MEMORANDUM OF REVERSION
THIS .MEMORAND UM OF REVERSION is made this 28 day of September, 2006
by and between the State of Montana and the City of Kalispell by which the parties
acknowledge the reversion of all title and interest to the below described real property

warranty deed, the following described real property to the State of Montana, recorded
0 that same date in Book 370, at Page 172, as Document No. 2201 in records of Clerk and
Recorder for Flathead County, Montana:
Commencing at a point eight hundred eighty (880) feet more or less
South 890 51 ' East of the northwest corner of Section 20, Township 28
North, Range 21 West to the west property line of U.S. Highway 93;
thence South 33 ° 01 ' East along property line si* hundred (600) feet to
the true point of beginning; thence continuing along the West property
line of U.S. No. 93 five hundred (500) feet South 33' 01 ' East; thence
three hundred (300)feet South 560 59' West; thence five hundred (500)
feet North 33 ° 01 ' Vest; thence three hundred (300) feet north 560 59'
East to the point of beginning, containing 3.44 acres more or less.
And otherwise legally described as:
Tract 1 of Certificate of Survey No. 17045, a tract of land, situated,
lying, and being in the North Half of the Northwest (Quarter of Section
20, Township 28 North, Range 21 West, P.M.H., Flathead County,
Montana,
WHEREAS, the above described warranty deed contains a use restriction and
reversionary clause that declares that the use of the property shall be for the purpose of
"construction and use thereon of an armory building and appurtenant facilities; should
said property be not used for said purposes or its use therefore be abandoned by said
party of the second part [State of Montana], its successors or assigns, title to said property
shall revert to and become revested in said party of the first part [City of Kalispell], its
successors or assigns."

WHEREAS, the parties agree and acknowledge that on the Vt day of February
2006, the State of Montana abandoned the use of the sub ect property as an armory
building and appurtenant facilities.
NOW THEREFORE, the parties agree that all title and interest in the above -
described property reverts to and is revested in the City of Kalispell.
