BACKGROUND: This is a request for final plat approval of Glacier Village Greens
Phase 18 that plats 12 sublots on approximately two acres. The property is located at
the northern end of East Nicklaus Avenue.
The Kalispell City Council approved Glacier Village Greens Phases 14 through 22 in
December of 2002 subject to 16 conditions. All of the required infrastructure for
phase 18 has been completed.
RECOMMENDATION: A motion to approve the final plat for Glacier Village Greens
Phase 18 would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

Dear J1m:
Our office has received an application from Sands Surveying for final plat approval of
Glacier Village Greens Phase 18 that plats 12 sublots on approximately two acres.
The property is located at the northern end of East Nicklaus Avenue.
The Kalispell City Council approved Glacier Village Greens Phases 14 through 22 in
December of 2002 subject to 16 conditions. All of the required infrastructure for phase
18 has been completed.
The following is a list of the conditions of preliminary plat approval for this subdivision
and a discussion of hour they have been met or otherwise addressed.
COMPLIAJ'CE WITH CONDITIONS OF "PROVAL
Condition No. 1: Development of the subdivision shall be platted in substantial
compliance with the approved preliminary plat which governs the location of lots and
roadways within the subdivision.
�► This condition has been met. Some minor modifications have been made to the
lot layout for this area by shifting the road and lots west to avoid the 1 oo-year
floodplain along the Whitefish River.
Condition No. 2: That the roadways serving the subdivision shall be constructed in
accordance with the adopted Design and Construction Standards for the City of
Kalispell for local roads and include the pavement, curbs, gutters, storm drainage,
sidewalks and a minimum five foot landscape boulevard with street trees placed in
accordance with a plan approved by the parks and recreation director. A letter from
an engineer licensed in the State of Montana certifying that the irnprovements have
been installed according to the required specifications shall be submitted at the time
of final plat approval along with a letter from the Kalispell Public works Department
stating that the required improvements have been inspected and comply with the City
standards.
• This condition has been met. A letter from the Kalispell Public Works
Department dated 4 / 2 5 / 03 has been submitted approving the infrastructure
plans for phases 14, 1.8 and. 22. A subsequent letter from. the Kalispell Public
Works Department dated 1 / 5 / 07 approves of the city owned improvements in
the subdivision based in part on a letter from the project engineer, WMW
Engineering, dated 12 / 18 / 06. Although only a portion of East Nicklaus Avenue
is shown on phase 18, the entire roadway has been constructed. Only the
portion of East Nicklaus Avenue shown on the final plat for phase 18 will be
dedicated to the city at this time. However, the developer will be providing a
temporary easement for the use of the remaining portions of East Nicklaus
Avenue for public use. Once phase 22, which includes the remaining portions
of East Nicklaus Avenue, is recorded the remaining portions of road right-of-
way will be dedicated to the city.
Conditions No. 3: That a letter be obtained from. the Kalispell Public Works
Department approving the sewer and drainage facilities for the subdivision.
This condition has been met. Attached is a letter dated 4 / 2 5 / 03 from the
Public Works Department approving the plans and specifications for the
project.
Condition No. 4: That a geotechnical analysis of the slope areas to the north and to
the vest of the proposed subdivision be performed that pertains to the stability of the
slope and identifies any potential for failure due to development of the subdivision or
other construction that might occur. The report shall be submitted to the Kalispell
Public Works Department for their review and approval.
• This condition is not applicable to this phase.
Condition No. S: A storm water drainage plan which has been designed by an
engineer licensed in the State of Montana shall be prepared which complies with the
City's Design and Construction Standards and shall be reviewed and approved by the
Kalispell Public Works Department.
• This condition has been met. A letter from Public Works Department dated
4 / 2 5 / 03 approving the plans and specifications for this project has been
submitted with the final plat application.
Condition No. 6: That the developer obtain a letter from the Evergreen Water
District or their engineer approving the grater main extension and certifying that any
necessary improvements have been completed.
• This condition has been met. A letter from the Evergreen Water & Sewer
District dated 1 / 11 / 06 approving the water main extension has been submitted
with the final plat application.
Condition No. 7: The roads within the subdivision shall be named and signed in
accordance with the policies of the Kalispell Public Works Department and the
Uniform Traffic Control Devices Manual and be subject to review and approval of the
Kalispell. Fire Department.
• This condition has been met. The road signs for this roadway are already in
place.
Condition No. S: The developer shall provide a letter from the U.S. Postal Service
approving the plan for mail service.
• This condition has been met. These phases will utilize existing pre -approved
mail facilities.
Condition No. 9: Street lighting shall be located within the subdivision and shall be
shielded so that it does not intrude unnecessarily onto adjoining properties.
• This condition has been net. Street lighting has been installed in the
subdivision.
Condition No. 10: That the parkland dedication requirements shall be met by
recognizing the existing park and parking improvements as well as open space within
the development.
* This condition has been met.
Condition No. 11: All utilities shall be installed underground.
This condition has been met. All new utilities have been installed underground.
Condition No. 12: That the fire access and suppression system comply with the
Uniform Fire Code and a letter from. the Kalispell Fire Department approving the
access and number and placement of fire hydrants within the subdivision as well as
fire flours and access shall be submitted with the final plat. The fire access and
suppression system shall be installed and approved by the fire department prior to
final plat approval.
• This condition has been met. A letter from the Kalispell Fire Department dated
1 l 9 / 0'7 has been submitted approving the fire access and suppression system
and the fire flow tests have been completed.
Condition No. 13: That a . um of two-thirds of the necessary infrastructure for
this subdivision shall be completed prior to final plat submittal.
• This condition has been net. All necessary infrastructure has been installed
except for street trees which the developer has paid the Kalispell Parks and
Recreation Department to install the required street trees when a majority of
the homes have been built. A letter from the Parks and Recreation Department
approving the cash in lieu of street trees is attached.
Condition No. 14: AR areas disturbed during development of the subdivision shall be
re -vegetated with a creed -free mix immediately after development.

Condition No. 15: That the boundaries of the 100-year floodplain be established and
delineated on the final plat.
The original lot configurations for the subdivision had portions of the 100-year
floodplain on the east side of the lots. Since preliminary plat the developer has
shifted the roadway and lots west, out of the 100-year floodplain. A letter from
Sands Surveying dated 2 / 9 / 07 includes a map indicating the lots for phase 18
and the approNimate 100-year floodplain boundary. The 100-year floodplain
boundary is not located on any of the lots.
Condition No. 1 f : That preliminary approval shall be valid for a period of three years
from the date of approval.
■ This condition has been met. This phase has been filed within the allowed
timeframe.
C€ hMIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was
reviewed and approved by the City Council on December 16, 2002.
COO PLL46NCE WI'T'I-I THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in compliance with the State and City
Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision can be found to be in cornphance with the Kalispell Zoning Ordinance
and the R-4, Two Family Residential, zoning designation for the property which
governs the dimensional requirements of the lots within the subdivision as well as the
uses.
RECONUM ENDATIGN-,
It can be found that the conditions of preliminary plat approval have been met or
otherwise adequately addressed. The staff would recommend that the Kalispell City
Council approve the final plat for the Glacier Village Greens Phase 18. Please
schedule this matter for the regular city council meeting of February 20, 2007.

"The plat must be signed by all owners of record, the surveyor and the
examining land surveyor.
Attach a letter, which lists each condition of preliminary plat approval, and
individually state how each condition has specifically been met. In cases where
documentation is required, such as an engineer's certification, State
Department of Health certification, etc., original letters shall be submitted.
Blanket statements stating, for example, "all improvements are in place" are not
acceptable.

to expiration date of the preliminary plat.
When all application materials are submitted to the Kalispell Planning
Department, and the staff finds the application is complete, the staff will submit
a report to the governing body. The governing body must act within 30 clays of

Attached please find the materials required for the review of Flathead village Greens Phase
v111 final plat. This was granted preliminary plat approval on December 16, 2902 and phases
of this project have been submitted on a regular basis since then.

The purpose of this letter is to obtain City approval of the infrastructure improvements that are to
be City owned and rnazntained. These i.mprovcments are specifically the sidewalks, curb and gutter,
streets, sanitary sewer and storm sever. The water system m this area is to be owned and operated by
Evergreen water and Sewer District'
At such time as the individual phases are submitted for recordation, any outstanding items will be
addressed, and Will be finished or covered by a Subdivision Improvement Agreement.
Be advised that the above mentioned infrastructure improvements have been installed in
compliance with unproved plans. 1 have included an irrevocable letter of credit in the amount of $205866,
which is equal to ten percent (10%) of the estimated construction costs. Also included are 2 copies of the
"as -bunts" of the project.
Please send us a letter acknowledging receipt of the bond and approval of the project.

• Met with engineering firm regarding Glacier High School and Stillwater Road right-of-
way.
• Conducted several technical review sessions for the Facility Plan Update Project.
• Reviewed need for dedicated left -turn arrow at Meridian and Three Mile intersection with
MDT. Left turn arrow to be installed as soon as possible after spring thaw allows
electrical cabling to be installed.
• Conducted project review meeting with consultant for water storage tank and water well
project.
* Supported Kalispell areas TAC meeting to review status of areas transportation projects.
• Conducted project review for wastewater Treatment Plant Expansion Project. Bid date
set for February 11, 2007. Bid opening set for April 5, 2007.
• Met with TMDL consultants regarding upcoming WWTP permitting process and
potential TMDL impacts on that process.
• Coordinated installation of emergency generator at Buffalo Hill site for the Northern Tier
Communications Project with Department of Homeland Security.

• Per direction given by City Council, wrote a Policy & Procedure Guideline for the City of

• Met with Impact Fee Advisory Committee (IFAC). The committee again reviewed the
Transportation Impact Fee and decided to continue discussion and review of the fee until
next month's IFAC meeting.
• Reviewed the Montana Building Industry's commissioned study of Kalispell's Draft
Transportation Impact Fee.
• Reviewed with consultants the Capital Improvement Plan software to be used in the
updated Facility Plan.

• Conducted several meeting with the GIS Department at the County to establish data and
programming for a GIS based assessment analysis program,
• Prepared a database table of assessments to be compatible with the County CIS software.
• Assisted the GIS programmers at the County with the design of the analysis software.
• Established a link with parcels, photos, and assessments in a geodatabase to enable a
visual scan of assessments for the City.
• Continue to update residential, commercial, and land properties with appropriate charges
for garbage, street lights, storm sewer, street maintenance, forestry, and decorative lights.

ADMINISTRA TION
• Completed Request for Statements of Interest - on -Call Equipment and Personnel for Snow
Plowing and Snow Removal for the budget year beginning July 1, 2007 - June 30, 2008. City
Attorney reviewing.
• Held interviews for Street operator Position on January 11 try and January 1 2"h. Vaughn
Stark and Clint Speer will be joining our Street Division as operators.
• Attended SHR.M meeting on January 1 oth -- Topic was "Disaster Preparedness" presented
by Mark Peck, Director of the office of Emergency Services, Flathead County.
• Complied project information and completed Project Manuals for the Grandview Lift
Station Force Main Replacement Project going out for bid in February.
• Completed the FEMA Emergency Management Institute on-line course for IS--Zoo-ICS
for Single Resources and Initial Action Incidents.
