A WORK SESSION OF THE KALISPELL CITY COUNCIL WAS HELD ON MONDAY,
JANUARY 23, 2017, IN THE COUNCIL CHAMBERS AT CITY HALL IN KALISPELL,
MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCIL MEMBERS JIM
ATKINSON, SANDY CARLSON, KARI GABRIEL, CHAD GRAHAM, PHIL GUIFFRIDA,
TIM KLUESNER, ROD KUNTZ, AND WAYNE SAVERUD WERE PRESENT.
Also present: City Manager Doug Russell, City Attorney Charles Harball, and City Clerk Aimee
Brunckhorst.
Mayor Johnson called the work session to order.
DISCUSSION ITEMS
1. Possible Amendments to the Permit Process and Application for Parades and Special
Events, With or Without Alcohol
Russell introduced the topic and detailed some history of the ordinance. He said the issues facing
council are: whether alcohol permits should be council or administratively approved; the for -profit vs
non-profit issue; should buildings owned by the city but not under city management be allowed to
host events without a permit; and a new request to extend the alcohol approved dates for the ice rink.
He said staff also would like to add the B-3 zone under the distance requirements section.
Russell asked council whether they prefer council approval or administrative approval for alcohol
use, stating anything out of the ordinary would come before council.
There was discussion and council consensus was to move to administrative approval.
Russell opened the profit vs nonprofit discussion.
Kluesner remarked he would like to restrict all permits on public property to non-profit entities.
There was lengthy discussion.
Mayor Johnson, Carlson and Kuntz agreed that council is picking winners and losers if just non-
profits are allowed, and that everyone needs to be given the same opportunity.
Gabriel and Atkinson rebutted and remarked they want to limit permits to non -profits.
Russell suggested leaving the language as it is and working through it during a regular meeting.

Russell introduced the next topic: should buildings owned by the city but not under city management
be allowed to host events without a permit?
Harball noted current unwritten practice is to allow these places to serve alcohol inside without a
permit but they must have insurance.
There was discussion regarding moving Central School and its grounds, Conrad Mansion and its
grounds, and the Hockaday and its grounds to the same section and under the same rules as Buffalo
Hill Golf Course.
There was further discussion regarding liability insurance.
Russell stated staff will pull the leases and review them.
Regarding the change of dates for the hockey rink, Russell suggested changing them to the same
dates that the Hockey Association has access to the rink. Council concurred.
Russell concluded by noting the new B-3 Core Area zone will be added under the 300 foot limit for
alcohol in Section 7.G.3.
Council consensus was to bring the edited ordinance forward at a future meeting that has a light
agenda.
Public Comment
Joe Unterreiner, President, Chamber of Commerce, requested that all of the Chamber's leased
premises be listed in the ordinance, not just the building. He distinguished between events which
require a liquor license and a hosted alcohol event where beverages are given away and noted he
would like them covered in their lease.
Pam Carbonari, Business Improvement District, encouraged council to extend the allowable dates for
alcohol at the hockey rink and allow for -profit businesses to have alcohol at events.
Joe Apple, 203 Garland Street, spoke against the use of alcohol at events, stating he is concerned
with the effects of what alcohol is doing to the community.
Debbie Waldenberg spoke in favor of holding more events in Kalispell, noting people are focusing
too much on the alcohol side of things and not enough on the fun side. She stated the city needs to
manage alcohol appropriately.
Shawna Steele, DeSoto Grill, said they have a non-profit sponsor for their event this year and
explained why they want their event to succeed downtown.
Sean Baker requested council shift the dates for allowing alcohol at the ice rink and make them the
same dates the lease covers.

CITY MANAGER/COUNCILIMAYOR REPORTS
Russell announced that the Growth Policy meeting scheduled for January 24 will be rescheduled;
that he and Guiffrida are going to Helena on January 24 to testify on TIF additions to an Urban
Renewal Plan; and that it is time to plan for the trip to Washington D.C., and he is looking at late
March, early April or early May to go.
Mayor Johnson remarked he wants to get a feel for where the new administration is heading for
regulations, but that it is important to make the trip to D.C.
