The proposed selling price is $1 plus an equal share of closing costs up to $500. In addition to the offer letter from Knife River, I have also included a certificate of survey of the property in question, and a county property map showing its location east of Lawrence Park. As portions of this parcel are subject to wet conditions, we do not anticipate a full use of the area for park lands. However, we do envision being able to use this area for the public by creating nature trails through the forested area. Improvements to the area would likely be done as resources are available and would take place over time. FISCAL IMPACT: The fiscal impact for acquiring this parcel would be the $1 purchase price plus closing costs us to $500. RECOMMENDATION: It is recommended that council move that the City accept the offer of Knife River, made by letter dated April 17, 2017, to the City Manager, to sell to the City, for the sum of $1.00, a parcel of real estate that is situated adjacent to Lawrence Park, located in the NW 1/4 of Section 8, Township 28 North, Range 21 West, Prime Meridian Montana, and particularly described as, "Tract 1 of Certificate of Survey 19246 according to the map or plat of record in the Office of Clerk and Recorder, Flathead County, Montana" on the condition that the parcel may be conveyed by limited warranty deed and is not otherwise legally encumbered to an extent unacceptable to the City, and that the City will further agree to share equally in the closing costs (up to $500.00 for the City of Kalispell), which will include the cost of title insurance and that the parties will endeavor to close the transaction no later than June 1, 2017.
