Re: Trumbull Creek Crossing Phase One
Dear Mr. Patrick:
Please be advised that I am in receipt of your letter of August 20, 2007 concerning the
above captioned matter.
You are advised that it is the policy of Flathead County water and Sewer District #1 -
Evergreen (District) that all properties that hook up to the District facilities are customers
of the District; and, accordingly, the District cannot agree with the condition set forth in
your letter that this property will be a City customer and that the City of Kalispell will
utilize the District's facilities to transport wastewater for treatment at the Kalispell Plant.
The District is prepared to serge the Trumbull Creek Crossing Phase I as it currently
serves all of its customers, whether outside or inside the Interlocal Agreement boundary,
namely, the users within Trumbull Creek Crossing will be customers of the District,
billed by the District for both transportation and treatment of wastewater; and as is the
present case with all existing customers, the District will, in turn, pay Kalispell for the
treatment of said wastewater, per the Interlocal Agreement and, of course as set forth
expressly therein, the wastewater volumes from all sources outside the Interlocal
Agreement boundaries will not be considered part of the District's reserved capacity.
