a basement the city will count parking
against the basement square footage if it has at least a 7 foot
clearance; a hard surface floor of steel, wood or concrete; and
2 code compliant accesses. If all 3 of the criteria are not met,
no parking calculation will be added for the basement square
footage.

Hull said that he agrees with Clark that connectivity is
something that is vitally important. It wasn't that long ago
the board discussed the need for alternate access points so
the traffic would be distributed. Hull noted that North Haven
Drive doesn't go anywhere, the Christian Center has a road
that is blocked, and there is simply no connectivity there and
should be added as the area develops. Hull said he realizes
the neighbors are unhappy but connectivity and a grid
system is what makes a city.
Hinchey said the he agrees with the need for connectivity but
he is concerned there appears to be some sort of
commitment between these homeowners and the city which
he thinks should be honored to some degree. Hinchey said
he would propose that the road be put in but chained off for
emergency use only.
Schutt said he is a big fan of connectivity. The issue here is
there are so many dead ends that the traffic is forced into
limited areas. He is in favor of the connectivity to Summit
Ridge Drive and likes the idea of traffic calming devices.
MOTION -- AMEND
Schutt moved and Balcom seconded a motion to amend

Condition #6, last sentence of Note # 2 to read, "This shall
specifically include at a minimum a traffic calming device at
the intersection of Summit Ridge Drive and Northland Drive."

does agree that traffic calming is needed on the linear stretch

Johnson noted there was a miscalculation of the required

ST"F REPORT KZTA-07- P.J. Sorensen representing the Kalispell Planning
03 Department presented staff report KZTA-97-03 to the board.
Sorensen noted that the current parking regulations were
drafted between the mid 1940's and 1992 and there have not
been any major changes since 1992. Sorensen noted they
looked at a number of cities to see what their ratios were
which included Missoula, Bozeman, Billings, Coeur d'Alene,
Boise, Bend, Salem, and Flagstaff. A majority of the changes
were clarifications and organization of the regulations.
Sorensen reviewed some of the major points for the board.
The discussion was as follows:
■ Clarified that a change in use of a building could
trigger a review of the parking conditions on the
property. Sorensen noted this is not a, new standard
but was broken up into 2 sections and is now
combined into the same section.
■ That commercial and industrial parking areas be
landscaped and have proper drainage. Sorensen said a
comment was received last week that this change as it
relates to interior landscaping may apply only to
properties with more than 4 parking spaces. Clark
suggested 5 parking spaces instead of 4 because he is
concerned that a small business owner would have to
have drainage plans approved ahead of time and
would be required to put in landscaping where it
didn't necessarily make sense such as *in the alley.
Sorensen said landscaping becomes more important
with larger lots in order to break up the "sea of
asphalt" look and, he added, any time parking lots are
constructed drainage should be taken into account.
The Site Review Committee, including representatives
from Public Works currently review drainage on
construction of all parking lots. Hinchey suggested
amending Section 6.a. to add "for lots larger than 4
parking spaces."
■ Sorensen continued updates were added to reflect the
new lighting ordinance.
Compact parking spaces, which are smaller in
dimension than the standard parking spaces were
originally included in the standards not because there
was a need for compact parking spaces out there but
it providing some flexibility in designing arkin lots.

Staff believes that other changes within the proposal
including a reduction in the number of required
spaces and reductions available for providing bile
racks accomplishes the Board's goal and therefore the
proposal does not include compact spaces. However,
compact spaces can be added back in at the Board's
discretion. Sorensen noted there is a concept called
administrative adjustments which is similar to
variances. Staff will bring forth a proposal adding
administrative adjustments to the zoning ordinance. it
would apply to any provision in the zoning ordinance.
An example would be if there is some unique
character about the lot you could file a petition with
the Zoning Administrator and could possibly receive a
reduction in the required number of spaces.
• Allowing up to a 5% reduction in required parking
with a provision of bike racks. Sorensen said a
clarification would be to install one bike rack with
enough space for 5 bikes. The way it was worded in
the current text was confusing.
• Defining a usable area which is used to calculate
gross square footage for parking purposes to include a
basement or crawl space with clearance of 5 or more
feet, access with a door or stairs, and a hard surface
for the floor. There was considerable discussion
regarding this amendment and Jentz noted that this
provision is not focused at the downtown area but for
new construction. Sorensen said the idea is to prevent
developers of new construction from creating
habitable space in a basement without providing the
required parking spaces to accommodate that space.
Schutt agree there needs to be a definition.
• Lowering shopping center parking from 5 spaces /
1.,000 sq. ft. to 4 spaces/ 1000 sq. ft.
• Moving towards a "300 square foot per parking space"
standard for more uses so that we do not
inadvertently create parking shortfalls when a
building is converted to a different use. we propose
moving banks (150 sq ft. / space), convenience grocery
(100 sq ft/ space) and medical/dental (200 sq.
ft./space) to a minimum 300 sq. ft/ space standard
and at the same time taking professional offices from
400 sq. ft. / space to 300 sq. ft.
• Reducing the demand on multifamily housing from
2.5 spaces per unit to just 2 spaces and allowing a
one space/ unit requirement for efficiency units.
• Under off-street loading standards we propose
reducing the number of off-street loading berths

required for various uses as more deliveries are done
by small package delivery trucks (UPS, Federal
Express) than over the highway semi's in today's
market.
■ Sorensen added a suggestion of changing the title of
the chapter from Off -Street Parking noting that the
chapter does not completely regulate the parking of
cars off-street but it is a parking lot design ordinance
and therefore should be titled Off -Street Parking Lot
Design Standards.
• Sorensen said they did call out a few areas with clear -
vision triangles, making sure that parking lots do not
have cars parked where they block traffic at
intersections. Right now there is a generic standard
and is another change that they are looking at
bringing forward.
BOARD DISCUSSION Balcom asked if other cities have a basement standard and
Sorensen said they haven't defined them either and that is
why they tried to look at other things that would define a
basement as usable space.
Balcom asked if there is a standard for medical office parking
and how is it figured? She added she recently had to walk
quite a distance from parking to an office on Burns way.
Sorensen said if there was a new medical facility constructed
they would take the gross square footage and divide it by Zoo
and that would be their requirement. He added Burns Way
had a higher parking requirement and were given a variance
to get a significant reduction in the number of parking
spaces that were required.
Williamson asked for clarification on the removal of the
compact parking spaces and the alternate mechanism where
people can petition the Zoning Administrator to receive
reductions. Sorensen said that mechanism is not a part of
the update because the administrative adjustment is a
general provision and not just for parking. Williamson said
then the board would have to add that provision to the
parking section and Jentz said yes.
Sorensen directed the board to the reap of the Special
Parking Maintenance District #2 that was included with the
staff report. Sorensen said the district boundaries are from
Center Street to 5th and from. 3rd Ave west to 3rdAve East.
"Within that area there is a specific section in the standards
that address the downtown parking and certain standards
such as parking ratios do not apply to downtown. Clark
thought that was unclear and Sorensen explained for the
board..

Sorensen said in the downtown area the parking requirement
is a flat 1-400 ratio. The only thing that would trigger an
additional parking requirement would be new construction or
adding on to an existing building. A change in use would not
lead to an additional parking requirement for properties
within the downtown Special Parking Maintenance District
#2.
Jentz suggested they could add language to make it clearer.
Schutt said then they are saying that existing uses, even if
under -parked, are grand.fathered in. Sorensen said yes.
Sorensen said one final thought related to the downtown
area on page 1, paragraph 2 that states "Parking spaces
shall be increased whenever a change in use increases the
amount of required parking except for properties within the
boundaries of the Special Parking Maintenance District #2."
Sorensen suggested that wording could be added to the
section discussed above to make it crystal clear. Hinchey
thought "increase" might not be the right word and
suggested "reviewed". His concern is what if the use required
fearer parking spaces." There was additional discussion on
the wording.
PUBLIC HEARING Michael Blend, 104 West Bluegrass provided written
comments to the board and he reviewed them. (A copy is
attached to the minutes).
Clark asked Blend when he is talking about sub -lots was he
referring to pads and Blend said he is referring to townhouse
or multi -family lots where each building has their own lot so
they can be sold individually but then there is an undivided
common interest in the parking lot.
Sorensen addressed some of the comments that Blend
presented.
Mayre Flowers, Citizens for a Better Flathead stated she is
concerned about the reduction in parking at the current
Kalispell Center Mall. if there are additional businesses
constructed in the Mall's parking lot would that put pressure
on other businesses in the area with parking spilling over
from additional uses at the Mall.
BOARD DISCUSSION Schutt asked where the board is on these amendments to
the parking standards. The public hearing has been held and
he questioned if they should table the discussion for a
decision at another meeting or should a work session be
held.
Jentz suggested staff could bring in some additional
amendments to address the comments by the board and the
public.

Hinchey said with the removal of the compact spaces, he
understands what staff is saying, they are smaller and hard
to monitor, but today when cars are getting smaller and gas
is getting more expensive is it prudent to eliminate compact
spaces. There was discussion on whether the administrative
adjustment could be used to compensate for the removal of
the compact spaces provision.
Hinchey asked if there was some rationale for the new
allotment of parking for square footage. Sorensen said they
compared the allotment to this community and the 8 other
cities that were reviewed and came up with an average.
Sorensen said one of the general comments that the board
has made is the city is over parked and has "seas of asphalt".
Jentz said staff is not saying they can't provide more parking
but this is the minimum.
Schutt asked the planning board members to provide written
comments to the staff before the next meeting or work
session.
