50/50 Sidewalk Programr"%JESOLT,�TION No. 4737 A RESOLUTION AMENDING RESOLUTION 4291, THE ANNUAL SIDEWALK REPLACEMENT PROGRAM FOR THE CITY OF KALISPELL, BY INSTITUTING A 50/50 SIDEWALK REPLACEMENT PROGRAM, WHEREAS, the City of Kalispell is responsible for the construction and replacement of all sidewalks within the City, and WHEREAS, current policy is resulting m' insufficient sidewalk replacement, and WHEREAS, funds exist in the 2003 budget that can be used for replacing public improvements including sidewalks, and WHEREAS, the City Council desires to use the funds in the annual Gas Tax Fund program to create an improvement program for sidewalks in the City, and WHEREAS, a cost -sharing sidewalk replacement program would encourage replacement of sidewalks by equally dividing the cost of sidewalk replacement between the property owner and the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of THE CITY of ALISPELL AS FOLLOWS SECTION II. The City will initiate a cost-shuing sideway replacement program by equally dividing the cost of sidewalk replacement between the adjacent property owner and the City by using $50,000 of Gas Tax monies. SECTION II. The 2004 Proms Funds will be based on available cash and demand for the program,, SECDON III, The installation of new sidewalks in areas that do not now have sidewalks will remain. the responsibility of the adjacent property owners. oN Iy. WHEREAS, the Public Works Department has completed a survey regarding sidewalk conditions throughout the City of Kalispell, and WHEREAS, the City of Kalispell has a need for a sidewalk replacement program, and WHEREAS, funds exist in the tax increment fund that can be used for replacing public improvements including sidewalks in this district, and WHEREAS, the City Council would desire to use some of the funds in the annual street improvement program to create an annual improvement program for sidewalks in the City. NOW THEREFORE BE IT RESOLVED THAT: SECTION I. The City will initiate a sidewalk replacement program in the downtown tax increment district in FY 1997 using $ 7 5, 0 o 0 of non --programmed funds. SECTION II. The City will use $25,,000 of the street improvement funds for sidewalks in FY 1998 through the Year 2002 and each Year thereafter a sung of $15,000 will be used for sidewalk replacement. SECTION III. The installation of new sidewalks in areas that do not now have sidewalks will remain the responsibility of the adjacent property owners. SECTION iv.
