RE: Public Hearing to reestablish the Kalispell Downtown Business
Improvement District (KBID) with expanded boundaries
BACKGROUND: The Kalispell Downtown Business Improvement District is expiring
pursuant to state statute. The KBID was established to promote the success of downtown
Kalispell and is funded and directed by the property owners of downtown Kalispell. These efforts
include beautification, downtown events, marketing, social media, fagade improvements and
working with the City of Kalispell and other organizations to represent property owners.
To establish a district, property owners of at least 60% of the land area within the proposed
boundaries must petition the City for the creation of the district. If the petitioners meet this
threshold the City then gives notice, by publication and mailing, to all of the landowners within
the proposed district that they may file a protest with the City against the formation of the district
and that the protest must be received within 15 days of the first publication and mailing. The total
protest meets its threshold if the protests filed, when aggregated amount to any of the following:
(a) more than 50% of the total taxable valuation of property within proposed district; or
(b) more than 50% of the property owners in the proposed district; or
(c) more than 50% of the total projected assessments for property within the proposed
district.
The Council can take no further action upon a proposed district for one year if any one of the
protest thresholds is met.
Business owners representing 62.84% of the land area within the proposed district have submitted
petitions to establish the business improvement district with the expanded boundaries.
The proposed district assessment for each property owner is calculated by .015 per square foot,
plus .0375 of the taxable value of the property. For example, a property with 7,000 square feet of
land area with the appraised value of $6,494 would be assessed $105 (7,000 * .015), and $241.76
(6494 * .0375) for a total annual assessment of $346.76.
With the passage of Resolution 5793 on December 19, 2016, the Council stated its intention to
consider the establishment of the district, pursuant to statute, called for the public hearing to be
held January 17, 2017, and caused notice of the hearing to be published and mailed to all property
owners in the proposed district.
Property owners were notified in the publication and mailing per state statute that they would
have a period of fifteen days after December 28 (the first publication date) to provide written
protests against the creation of the district. Protests received prior to the release of the January
17th City Council agenda and materials have been attached to this memorandum.
RECOMMENDATION: Open the public hearing and call for public comment on this item.
Consider all communication received on this matter. A Resolution to approve the creation of the
District will then be brought before the council for consideration at the regular February 6, 2017,
City Council meeting.

The Kalispell Business Improvement District (KBID) was established to promote the success of
downtown Kalispell. The KBID is funded and directed by the property owners of downtown
Kalispell.
As a board of volunteer downtown property owners, we do our very best to allocate these funds to
activities and programs that make a real difference. These efforts include beautification, downtown
events, marketing, social media, facade improvements and working with the City of Kalispell and
other organizations to make sure property owners are represented. The KBID has had a significant
positive impact on the progress and current revitalization of downtown Kalispell.

Improvement District.
The KBID is up for renewal, which requires signatures from property owners representing 60%
of the land area of the proposed district. We are proposing an expanded district to include
adjacent businesses to more fully represent what constitutes "Downtown Kalispell". With recent
reappraisals, most property owners in downtown Kalispell have seen a significant decrease in
their property taxes. KBID assessments have also decreased and the district needs to expand its
footprint to keep existing programs in place and add new programs. Please read, sign and return

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council on the 19th day of December, 2016,
passed Resolution No. 5793 declaring an intention to create a Downtown Business Improvement
District within the City of Kalispell, pursuant to Title 7, Chapter 12 Montana Code Annotated. The
exterior boundaries of the business improvement district are more particularly described in Exhibit
"A" attached hereto.
Said Resolution No. 5793 declares that the creation of such a business improvement district
will promote the health, safety, prosperity, security, and general welfare of the inhabitants thereof
and is in the best interest of the City of Kalispell; and will be of special benefit to the property within
the boundaries of the district.
NOTICE is further given that for a period of fifteen (15) days after December 28, 2016, that
date being the first day of publication of this Notice in the Daily Inter Lake, the City Clerk will
receive from the property owners in the area proposed to be included in the business improvement
district, written protests against the creation of the district to be assessed, or both.
The City Council of the City of Kalispell shall hold a public hearing on the 17th day of
January, 2017, at 7:00 p.m., in the Council Chambers, City Hall, Kalispell, Montana and consider all
communication received by the City Clerk pursuant to this Notice. After considering the same, the
Council shall proceed to hear and pass upon all protests and may duly and regularly pass and adopt a
Resolution approving the creation of the Downtown Business Improvement District as described in
Exhibit "A". Its decision shall be final and conclusive. If passed, the time when the said Resolution
shall go into effect shall be fixed by said Resolution.

A RESOLUTION OF INTENTION TO CREATE A BUSINESS IMPROVEMENT
DISTRICT FOR THE CITY OF KALISPELL, MONTANA, TO FIX A DATE OF A
PUBLIC HEARING, AND TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID
HEARING.
WHEREAS, pursuant to Section 7-12-1101, et seq., MCA, the City of Kalispell is authorized
to create business improvement districts; and
WHEREAS, the City of Kalispell has been presented with petitions signed by the owners of
more than 60% of the area of the property to be included in the district, the
exterior boundaries of which are shown on the attached Exhibit "A" and which by
this reference is made a part hereof; and
WHEREAS, the aforementioned petition requests that the City of Kalispell create a business
improvement district for up to ten (10) years, pursuant to Section 7-12-1101, et
seq., MCA; and
WHEREAS, the purpose of said business improvement district appears to promote the health,
safety, prosperity, security and general welfare of the inhabitants of the City of
Kalispell and the proposed district, and appears to be of special benefit to the
property within the boundaries of said proposed district as shown on the attached
Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That the Kalispell City Council intends to create a business
improvement district pursuant to Section 7-12-1101, et seq.,
Montana Code Annotated.
SECTION II. Said business improvement district would have boundaries as
shown on the attached Exhibit "A" which by this reference is made
a part hereof; provided, however, that all property classified as a
commercial improvement within the district will be included in the
district. All publicly owned property and owner -occupied single
family residential property within the district are specifically
excluded from the business improvement district and are exempt
from its assessments.
SECTION III. The City Clerk shall prepare and publish in the Daily Inter Lake, a
daily newspaper published at Kalispell, Montana, proper notice of
this Resolution of Intention in accordance with Section 7-1-4131,
Montana Code Annotated at least once a week for two successive
weeks; and give said notice in writing, addressed to all property
owners within the proposed business improvement district.
SECTION IV. For a period of fifteen days after the first publication of said notice
by the City Clerk, said City Clerk will receive expressions in
writing of the approval or disapproval of the proposed business
improvement district from property owners in the area proposed to
be included within the business improvement district.
SECTION V. At the regularly scheduled meeting of the City Council of the City
of Kalispell, next succeeding the expiration of said fifteen days, the
City Clerk shall forward all written communication received by
said Clerk for Council's consideration.
SECTION VI.
The City Council of the City of Kalispell shall hold a public
hearing to consider the proposed business improvement district at a
meeting to be held on the 17th day of January, 2017, at 7:00 p.m.,
in the Council Chambers, City Hall, Kalispell, Montana, and
subsequent to the conclusion of said meeting the City Council,
after considering all spoken and written communication, may
adopt a resolution creating the business improvement district and
the boundaries thereof shall include the property shown on Exhibit

For the Renewal of the
Business Improvement District in Downtown
Kalispell, Montana
I (we), a property owner within the proposed district, hereby petition the Kalispell City Council
to renew the Kalispell Business Improvement District, pursuant to the Business Improvement
District Act of the Montana Code Annotated Sec. 7-12-1101. The District shall run for 10 years.
The district would be renewed for the general purpose of continuing to promote private
investment and business expansion in the district; promoting increased densities at the city
core; making the district more competitive in the marketplace; and performing such other
functions as are necessary to carry out the purposes of Sec. 7-12-1131, and to further the
objectives of the district.
The boundaries of the proposed district are described on the map attached hereto and
incorporated herein.

City Council members:
Regarding the proposed creation of a business improvement district in the downtown
area of Kalispell, I am opposed as it creates an undue burden on the property owners in
that area and provides no benefit. With the property taxes in Kalispell already high, an
additional tax burden on an already struggling downtown area is inappropriate and
detrimental to the benefits of Kalispell. Although you state that it promotes Health,
Safety, Prosperity, Security and general welfare in this area I have not seen evidence of
that in the last few years. I therefore strongly object to being continually taxed for no
benefit.

which has been my home for nearly than 40 years. My property is
zoned residential, and just happens to be located on Main Street.
I am writing to formerly protest the creation of a SID which extends
south of Fifth Avenue. The inclusions of those properties south of Fifth
Avenue are historically removed from the downtown area. South Main
is not incorporated or a part of the Downtown Business Improvement
District. The area south of Fifth Avenue receives almost no services
:related to the business district, and the inclusion of my property will
increase my taxes without benefit. I do protest and object to the levy of
additional taxes for the benefit of the downtown businesses.
For the foregoing reasons, I urge the council to limit the SID to its
traditional boundaries and not extend the SID into the 500, 600 and 700
blocks of Kalispell.

Re: Business Improvement District Proposal No. 5793
Dear Ms. Brunckhorst:
We own the property located at 220 E. Center, Kalispell, MT 59901, which is in the
proposed Business Improvement District, and are writing to voice our objection to Resolution No.
5793 for several reasons. First, the Resolution does not state what cost will be for each property
owner or how that cost will be determined. It simply creates an authority, although not explicit in
the language of the Proposal, to impose an additional assessment on each property owner for an
unknown amount which presumably will be determined by the city council. As written, the
Proposal gives the City Council complete authority to impose any assessment they so choose for
whatever project they so desire and all to be paid for by property owners without any .
Second, the Proposal does not specify what the City intends to do with the funds. Merely
stating an intent to promote the "health, safety, prosperity, security, and general welfare" of those
property owners within the proposed boundaries is extremely broad. As written, this Proposal
means the City could spend the funds on just about anything, provided there is some tangential
connection to the health, safety, prosperity, security and/or general welfare of anyone (not just
those within the proposed District). Moreover, the Proposal does not restrict the City from
providing preferential treatment and/or use of public funds for one person/entity over another. For
example, the City could determine a privately -owned lot within the proposed District needs
maintenance and repair and the City could use these funds to do so, thereby increasing the property
value of a private citizen/entity. At the very least, the Proposal should have been written to specify
that funds will be used to improve u� spaces within the proposed District (i. e., roads, sidewalks,
street lighting, etc.). Again, this Proposal is vague and grants the City an improper carte blanche
authority to use the funds for practically whatever and however they wish.

Finally, the Proposal does not state who will be administering the funds to be raised nor
does it outline the process the City will undertake to determine how said funds will be used. Will
there be additional "notice and comment" process for the public to weigh in on potential uses?
Will there be a person or committee appointed to oversee this money? Simply stating there is a
need for a Business Improvement District with no clear direction on how it will be used does not
give us confidence any such funds will be used efficiently and for its intended purpose.
In closing, we urge you to consider the negative impacts this Proposal will have on the
Kalispell citizens and property owners. We have owned this property for decades and have always
kept it clean, updated and well maintained at our own cost and with our own labor. This Proposal
is poorly written and seeks to give the City free reign to impose whatever assessments it wishes,
to perform whatever work it wants, and with almost no restrictions or guidance on how the funds
will be used. For many reasons, including those set forth above, we are opposed to this Proposal.

I choose not to sign this petition and would request that my properties be
taken out of your downtown project. According to your map, I am at the
farthest corner of your designation and I receive none of the benefits you
speak of. I am not a retail business, I maintain all of my property myself and
have no amenities such as benches and Christmas lights. I understand the
importance of your retail perspective, but it its of little consequence to me
and not worth raising my taxes $184.00.
